91-1988 C,�RIGI�IAI � . • � - I 2 ouncil File # �/`f�� Green Sheet � g�� RESOLUTION CITY OF SAINT PA , MINNESOTA . �, � � Presented By `�� ' Referred To --��/ \ Committee: Date � WHEREAS, on June 27, 1991, the Division of Public Health fogged or dye tested a rodent hole on the property located at 831 Ashland Avenue in Saint Paul, Ramsey County, Minnesota, and discovered that the sewer line connecting the above described property to the City sewer system was broken; and WHEREAS, broken sewer lines a11ow rats to tunnel to the surface of the ground and allow raw sewage to escape and have been determined to be public nuisances by the Division of Public Health; and WHEREAS, on July 3, 1991, the Division of Public Health sent written orders to Mr. Lee B. Nelson, the owner of the property located at 831 Ashland Avenue, ordering him to summarily abate this public nuisance by repairing the broken sewer line; and WHEREAS, the written orders of the Division of Public Health required Mr. Nelson to abate this public nuisance within thirty (30) days and that Mr. Nelson filed a timely appeal of the said order with the City Clerk; and WHEREAS, the Saint Paul City Council, on August 8, 1991, conducted a public hearing on said appeal and affirmed the Division of Public Health's summary abatement order and further ordered that the sewer line connecting the property located at 831 Ashland Avenue to the City sewer system be repaired within seven (7) days of publication of this resolution; NOW, THEREFORE, BE IT RESOLVED, that the summary abatement order of the Division of Public Health issued to the property located at 831 Ashland Avenue, Saint Paul, Ramsey County, Minnesota, on July 3, 1991 is hereby affirmed except as modified herein, and be it �� /�c�i-'9� : � FURTHER RESOLVED, in the event that the said public nuisance is not abated within seven (7) days following publication of this resolution, the City may proceed to perform or complete the work necessary to abate the said public nuisance with any costs incurred therefrom to be collected in the manner provided by law. (See Attached) The grounds for appeal are two fold. First, any problem with sewer line was caused by City Water Department and their failure to properly repair the sewer which they admittedly damaged in the past. Second, if the City is not responsible, per the Water Department' s action or in action, then I am at most half responsible for the cost of repair because my neighbor ( 829 Ashland) shares the connection to the city sewer system (a four unit condominium was buil� on 2 city lots and the original connections were not changed) . Nelson 831 Ashland Avenue ( #831 ) St. Paul , Mn. 55104-7122 Dear Mr. Nelson On June 27 , 1991 , our Animal Control crew fogged or dye tested a rodent hole on the property at 831 Ashland Avenue . The test indicates that the sewer line that connects your property to the City sewer system is broken. Broken sewer lines cause unsanitary conditions , and allow rats to tunnel to the surface of the ground. The repair of a broken sewer line from the property connection to the City sewer connection is the responsibility of the owner of the property. This is your notice that you must complete the above noted re�air . You may appeal this order and obtain a hearing before the City Council by filing a written request for a hearing with the City Clerk` s Office, Room 386 City Hall , 298-4231 , within seven ( 7 ) days from the date of this order. You will be notified by the City Clerk' s Office when the hearing will be held. If you do not file an appeal , a reinspection of your property will take place in 30 days to ascertain that the ordered repairs were made. ( If corrective action has not been taken, the City of Saint Paul may repair or replace the broken sewer line at your expense on your property. This is necessary to eliminate the public health hazard , and any unsanitary condition caused by such broken sewer lines ) . You may hire your own licensed house sewer contractor . You may also have the City of Saint Paul make repairs on your property. A permit and inspection is required for all repairs or replacement of the sewer line . The permit may be obtained at the Building Inspection and Design Division, Room 445 City Hall , 298-4212 .
