WHEREAS, the Council of the City of Saint Paul , by resolution
C.F. 88-1945, approved December 12 , 1988 , vacated public land in
the City of Saint Paul described as follows :
Berry Street from the northerly line of Territorial
Road to the northerly line of Pearl Street
Pearl Street from the west line of Eustis Street to the
west line of Berry Street
Curfew Street from the northerly line of University
Avenue to the southerly line of Charles Avenue
( formerly Charles Street) .
Charles Avenue ( formerly Charles Street) from the east
line of Berry Street to a line described as follows:
From a point on the northerly line of Charles Avenue
( formerly Charles Street) 57 .15 feet easterly from the
southwesterly corner of Lot 15 , Block 1 of Twin City
Addition to a point on the southerly line of said
Charles Avenue (formerly Charles Street) 57 .15 feet
easterly from the northwesterly corner of Lot 18 ,
Block 2 of said Addition.
All of the alley in Buckmore Addition to St. Paul ,
Minnesota
WHEREAS, based upon the utility easement Certificate of Intended
Non-Use filed voluntarily on behalf of Northern States Power
Company, Gas Division , and made a part hereof by this reference
and filed in the office of the City Clerk of Saint Paul, the City
for itself and on behalf of this corporation , waives the right to
utility easements in the vacated area as described in the
Certificate of Intended Non-Use .
THEREFORE BE IT RESOLVED, pursuant to Section 130 .06 of the Saint
Paul Legislative Code and on behalf of the City of Saint and
those persons for whom the City has reserved easements , the
Council of the City of Saint Paul does hereby waive and release �
the retained utility easements in the vacated public property as
specified in the Certificates of Intended Non-Use described as
follows :

BE IT FURTHER RESOLVED, that upon passage of this resolution , the
City Clerk is hereby authorized and directed to record a copy of
this resolution in the office of the County Recorder of Ramsey
County, Minnesota , and also file a copy of this resolution with
the Registrar of Titles , Ramsey County , Minnesota , and shall
maintain a copy of all Certificates of Intended Non-Use
referenced in this resolution on file in the office of the City
Clerk.
AND BE IT ALSO RESOLVED, that in all other respects , resolution
C.F. 88-1945 shall remain in full force and effect.

In reviewing the above vacation, our Distribution Department reports
In reviewinq the above vacation, NSP GAS UTILITY has a 2" ��ledium Pressure
Gas Main on Charles and on Curfew. A work order is being made out to
cut this 2" Gas main at Berry and at University. It is anticipated
these cuts can be made before September 15, 1991. Please do no
constx�uction or alterations on site until abandonment is verified by
our dept.
