WHEREAS, plans for Project No. S. A. P. 62-630-36 (construction of Larpenteur
Avenue between 35E and Edgerton), �S.P. 62-630-21 (construction of a bridge%ulvert
on abandoned Soo Line right-of-way at Larpenteur Avenue), and S. A. P. 62-630-35
(proposed right-of-way acquisition to accommodate the bridge and road construction)
have been approved by the Saint Paul City Council, and
WHEREAS, the City of Saint Paul will contribute approximately $53,500 to some of the
storm sewer, curb and gutter construction because. it involves City`property, now,
therefore
BE IT RESOLVED, that the City of Saint Paul enter into Ramsey County Agreement
No. 89006 to provide for payment of approximately $53,500 from the County Aid Fund
by the City of Saint Paul to Ramsey County for the City's share of construction costs on
said projects, and
BE IT FURTHER RESOLVED, that the proper City Officials are hereby authorized and
directed to execute said agreement.

THIS AGREEMENT, by and between the City of St. Paul, Minnesota, a municipal
corporation, hereinafter referred to as the "City," and Ramsey County, a political
subdivision of the State of Minnesota, hereinafter referred to as the "County";
WITNESSETH:
WHEREAS, The County and the City desire to construct and rebuild Larpenteur
Avenue between I-35E and Edgerton Street from a point 545 feet west of the west line --
of Section 17, T29N, R22W to a point 2587 feet east of the west line of Section 17,
T29N, R22W along the north line of said Section 17 a distance of 2042 feet; and
WHEREAS, Larpenteur Avenue from I-35E to Edgerton Street is partially in the
City of Maplewood; and
WHEREAS, the City of Maplewood and the County have a separate Cooperative
Agreem ent No. 89005; and
. WHEREAS, the work contemplated under this agreement has been divided into
three separate plans which provide for the bridge replacement, right of way acquisition
and road reconstruction; and __
WHEREAS, the replacement of Bridge No. 7231 with Bridge No. 62554 has been
designated by the Minnesota Department of Transportation as eligible for certain
construction costs reimbursement from the Federal Bridge Replacement funds and
identified as MINN. PROJ. NO. BRM-M5103(1); and

WHEREAS, this bridge replacement project has been designated by the Minnesota
Department of Transportation as eligible Por certain construction costs reimbursement
from the County State Aid Highway funds and identified as S.P. 62-630-21 Bridge No.
62554; and
W�iEREAS, the right of way acquisition project has been designated by the
i�7innesota Department of Transportation as eligible for certain construction costs
reimbursement from the County State Aid highway funds and identified as S.A.P. 6?-
630-35; and
WHEREAS, this road pro�ect has been designated by the Minnesota Department
of Transportation as eligible for certain construction costs reimbursement from the
County State Aid Highway funds and identified as S.A.P. 62-630-36; and
WHEREAS, plans for this project MINN. PROJ. NO. BRM-M5103(1), S.P. 62-630-
21, Bridge No. 62554, S.A.P. 62-630-35, S.A.P. 138-020-10, S.A.P. 62-630-36, and S.A.P.
138-020-07 showing proposed alignment, profiles, grades and cross sections for the
improvement of County State Aid Highway 30 within the limits of the City as a County
State Aid Highway project has been presented to the City; and
WHEREAS, the projects include, in addition to other things, right of way acquisition,
grading, concrete curb and gutters, storm sewer, storm water laolding ponds, bridge
replacement, sidewalks, and City utility adjustments and/or improvements; and
WHEREAS, the Minnesota Department of Transportation has determined allowable
credit for storm sewer outfall lines previously constructed prior to the project, and
the resulting portion of this storm sewer system eligible for County State Aid funds
as present in D.V. Halvorson, MN/DOT Hydraulics Engineer, office memorandum dated
July 27, 1988.
NOW, THEREFORE, IT LS HEREBY MUTUALLY AGREED AS FOLLOWS:
- 1. The County shall prepare the necessary plans, specifications and proposals,
take bids, and with concurrence of the City and the City of Maplewood, recommend
award of a contract for the construction of Bridge No. 62554 to be awarded by the
Minnesota Department of Transportation; the County shall perform the construction
inspection.
2. Upon completion of Bridge No. 62554 the County shall own and maintain
the bridge; however, the Minnesota Department of Natural Resources shall be responsible
for usage and operation of the trail opening and shall provide normal maintenance and
access for that usage.
3. The County has prepared the necessacy plans, descriptions and estimates
and with the approval of the City, the City of Maplewood and the Minnesota Department
of Transportation acquired the neeessary right of ways in accordance with procedures__
for reimbursement from State Aid funds.
4. Right of way required for the construction is estimated to be 10096 eligible
for State Aid funds reimbursement and this portion shall be paid by the City of
Maplewood and the County.

- _ 5. All road project right of way and temporary easements will be in the
name of the County, and parking and other regulations will be controlled by the County.
All highway rights of way on the project which are owned or acquired by the City shall
be assigned by the City to the County. All storm sewer and storm water holding pond
right of way in the City beyond the road right of way shall be assigned by the County
to the City.
6. The County shall prepare the necessary plans, specifications and proposals,
take bids, and with concurrence of the City and the City of Maplewood, award a
contract for the roadway construction; the County shall perform the construction
inspection.
7. The City shall assist the County in the inspection of the sanitary sewer
and watermain adjustments.
. 8. The storm sewer system as shown in the plans and specifications is eligible
for construction cost reimbursement of 60.90% by County State Aid funds based on
the hydraulics memorandum and this portion shall be paid by the County.
9. The City shall pay for 8.459b of the construction cost of the storm sewer
system which portion is attributable to contributing area from the City outside the
road right of way and not eligible for reimbursement from County State Aid Highway
funds. The remaining 30.6596 shall be paid by the City of A4aplewood.
10. Upon completion of the project the County shall own and maintain the
storm sewer catchbasins and leads and the City shall own and maintain the storm sewer
trunk lines within the City. Laterals and drains servicing property within the City
outside the road right of way and storm sewer water holding ponds shall also be owned
and maintained by the City.
11. The City shall pay to the County 75% of the cost of concrete curb and
gutters constructed within the City except for replacement of existing concrete curb
and gvtters.
12. Any City utilities or facilities modified or added to those provisions
presently made in the plans and specifications may be incorporated in the construction
contract by supplemental agreement and shall be paid for as specificed in the
supplem ental agreem ent.
13. All liquidated damages assessed the contractor in connection with the work
performed on the project shall result in a credit shared by the City of Maplewood, the
City and the County in the same proportion as their respective total share of construction
work is to the total construetion cost without any deduction for liquidated damages.
14. The City shall pay 109b of its share of the construction cost, as determined
dy the contract proposed to be awarded, to the County as a preliminary engineering
fee. This fee shall be due after receipt of bids and prior to award of a construction
-- contract.
15. In addition to the preliminary engineering fee the City shall pay 8% of
its share of the construction cost, as determined by the final estimated contract
amounts, to the County as a construction engineering fee. This fee shall be due upon
notification to the City of the estimated final amounts due to the contractor. -

16. The City shall not assess or otherwise recover any portion of its costs
for this project through levy on County-owned property.

17. The County shall, when a construction contract is proposed to be awarded,
prepare a revised estimate and cost participation breakdown based on eonstruction
contract unit prices and submit a copy to the City. The City agrees to advance to
the Treasurer of Ramsey County an amount equal to the City total construction cost
share plus preliminary engineering costs. The contractor shall then be paid by the County.
18. Upon completion of the work, the County shall prepare a revised estimate
of cost and cost participation breakdown based upon the contract unit prices and the
actual units of work estimated to have been performed and submit a copy to the City.
The construction engineering costs to be paid the County by the City shall be based
on this estimated final construction cost. The County shall add to the City estimated
final construction costs the preliminary engineering based on the contract as awarded
and construction engineering costs, make necessary adjustments for liquidated damages,
if any, and deduct City funds previously advanced to the project by the City. The
City agrees to pay to the County any amount due, be it more or less than the estimated
sum of the� first revised estimate. In the event the calculations show that the City
has advanced funds in greater amount ttu�n is due the County, the County shall refund
the amount to the City without interest.
19. Preliminary plans reviewed at the public hearing and final plans and
specifications are hereby in all things approved.

Establishes a contract with Ramsey County to implement an approved 1988 CIB project related to the reconstruction of Larpenteur between 35E and
Edgerton.
Background:
Larpenteur Avenue borders the City of Saint Paul. This reconstruction work is joinfly financed by Saint Paul,Maplewood and Ramsey County. Saint
Paul's funding will cover a portion(8.45%)of the storm serwer,curb and gutter design and construction.
Major Issues:
None.This action implements an approved project.
Fiscal Impact: (Current Year and Following Year)
The current estimate for Saint Paul's share of this project is$53,476.38. $50,000 was approved in the 1988 CIB(County Aid)to fund this project. There
are sufficient funds set aside in the 1988 County Aid Contingency($62,500)to cover the difference.
Recommendation:
Recommend approval. An administrative order can be processed later to fmance the balance,once the actual contract costs are known.
Follow-up Recommended, If Any:
Public Works accounting staff should monitor actual costs and then process an administrative order.
