1 BE IT RESOLVED, that, upon the petition of the Department of Housing and Urban Development,
2 as documented in Finance Department File Number 97-C-10, and subject to the herein stated
3 exceptions, the easements within vacated properties hereinafter described are hereby released.

5 The vacated property from which easements are to be released is described as follows:

7 the vacated alley dedicated in Linse's Subdivision of Lots 9, 10 and 11, and parts of Lots 7 and
8 8 of Block 34 of Linse & Zimmerman's Re-arrangement of Blocks 33 and 34 of Brown &
9 Jackson's Addition to West St. Paul, accarding to the plat on file and of record 'm the office of
10 the Register of Deeds in and for Ramsey County, Minnesota.

12 This release of easements shall be subject to the following conditions:

14 L That the petitioner's their successors, and assigns agree to indemnify, defend and save
15 harmless the City of Saint Paul, its officers, and employees from all suits, actions, or claims of
16 any character brought as a result of injuries or damages received or sustained by any person,
17 persons, or property on account of this release of easements or petitioner's use of this
18 property, including but not limited to a claim brought because of any act of omission, neglect,
19 or misconduct of said petitioner or because of any claims or liability arising from any violation
20 of any law or regulation made in accordance with the law, whether by the petitioner or any of
21 their agents or employees
