WI�REAS, the Division of Public Health has requested the City Council to hold public
hearings to consider the advisability and necessity of ordering the repair or wrecking and
removal of a two story, wood frame,boarded, condemned,deteriorated, single family residentiai
structure with a detached dilapidated,boarded, deteriorated dangerous garage, which are located
on property hereafter refened to as the "Subject Property" commonly known as 1024 Ross
Avenue. This property is legally described as:
The West 12 1/2 feet Lot 7 and the East 25 feet of Lot 8, Block 13 Teny's
Addition to St. Paul
VVI�REAS, based upon the records in the Ramsey County Recorder's Office on 7uly 3,
1991, and other information available to the Division of Publ�c Health on or before August 20,
1991, the following persons aze owners,'interested and/or responsible parties of the Subject
Property: Nellie Kotke, C/O Edwin Kotke, Route #1, Box 191A, Sazona, WI 54870-9801;
Edwin Kotke, Route #1, Box 191A, Sarona, WI 54870-9801; Office Manager - Revenue
Division, Property Taxation - Delinquent, 15 Kellogg Blvd. W.
St. Paul, MN 55102.
The addresses of the above noted persons were obtained from various sources including
the Ramsey County t�c records, phone books, mortgage companies, etc.; and
W��RFAS� �Division of Public Health has issueci orders identified as an "Abandoned
Building Notice with Dangerous Accessory Strueture" dated July 17, 1991 which is attached and
incorporated as part of this Resolution by this reference. This order was served in accordance
with the provisions of Chapter 45 of the Saint Pzul Legislative Code on all owners, interested
and/or responsible parties of the Subject Property then k�wwn to the e�n�orcement officer. The
notice and order informed these parties that the two story, wood frame, boarded, condemned,
deteriorated, single family residential stcvcture locat�ed o� the subject property is an abandoned
building pursuant to Section 45.01, Subd. 1 of the Saint Paul Legislative Code; the detached
dilapidated, boarded, deteriorated dangerous garage located on the S�bject Property is a
dangerous structure pursuant to Section 45.01, Subd. 3 of the Saint Paul Legislative Code; and
both buildings ue nuisance�pursuant to Sections 45.02, Sut�d. 10 and Subd. 11 of the Saint Paul
Legislative Code. The 7uly 17, 1991 order also had 1tt�ched to it a list of defi�ciencies regazding
the structures on the Subject Property, said list is attached and incorporated as part of this
resolution; and

�VIHEREAS, tt�e July 17, 1991 order informed all�hen known owners, interested parties
and responsible parties that they must either repair tbe structuree� o� tt;e Subject Property by
correcting the list of deficiencies or demolish the buildings, either a�ction to take place by August
17, 1991.
VVHEREAS, no action has been taken regazding compliance with the July 17, 1991 notice
and order, and as a result the Division of Public Health requested that public hearings be
scheduled to take place on Wednesday, October 2, 1991 before th� Neighborhood Services
Committ�ee of the Saint Paul City Council to prepare a recommendation to be reviewed and
decided on 1�esday, October 8, 1991 by the Saint Paul City Council in considering the
advisability �nd necess�ty of ordering the correctior� of the nuisance conditions through the
rehabilitation or, in the alternative, the demolition and removal of these structures; and
VVHEREAS,the above referenced owners,interested and/or responsible parties have been
served notice of the time, place and purpose of the public hearings before the Neighborhood
Services Committee of the City of Saint Paul City Council on Wednesday, October 2, 1991 and
the Saint Paul City Council on T�esday, October 8, 1991 in �ccordance with the provisions of
Chapter 45 of the Saint Paul Legislative Code; and
VVI�REAS, a hearing was held before the Neighborhood Services Committee of the
Saint Paul City Council on Wednesday, Oct�ber 2, 1991 and all testimony and evidence was
considered by the committee; and
VV��EREAS, the Neighborhood Services Committee after receiving testimony and
evidence, made the recommendation to approve a request by the Division of Public Health to
order the above referenced owners, interested parties and responsible parties and their assigns
to make the Subject Property safe and not detrimental to the public peace, health, safety and
welfare and remove its blighting influe�ce on the community by rehabilitating these structures
and correcting those deficiencies set forth in the list previously refe�renced in accordance with
all applicable codes and ordinances, � in the alternative by demolishing and removing these
structures and filling the site in accordance with �11 applicable codes and ordinances. The
rehabilitation or demolition of these structures to be completed within thirty(30)days of the date
of mailing of this resolution; and
VVIEiEREAS, a hearing was held before the Saint Paul City Council on T�esday, October
8, 1991 and all testimony and evidence including the aetion taken by the Neighborhood Services
Committee was considered by the Council; and
NOW, THEREFORE, BE IT RESOLVED that based upon all of the testimony and
evidence presented at the Tbesday, October 8, 1991 hearing, the Saint Paul City Council hereby
adopts the following Findings and Order concerning the struch�r� at 1024 Ross Avenue:
1. That since August of 1990 the buildings have beer► routinely monitored by the
Nuisance buildings Code Enforcement Program.

2. That aincx August of 1990 the City of Saint Paal has on three occasions issued
orders to th�e then luwwn own�rs to makc these buildings secure and not
aaces.sible. Because of the inaction on the part of the owners, the City has had
to hire a private contra,ctor to malre th�buildings secure aad not open to a�ccess.
3. That the Division of Public Health of the City of Saint Paul condemned this
structure as "Unfit for Human Habitation" according to Chapter 34 of the Saint
Paul Legislative Code in 7une of 1990. The bailding is still subject to this
condemnation order.
4. That the owners of the Subject Property have repeatedly failed to register and pay
the vacant building fee for this property as required by C�ty Ordinance.
5. That there are now and have been since August of 1990 multiple exterior Housing
Code or Building Code violations in existence at the Subject Property.
6. That the owners, int�rested parties and responsible parties of these buildings are
as previously state� in this resolution. These individuals have been properly
served notice of the Wednesday, October 2, 1991 and the 1�esday, October 8,
1991 hearings concerning these buildings.
7. That on July 17, 1991 an Abandoned Building Notice with Dangesous Accessory
Structure was sent to the then known owners, interested parties and responsible
parties ordering these persons to either demolish and remove these buildings or
make repairs and cure the list of deficiencies by August 17, 1991.
8. That the order of July 17, 1991 h�s been disregazded by the owr�ers, interested
parties and responsible parties.
9. That the two story, wood frame,boazded, condemned, deteriorated, single family
residential structure located on the Subject Property is an abandoned building
according to Section 45.01, Subd. l, of the Saint Paul Legislative Code in that it
is "a building or portion thereof w�ich has stood unoccupied for longer than one
(1)Year" and during that period of time has beea�either "unsecured" or "boarded"
or has had "multipl� eacte,rior Housi,ng Code or Building Code violations".
10. That the two story, wood frame, boarded, condemned, deteriorated, single family
residential structure located on the Subject Property is a nuisance as defined
a�ccording to Saint Paul Legislative Code Section 45.02, Subd. 11, in that it is an
abandoned building located in,the City of Saint Paul that has created a dangerous
or unhealthy condition or which threatens the public peace, health, safety or
sanitary condition of the City or which is offensive or has a blighting influence
on the commwuty.

11. That the cleta�ched dil�pidated, boarded, deteri�orateci dangerous garage located on
the Subject Property is a dangerous stru�cture a�ccording to Sectiori 45.01, Subd.
3 of the Saint Paul Legislative Code in that it is "a stru�cture which is potentially
dangerous to persons or properiy".
12. That the detached dilapidated, boarded, deteriorated dangerous garage located on
the Subject Property is a nuisance �s defined a�cccording to Saint Paul Legislative
Code Section 45.02, Subd. 10, in that it is a dangerous structure located in the
City of Saint Paul that has created a dangerous or unhealthy condition or which
threatens the public peace, health, safety or sanitary condition of the City or
which is offensive or has a blighting influence on the community.
13. That the costs of abatement of these nuisances are estimated to exceed two
thousand dollars ($2,000.00) or the abatement involves demolition of a building
other than a structure accessory to a residential building.

The Saint Paul City Council hereby makes the following order:
1. The above referenced owners, interested parties and responsible parties and their
assigns shall make the Subject Property safe and not detrimental to the public
peace, health, safety and welfare and
remove its blighting influence on the community by rehabilitating these buildings
and correcting those deficiencies set forth in the list previously referenced in
accordance with all applicable codes and ordinances, � in the alternative by
demolishing and removing the buildings�nd filling the site in accordance with all
applicable codes and ordinances. The rehabilitation or demolition and removal
of these buildings must be completed within thiriy (30) days of the date of
mailing of this resolution.
2. If the above corrective action is not completed within the thirty (30) day time
period, the proper City officials of the City of Saint Paul aze hereby authorized
to take whatever steps aze necessary to demolish and remove these buildings and
fill the site and charge the costs incurred against the Subject Property pursuant
to the pmvisions of Section 45.08 of the Saint Paul Legislative Code.
3. In the evex�t th�buildings are to be demolished and removed by the City of Saint
Paul, all personal property or fixhues of any kind which shall unreasonably
interfere with the demolition ar►d removal shall be removed from the buildings by
the owners, interested parties and/or res�wnsible parties by the end of the thirty
(30) day time period. If the personal property is not so removed, the City of
Saint Paul shall remove and dispose of such property and fixtures as is provided
by law.

4. IT IS FiTRTHER ORDERF�D that a certified copy of this resolution and the
incorporated order and list of deficiencies be mailed to the last known address of
the owners, interested parties and responsible parties pursuant to Section 45.11,
Subdivision (5).

Dear Sir or Madam:
The Division of Public I�ealth has determined that the above noted building is an abandoned
building, which_ Chapter 45 of the Saint Paul Legislative Code defines as:
"any building or portion of a building which has stood with an incomplete exterior
shell for longer than three (3) years or any building or portion thereof which has
stood unoccupied for longer than one (1) year and which meets one or more of the
following criteria;
(a) Unsecured, or
(b) boarded, or
(c) having multiple exterior Housing Code or Building Code violations, or
(d) placarded as "Unfit for Human Habitation" pursuant to Chapter 34 of the Saint
Paul Legislative Code."
The Division of Public Health has also determined that there is a dangerous structure in the
form of detached, dilapidated, boarded, deteriorated, dangerous garage accessory to the
above noted building, which Chapter 45 of the Saint Paul Legislative Code defines as:
"any structure which is potentially dangerous to persons or property including but not
limited to:

(a) a structure which is in danger of partial or complete collapse; or
(b) a structure which has any exterior parts such as chimneys, eaves, porches,
siding, railings, or trim which are loose or in danger of falling; or
(c) a structure which has any parts such as porches, stairs, ramps, rails, balconies,
or roofs which are accessible and which are either collapsed, in danger of
collapsing, or unable to support a person."
The ordinance further states that an abandoned building and a dangerous structure are both
nuisances and may be ordered demolished and removed by the City.
NOTICE: If you do not want to have the City begin action to have the buildings torn
down, then the attached list of deCciencies must be repaired or you must demolish and
remove the buildings on or before August 17, 1991.
If you are unable to finance the correction or rehabilitation of the premises to comply with
this order, there are state and local rehabilitation programs for which you may qualify.
Information about these programs is available from the Department of Planning and
Economic Development, Rehabilitation Section at (612) 228-3105. Ask to speak to a loan
officer.
If you sell, transfer or convey, in any manner, the ownership or responsibility for this
property, you must within seven ('n days of such action, provide the Division of Public
Health with the names and addresses of any new owners or responsible parties.
You must also notify any new owners or responsible parties of this pending action by
the Division of Public Aealth. �
Any repair or demolition must be completed in accordance will all applicable laws.
If the rehabilitat�on work is not completed or if you have not demolished and removed the
house and garage by the above date, the Division of Public Health will refer this matter to
the City Council to receive authority to have the house and garage demolished and removed.
All costs incuned in wrecking and removing the buildings will be charged against the real
estate as a special assessment to be collected in the same manner as taxes. The City Council
will schedule public hearings to consider the necessity and advisability of ordering the
buildings repaired or demolished and removed. If public hearings become necessary, you
will be notified of the times and dates of the hearings and you will be allowed to present
evidence to the City Council.

A copy of this order will be kept on file in the City Clerk's Office and a resolution declaring
this property to be a nuisance shall be on file in the Ramsey County Recorder's Office.
Compliance with the attached list of deficiencies will remove your building from the list of
abandoned buildings but it does not mean that the buildings comply with all applicable
housing and building codes.
The date for compliance with these orders shall not be extended unless you receive written
approval from the Division of Public Health.
If you wish to have the City demolish and remove your house and garage, you may do so by
requesting a consent form be sent to you from our office to sign and return to the Division
of Public Health. However, please be aware that all owners and interested parties must sign
a Consent to Raze form before the City can demolish and remove the buildings without a
City Council order. Also be aware that the cost of the demolition, if performed by the City,
would become a special assessment against the property.

All repairs and new installations must be made in accordance with the appropriate codes.
Permits must be obtained where changes and/or additions to an electrical system require
upgrading of the service size to cunent National Electrical Code (N.E.C.) requirements.
Some plumbing regairs may necessitate updating of the fixtures and/or piping involved. A
permit is required for any repair or new installation. Permits may be obtained from the
Building Inspection and Design Division, Room 445, City Ha1L
REMEDIAL ACTION
The below list of deficiencies is not necessarily all the deficiencies present in the above
referenced property. As first remedial action, a Code Compliance Inspection must be
obtained from the Building Inspection and Design Division, Room 445, City �iall,
identifying all necessary repairs.

1. Retaining wall in the front of house is deteriorated.
2. The front steps to the house are deteriorated.
3. The wood trim around the windows is lacking paint.
4. The front door has rotted wood and broken glass.
5. The siding is cracked and defective.
6. The windows lack combinations and are also boarded.
7. The foundation wall in the southeast corner is cracked and defective.
8. There are trees growing up against the sides of the house.
Garage
9. The facia boards are missing and some boards have dry rot.
10. There is defective siding.
11. The windows and doors are boardeti.

12. The roof is sagging.
13. The wood siding in contact with ground has dry rot.
14. Chimney is missing bricks and mortar.
15. The brick chimney is defective and missing bricks at the top of the stack.
Interior
16. The common hallway walls and ceiling is soiled.
17. The existing surface on the common hallway steps has loose material and is
hazardous.
First Floor
18. There is an accumulation of rubbish and debris scattered about.
19. There are broken and missing windows.
20. The west side door is ripped off the inside wall
21. The center of the floor area is buckling and sagging due to improper supporting in the
basement area.
22. The walls and ceilings throughout are soiled.
23. The kitchen floor area is heavily soiled and defective.
Second Floor
24. The hallway window is missing glass.
25. The walls and ceilings need cleaning.

27. The electrical service throughout is not adequate for this building

The legal description of this property is:
The West 12 1/2 feet Lot 7 and the East 25 feet of Lot 8, Block 13 Terry's
Addition to St. Paul
The building is a two story, wood frame, boazded, condemned, deteriorated, single family
residential structure with a detached dilapidated, boarded, deteriorated dangerous garage.
The subject property has been routinely monitored by the Nuisance Buildings Code
Enforcement Program since August of 1990.
The building meets one or more of the condiaons that constitute an Abandoned Building as
defined in Chapter 45 of the Saint Paul Legislative Code.
On July 17, 1991 the Division of Public Health mailed an order to the then known owners,
interested pazties and responsible parties of these buildings requiring that the buildings be
either repaired, by correcting the attached list of deficiencies, or demolished on or before
August 17, 1991.
Inasmuch as the order has not been completed to the satisfaction of this Division and the
continued abandoned condition of the building contributes a blighting influence and potential
hazard to the neighborhood, it is the recommendation of this Division that the City Council
pass a resolution ordering the owners, interested and/or responsible parties to either repair or
demolish and remove the building in a timely manner to the satisfaction of the City.
In the event the owners, interested and/or responsible parties fail to comply with the Council
Resolution, the Division of Public Health should be authorized to demolish and remove the
building and assess all costs incurred in the demolition and removal against the real estate as
a special assessment to be collected in the same manner as ta�ces.
