the Ciry of Saint Paul for Sergeant Montgomery's salary and related fringe benefit costs as outlined

Sgt. Debbie Montgomery, of the St Paul Police Department, has been appointed the Assistant
Commissioner for the Department of Public Safety. An ag�eement for an intergovernmental
transfer has been entered into. During the life of the agreement Ms. Montgomery will remain
an employee of the St Paul Police Department and the State will reimburse the City for her
salary and related fringe benef�ts costs. Per a new legislation, Ms. Montgomery and the
State have agreed to revise the current agreement by extending the length of the contract.

AMENDMENT NO. 1 TO CONTRACT NUMBER M-3767
WHEREAS, the State of Minnesota , Department of Public Safety has
a contract identified as Contract No. M-3767 with the City of St.
Paul - Department of Police, providing for an intergovernmental
mobility assignment for employee Deborah L. Montgomery, and
WHEREAS, this agreement is authorized and subject to the Laws of
Minnesota, Minnesota Statute 15. 51 - 15. 59 (inclusive) , and
WHEREAS, the State and the Contractor have agreed to revise
contract as per new legislation, extending the length of the
agreement; and
WHEREAS, PARAGRAPH 1. provides that: , .
Effective January 7, 1991, Ms. Montgomery will be placed on an
intergovernmental mobility assignment from the City to the
, Department for an initial period of 24 months.
WHEREAS, PARAGRAPH 5. provides:
During the life of this intergovernmental mobility agreement,
Ms. Montgomery remains a regular employee of the City and
continues to accrue and retain any benefits, seniority,
compensation at the City in accordance with any current and
subsequently approved City administrative procedures and/or
• policies and labor agreements, including any increases in
compensation that may occur during the 24 month period of the
mobility agreement for which Ms. Montgomery would be eligible.
WHEREAS, PARAGRAPH 6. provides:
Total compensation for the position of Assistant Commissioner
held by Ms. Montgomery will be $62,911. The Department will
compensate Ms. Montgomery for the remainder of this salary
above that for which she is being compensated by the City, as
stated in #5 above. The Department will be responsible for
any increase in compensation for which Ms. Montgomery may be
eligible in the position of Assistant Commissioner.
WHEREAS, PARAGRAP:i 12. provides:
Ms. Montgomery retains the right to return to her previous
employment with the City upon expiration of the mobility
assignment or due to termination of the assignment at any time

NOW THEREFORE IT IS AGREED BY AND BETWEEN THE PARTIES HERETO:
WHEREAS, PARAGRAPH 1. shall be amended to read:

Dear Mr. McClosky:
As we discussed, this letter is in reference to the amended contract for the intergovernmental
mobility assignment of Deborah Montgomery pursuant to M.S. 15.53 (contract number
M-3767). This statute was amended during the 1990-91 legislative session to allow for these
mobility assignments to extend beyond the 24 month limit when they are made to coincide
with unclassified appointments under M.S. 15.06. We agree that this amendment covers
Assistant Commissioner appointments under Subd. 6 which gives Commissioners the authority
to appoint subordinate employees pursuant to M.S. 43A. M.S. 43A.08 Subd. c covers
appointment of assistant agency heads.
I hope this clarifies the intent of the legislative change and the resulting intergovernmental
contract amendment.
