VVFIEsREAS, the Divisi�of Public Health has requested the City Council to hold public
hearings to consides the advisability and necessity of�ordering the r�pair or wrecking and
removal of a one a�a half story, wood frame, severedy fire damaged, abandoned, deteriorated,
dangerous, single family residential structure with two �ta�ched, deteriorated, dangerous
garages, which are located on prope�ty hereafter refened ta as the "Subject Property" commonly
known as 605 Tl�mas Avenue. This propesty is legally described as: ,
Lot 19, Block 2, Michel's Subdivision of Block S, Stinson's Division of the NW
1/4 of Sectiai 36, Township 29, Range 23.
VVHEREAS, based upon the records in the Ramsey Cow�ty Registrar of Tifles Office on
September 6, 1991 a�other information available to the Division of Pub�ic Health on or before
September 12 1991, the followin$ persons are owners, inte�ested and/or responsible parties of
the Subject Property: Virginia M. Ronning, 1157 Osceola Aveltue, St. Paul, MN 55105;
Alcide Guillory, 301 Dore Aly, New Iberia, LA 70560; Taznmy L. Guillory, 301 Dore Aly,
New Iberia, LA 70560.
The �ddresses of the above noted persor►a we�e obtained from variou� s�onrces including
the Ramsey County taz records, phone books, mortgage �mpanies, etc.; and
VVHEREAS, the Divi.sion of Public Heaith h�s issu�ed orders identified as a "Dangerous
Structure Notic;e with A�cc;essory Dat►gerou� Structur�s " dated August 29, 1991 which is
attached and incor�wrat�ed as part of this R,esoluti� by this refe�ce. This order was served
in a�ccordance with t� provisions of Ctiaptea 45 of the Saint Paul I.egislative Code on all
owr�ers, interested a�/or responsible pa�rties of the Subject Praperty tt�en known to the
enforcement officer. The notice znd ord�r informed thest parties tl�t the one and a half story,
wood frame, seve�ely fire damaged, abandoned, deteriorated, dangemus, single family
residential structure located on the subject property is a dangerous structure pursuant to Section
45.01, Subd. 3 of the Saint Paul Legislative Code; tl� two deta�hed, deteriorated, dangerous
garages located on the Subject Praperty ue dangerous structures pursuant to Section 45.01,
Subd. 3 of the Saint Paul Legislative Code; �nd these buildings ate nuisarices pursuant to

notice and order, �cul as a result the Divisiai of Public Ii�th req�d that public l�rings be
scheduled to talce place on Wedn�sday, Octiober 16, 1991 befofe the Neighborhood Services
Committee of the Saint Paul City Council to prepare a recommendation to be reviewed and
decided on Thursday, Octd�r 24, 1991 by the Saint Paul City Council in considering the
advisability and necessity of ordering the co�rection of the nuisatwe condition through the
rehabilitation or, in tt� alt�rnative, the demolition and removal of these structures; and
VV]HEREAS,the above refe�ex►ced owners,int�r�sted and/or responsible parties have been
served notice of the time, place �nd purpose of the public hea�rings before the Neighborhood
Services Committee of the City of Saint Paul City Council on Wedn�sday, October 16, 1991 and
the Saint Paul City Council o� Thursday, October 24, 1991 �n �ccorda�e with tt�pmvisions
of Chapt� 45 of the Saint Paul Legislative Code; and
VVI�, a }�azing was held before the Neighborhood Service� Committee of the
Saint Paul City Council on Wednesday, October 16, 1991 and all testimony zr�d evidence was
considered by the committse; and
V��RF.AS, the Neighborhood Services Committee after receiving testimony and
evidence, made the recommendation to approve a request by the Division of Public Health to
order the above referenced owr�era, interested pazties �d respons�ble parties and their assigns
to make the Subject Property safe and not detrimental to tl� public peace, health, safety and
welfare and remove its blighting influence on the community by rehabilitating these structures
and correcting ttwse deficiencies sex forth in the list previously refe,renced in accordance with
all applicab�e codes and ordinances, � in the alteanative by demdishing and removing the
structures u�d filling tl�e site ia a�ccordance with all applicable c,odes and ordina�nces. The
rehabilitatioa or dGmolitia►of the structures to be completed within t�irty (30) days of the date
of mailing of this resolution; and
VVI�REAS, a hearing was held before the Saint Paul City Couacil on Thursday, October
24, 1991 and all testimony uid evidence incl�ding the xtion taken by tl� Neighborhood
Services Committee was conside,red by the Council; and
NOW, 'I'I�RF.FORE, BE IT RESOLVED that based upon all of tl� t�stimony and
evidence presented at the Thursday, October 24, 1991 hearing, the Saint Paul City Council
hereby adopts the following Findings And Order c�cerning the structures at 605 Thomas
Avenue:
1. That si�e September of 1990 the buildings have been routinely monitored by the
Nuisance Buildings Code P�forcemeait Program.
2. That since Septemb�er of 1990 the City of S�iint PAUi has on three (3) occasions
issued ord�as to the th�en luwwn owners to make these buildings �ecure and not
acoessible. Beca,use of the inactioa on tbe put of the owners, the City has had
to hire a private contr�ctor to mal�e the buildings seeure u�d not ope,n to access.

tl�v�cant building foe for this prn�rty as requifed by City Ordinazice.

5. That the owners, interested parties and responsible parties of these buildings are
a� previously stated in this resolution. These individwlls have bePai properly
serve�notice of the Wednesday, October 16, 1991 and the 1'hursday, O�tober 24,
1991 heuings c�ncerning these buildings.
6. T'hat on August 29, 1991 a Dangerous Structure Notice with Accessory
Dangerous Smicctures was se�►t to the then known owners, interest� parties and
responsib1e p�rties ordering these persons to either demolish and remove these
buildings or make rep�airs and cure the list of deficiencies by Septsmber 13, 1991.
7. That the ord�r of August 29, 1991 has been disregazded by the owners, intesested
parties and responsible pazties.
8. That the one and a half sto�►, wood frac�e, seve,rely fire damaged, abandoned,
dete�iorated, dang�aous, single family resi�tial structure with two detached
deterioratsd, dangerous garages located on th� Subject Property are dangerous
stnlctures according to Section 45.01, Subd. 3, of the Saint Paul Legislative Code
in that they are "structures wluch ue potea�tially dangerous to persons or
property, including, but not limited to: a)a structure which is in danger of partial
or complete collapse; b) a stcucture which has any exterior parts; such as
chimneys, eaves, porches, siding, railings � trim, which are loose or in danger
of falling; or c) a structure which has any parts, such as porches, sta,i.rs, ramps,
rails, balconies or roofs, which are aocessible and which are either collapsed, in
danger of collapsin8, or uaable to support a person".
9. 7'hat the one and a half story, wood frame, severely fire damaged, abandoned,
deteriorated, dui8e�ous, single funily residential structure with two deta�ched,
deteri�or.�ted, dangero�s gar�ges located on the Subject Properly are nuisances as
defined according to Saint Paul I.egislativc Cod�e Section 45.02, Subd. 18, in that
they arre dangerous struct�es loczted in the City of Saint Paul that ha� created a
dangerous or unhealthy condition or wluch threatens the public pea�ce, health,
safety or sanitary condition of the City or which is offensive or has a blighting
influence on the community.
10. That the oosts of abatement af thes�e nuisances are estim�ted to exceed two
� dollus (52,000.00) or tlle abatement involves demolition of a building
other tt�an � struct}ue a�rcessory to a residex►ti�l building.

3. In�he c�ve,�►t the buildings are to be demolish�d and removed by the City of Saint
Pau1, all P�o�al PropertY or fixpues of any kind wluch shall unreasonably
interfere with�e demolition and removal shall be removed fron�the buildings by
the owne�rss, interested parti�s and/or respons�:ble parties by the end of the fifteen
(15) day t� period. If the p�tsonal prop�rty i,a not so re�noved, the City of
Saint Paul shall remove asd dispose of�ch pro�erty a�d fixtures as is provided
by law. .
4. IT IS FURTHER ORDERED thzt a certified copy of this resolution and the

Dear Sir or Madam:
The Division of Public Health has determined that the above noted buildings aze dangerous
structures, which Chapter 45 of the Saint Paul Legislative Code defines as:

"any structure which is potentially dangerous to persons or property including but not
limited to:
(a) a structure which is in danger of partial or complete collapse; or
(b) a structure which has any exterior parts such as chimneys, eaves, porches,
siding, railings, or trim which are loose or in danger of falling; or
(c) a structure which has any parts such as porches, stairs, ramps, rails, balconies,
or roofs which are accessible and which are either collapsed, in danger of
collapsing, or unable to support a persons."
The Division of Public Health has also determined that there are dangerous structures in the
form of two detached, deteriorated, dangerous garages accessory to the above noted building,
which Chapter 45 of the Saint Paul Legislative Code defines as:

"any structure which is potentially dangerous to persons or property including but not
limited to:
(a) a structure which is in danger of partial or complete collapse; or
(b) a structure which has any exterior parts such as chimneys, eaves, porches,
siding, railings, or trim which are loose or in danger of falling; or
(c) a structure which has any parts such as porches, stairs, ramps, rails, balconies,
� or roofs which are accessible and which are either collapsed, in danger of
collapsing, or unable to support a person."
The ordinance further states that a dangerous building and dangerous structures are both
nuisances and may be ordered demolished and removed by the City.
NOTICE: If you do not want to have the City begin action to have the buildings torn
down, then the attached list of deficiencies must be repaired or you must demolish and
remove the buildings on or before September 13, 1991.
If you are unable to finance the correction or rehabilitation of the premises to comply with
this order, there are state and local rehabilitation programs for which you may qualify.
Information about these programs is available from the Department of Planning and
Economic Development, Rehabilitation Section at (612) 228-3105. Ask to speak to a loan
officer.
If you sell, transfer or convey, in any manner, the ownership or responsibility for this
property, you must within seven (� days of such action, provide the Division of Public
Health with the names and addresses of any new owners or responsible parties.
You must also notify any new owners or responsible parties of this pending action by
the Division of Public Health.
Any repair or demolition must be completed in accordance will all applicable laws.
If the rehabilitation work is not completed or if you have not demolished and removed the
house and the two detached, deteriorated, dangerous garages by the above date, the Division
of Public Health will refer this matter to the City Council to receive authority to have the
house and the two detached, deteriorated, dangerous garages demolished and removed. All
costs incurred in wrecking and removing the buildings will be charged against the real estate

as a special assessment to be collected in the same manner as taxes. The City Council will
schedule public hearings to consider the necessity and advisability of ordering the buildings
repaired or demolished and removed. If public hearings become necessary, you will be
nodfied of the times and dates of the hearings and you will be allowed to present evidence to
the City Council.
A copy of this order will be kept on file in the City Clerk's Office and a resolution declaring
this property to be a.nuisance shall be on file in the Ramsey County Recorder's Office.
Compliance with the attached list of deficiencies will remove your building from the list of
abandoned buildings but it does not mean that the buildings comply with all applicable
housing and building codes.
The date for compliance with these orders shall not be extended unless you receive written
approval from the Division of Public Health.
If you wish to have the City demolish and remove your house and the two detached,
deteriorated, dangerous garages, you may do so by requesting a consent form be sent to you
from our office to sign and return to the Division of Public Health. However, please be
aware that all owners and interested parties must sign a Consent to Raze form before the
City can demolish and remove the buildings without a City Council order. Also be aware
that the cost of the demolition, if performed by the City, would become a special assessment
against the property.

DEFICIENCY LIST
FOR
605 Thomas Avenue �
August 14, 1991
All repairs and new installations must be made in accordance with the appropriate codes.
Permits must be obtained where changes and/or additions to an electrical system require
upgrading of the service size to current National Electrical Code (N.E.C.) requirements.
Some plumbing repairs may necessitate updating of the fixtures and/or piping involved. A
permit is required for any repair or new installation. Permits may be obtained from the
Building Inspecdon and Design Division, Room 445, City Hall.
REMEDIAL ACTION
The below list of deficiencies is not necessarily all the de�iciencies present in the above
referenced property. As first remedial action, a Code Compliance Inspection must be
obtained from the Building Inspection and Design Division, Room 445, City Hall,
identifying all necessary repairs.
1. The house has been severely damaged by a fire which occurred prior to September
25, 1991.
The utility services are off.
2. There has been no repair work performed to the house and no building permits have
been issued for repair work.
3. Prior inspections of the interior establish conditions which comprise material
endangerment and the house does not appear repairable due to the extensive fire,
smoke and water damage.

The building is a one and a half story, wood frame, severely fire damaged, abandoned,
dete�iarated, dangerous, single family residential slxucttu+e with two detached, deterioratsd,
dangerous garages.
The subject propesty has been routinely monitored by the Nuisance Buildings Code
Fnforcement Program since September of 1990.
The building meets one or more of the conditions that constitute an Abandoned Building as
defined in Chapter 45 of the Saint Paul Legislative Code.
On August 29, 1991 the Division of Public Health mailed an order to the thea known
owners, interested parties and responsible parties of this building requiring that the building
be either repaired, by con�cting the attached list of deficie�cies, or demolished on or before
September 13, 199 L
Inasmuch as the order has not been complet�ed to the satisfaction of this Division and the
continued abandoned condition of the building contributes a blighting influence and potential
hazard to the neighborhood, it is the recommendation of this Division that the City Council
pass a resolution ordering the owners, intesested and/or responsible parties to either repair or
demolish and remove the building in a timely manner to the satisfaction of the City.
In the event the owne,rss, intesested and/or responsible parties fail to comply with the Council
Resolution, the Division of Public Health should be authorized to demolish and remove the
building and assess all costs incurred in the demolition and removal against the real estate as
a special assessment to be collected in the same manner as taxes.
This matter will have a Public Hearing before the Neighborhood Services Committee as well
as the full City Council.
