THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1 Section 403 . 05 of the Saint Paul Legislative Code is hereby amended to read as follows: "Sec. 403.05. <�;;z�;�?:; Minimum distance between bingo halls. A minimum distance of two (2) miles shall be required between buildings licensed for bingo halls under the provisions of this chapter. This minimum distance requirement shall not be applicable: (1) Where the license is to be held in a place located in the downtown business district, as defined in Section 411. 04 (b) (4) of this Code; or (2) Where the license is to be held in a place located in an I-1, I-2 or I-3 industrial zone at least one and three- fourths (1 3\4) miles from another bingo hall, and which is located at least six hundred (600) feet from any residentially zoned property in any municipality, measured in a straight line from the closest point of the property line of the building in which the bingo hall is to be located to the closest point on the property line of the bingo hall and the residentially zoned property, respectively. Macalus and Mary Ellen Macalus, husband and wife, hereinafter "Macalus," and Norbert J. Anderson, hereinaPter "Anderson." WF�REAS, Macalus is the owner of the real property commonly known as _ __ 733 Pierce Butler Route, St. Paul, Minnesota and hold a Bingo Hall License . from the City oP St. Paul. for the rental oP space in the building at such address for the operation of lawful bingo for charitable p�.7-poses; and WI-�REAS, Anderson desire� to obtain a Bingo Hall License for lawful bingo operations at Anderson's real property commonly known as 1535 Como Avenue, St. Paul, but due to City of St. Paul licensing restrictions, needs the consent of Macalus in order to make application for such license; and WHEREAS, Macalus has agreed to such consent, on the Following terms.
