WHEREAS, Section 5.02 of the St. Paul City Charter and Section 3.04 of the
Administrative Code authorize the City Council, upon request of the City Attorney, to
appoint special counsel and provide compensation therefor in cases where the City
Attorney by reason of interest cannot represent the City; and
WHEREAS, the City Attorney's Office has been asked to assume jurisdiction over
complaints filed by the Ethical Practice Board against City Council Member Tom
Dimond in order to determine whether criminal charges are appropriate, and
WHEREAS, the City Attorney's Office provides legal services to the Saint Paul
City Council, of which Tom Dimond is a Councilmember, and
WHEREAS, the City Attorney believes that it would be a conflict of interest for
the City Attorney's Office to provide legal services to the Councilmember Dimond and
to determine the merit of the Ethical Practices Board complaints; now, therefore, be it
RESOLVED, that by virtue of said conflict circumstances, Michael Scott be
retained to provide legal services necessary to determine whether probable cause exists
to support the charges against Councilmember Dimond; and, be it
FURTHER RESOLVED, that such legal services shall include: review of the
records from the Ethical Practices Board underlying the complaints filed against Mr.
Dimond and a decision as to whether probable cause exists to issue criminal complaints;
and that the fee for such services shall not exceed $100.00 per hour, which is a
discounted fee offered to the City; and, be it

fee having reference to the appropriate provisions of the Code of Professional
Responsibility.

Re: Councilmember Tom Dimond
Dear Mr. Moline:
This letter is being submitted to the Ethical Practices
Board in response to your letter to Tom Dimond dated September
26, 1991, which pertained to complaints against Mr. Dimond filed
with the board by Donald Oakey and Dino Guerin.
• Before responding to the allegations in the referenced
complaints, I must express my profound dismay over the
inexcusable delay and resultant unfairness involved in the
processing of these complaints by the board. The complaints were
sent to the board on June 10 and July 16, 1991, respectively.
Your letter to Mr. Dimond, which notified him of the complaints
and provided him with an opportunity to respond, was delayed
fifteen weeks from your receipt of the first complaint and ten
weeks from your receipt of the second. The result of this delay
has been to thrust these complaints upon Mr. Dimond and into the
upcoming arena of public debate with just six weeks remaining
before the election. By so doing the board has all but
guaranteed that Mr. Dimond must endure the taint of accusation
throughout the most critical weeks of the campaign, without any
opportunity for exoneration through a proper and timely inquiry.
The facts that the complaints are so palpably political and
so utterly devoid of inerit only compound the injustice caused by
the board's delay. Moreover, there is nothing in the nature of
the allegations which possibly could justify the many weeks of
inaction. As you note in your own letter, the alleged incidents
were the subject of a prior review by the board, thereby
requiring little additional evidence to put the remaining
allegations to rest.

The injury caused to Mr. Dimond by the board's delay on
these complaints cannot be eliminated. However, the injury can
be minimized by an immediate review and decision in this matter,
I can assure you of the total cooperation of Mr. Dimond in this
process.
I turn now to the substance of the complaints from Donald
Oakey and Dino Guerin. Both allege that the Friends and
Supporters of Tom Dimond committee raised and spent more than the
$350 reported in its campaign financial reports. The alleged
bases for these allegations are as follows:
a. The committee distributed literature at an expense
greater than $350. Mr. Oakey claims the distribution
of 1,000-1,500 letters, and Mr. Guerin claims the
distribution of 20,000. (Doesn't the disparity in
these allegations tell you something about the
reliability of the complainants?)
b. The committee paid a settlement exceeding $350 to John
Babler for a defamation action brought by Babler
against committee supporters.
� c. The Committee did not record campaign services from
.
Larry Kitto as an in-kind donation.
In response to these allegations I have enclosed the
following evidence.
a. An affidavit of committee treasurer pon Crotty, which
includes a complete copy of the campaign finance
report. Mr. Crotty also reports in his affidavit that
the committee distributed approximately 1, 000 pieces of
literature during the 1989 campaign. Additionally, Mr.
Crotty reports that he was a personal defendant in the
referenced lawsuit involving Mr. Babler, and that he
paid the settlement to Mr. Babler from his personal
funds. The canceled settlement check is attached to
his affidavit. Finally, Mr. Crotty affirms that Mr.
Dimond had no involvement in the finances or reporting
� of the committee. �
- - b. An affidavit of Tom Dimond. Mr. Dimond states that
while he-was aware of the committee�s activities, he
played no role in the organization, he was not involved
. in fund raising for the organization, he had no control
over expenditures of the organization, and he had no

involvement in the preparation of the filing of reports
by the organization.
The allegations in the complaints can now be viewed in the
context of the applicable ordinances. Your letter states that
the alleged conduct falls within Chapter 28 of the St. Paul
Legislative Code (Campaign Contributions) Section 28. 04 (a) . That
section provides as follows:
Candidates. Any candidate, or secretary of a personal
campaign committee or treasurer of a committee or
political fund who receives, accepts, benefits from, or
expends any campaign contributions which said
candidate, secretary or treasurer knows to have been
contributed or expended in violation of this chapter is
guilty of a misdemeanor.
(Emphasis added. )
I must first note the extraordinary breadth of this '
ordinance and its questionable constitutionality to the extent
that it purports to impose criminal liability upon one person who
merely benefits from the conduct of another. Moving beyond that
issue, the ordinance itself required both the existence of a
violation and the knowledge of a violation in order to attribute
guilt to a candidate. Here there is no evidence that a violation
occurred. Even if it did, Mr. Dimond was utterly without
knowledge of the same.
The final allegation included in the complaints pertains to
the failure of the committee to record the services of Mr. Kitto
as an in-kind donation. I call the board's attention to Section
28. 01 of Chapter 28, which includes the following in the
definition of �"contribution":
"Contribution" does not include services provided
without compensation by an individual volunteering his
time on behalf of a candidate, ballot question,
political committee, personal campaign committee or the
publishing or broadcasting of news items or editorial
comments by the news media.
Quite clearly, services which are volunteered to a campaign are
expressly excluded as contributions which must be reported.
Based upon the foregoing, I urge the board to immediately
dismiss the complaints against Mr. Dimond in accordance with the
Administrative Code, § 111.07B(4) (b) 1. If for any reason the

board feels the need for additional investigation, we are
prepared to fully cooperate upon very short notice.
The board should be advised that today Mr. Dimond has asked
City Attorney Jane McPeak to facilitate a prosecutorial review of
allegations against him pending before the board. The reason for
this request is our deep concern that the pattern of delay and
inaction by the board will continue, thereby causing these
complaints to remain unresolved through the balance of the
campaign. For that reason Mr. Dimond is willing to bypass the
board and to have the allegations presented directly to a
prosecutor, since any violations found by the board must result
in a referral for prosecution. Based upon the evidence, we are
confident that prosecutorial review will result in a prompt and
total exoneration.
We recognize that this request to the city attorney must
result in the appointment of a special prosecutor, since that
office cannot itself act as a prosecutor on allegations of
misconduct involving city officials. Thus, the request will
result in very substantial _expense to_the citizens of St. Paul.
The expense can be avoided if the board can respond to the demand
for justice contained in this letter by promptly reviewing and
acting upon this: matter. .

Dear Ms. McPeak:
On behalf of Tom Dimond I am requesting your office to
assume jurisdiction over a series of complaints filed against Mr.
Dimond with the Ethical Practices Board. Those complaints
include two which were announced to Mr. Dimond by the board on
September 26, 1991 in a letter from board staff Michael Moline
and several others which are the subject of .a suit filed today by
. your office on Mr. Dimond's behalf against the Ethical Practices
Board.
I am requesting that your office asswne jurisdiction over
these complaints simply because the board has shown itself to be
unwilling or unable to process the complaints in a timely manner.
As a consequence, Mr. Dimond has been the subject of innuendo and
the taint of accusation during his current campaign, even though
the complaints before the Ethical Practices Board should have
been resolved�many months ago.
' By calling upon your office to exercise jurisdiction, I
recognize that this entails the need for the appointment of a
special prosecutor because of the conflict of interest created by
your representation of Mr. Dimond. Unfortunately, I see no
alternative to this course of action. If the allegations in the
complaints before the Ethical Practices Board are meritorious,
they eventually will come to your office in any event, since they
entail misdemeanor offenses upon which the board itself is
powerless to act. It would be our preference, of course, that
the board perform its duty in a timely fashion, thereby making
its own determination on the probable cause issue and possibly
avoiding any need for the appointment of a special prosecutor.

The past failure of the board to move, however, makes this
prospect unlikely.
Mr. Dimond is entitled to a decision on these baseless
allegations, and he is entitled to one promptly. The failure of
the Ethical Practices Board to act in a timely manner is causing
injury to Mr. Dimond which can never be eliminated, but only
abated by prompt action at this time. The district court
complaint filed by your office on behalf of Mr. Dimond recognizes
the fundamental unfairness of this inaction by the Ethical
Practices Board. Therefore, I urge you to take the additional
step of appointing a special prosecutor to consider the merit of
the dormant complaints. Additionally, I urge that you direct the
special prosecutor to investigate and resolve these matters with
the utmost dispatch. Only in this way can some measure of
justice be restored to Mr. Dimond.
