The Saint Paul Legislative Code is hereby amendesl as to add the

Sec. .oi. Statement of purpose. y��`

In order to provide the City of Sa t��aul with a
greater degree of flexibility in d ` ing with
violations of its ordinances, EEhe ty determines that
certain violations of its Legi� a ve Code shall be
designated as administrative of nses. This provision
for the administrative enf nt process will allow
the city procedural optio s i the enforcement of such
offenses and provide the c � enry and suspected
violators with a hearinc�, r ess specializing in Saint
i
Paul ordinances and e �c ment. Finally, the city's
civil enforcement pr c will reduce the amount of
criminal cases a e in - on court calendars and will

also provide needed a itional revenue because the
receipts from adm'nis ative penalties will be retained
by the city.
Sec. .02. De�i tions.
Administrative fense. An administrative offense means
a violation of any section, subdivision, paragraph or
provision of he Legislative Code included on the list
of offenses ontained in this chapter and is subject to
the penalt' s and fees set forth herein and in Section
1. 05 of t Legislative Code.
Admin' s at've offense office. The administrative
offens office is within the division of treasury and
has t e duties specified in Section 5. 04 of the
Admi istrative Code.
Enforcement personnel. For purposes of this chapter,
enforcement ersonnel are those
p persons authorized by

�. ` ' the director of finance to issue an administrative �
notice pursuant to this chapter. �,�
, Hearing officer. The director of finance shall appoint
� or independently contract for the services of one or
more persons to act as hearing officers within the
meaning of Minnesota Statu�es §609.415. The city
council may promulgate standards to guide the
discretion of hearing officers in individual cases. A
copy of such standards shall be available for public
inspection in the city clerk's office.
Sec. .03. List of administrative offenses.
No person shall violate any provision of the
ordinances listed below in this section. In
addition to being a misdemeanor as prescribed
in Section 1.05, a violation of any of the
following enumerated ordinances shall also
constitute an administrative offense subject
to the schedule of penalties and fees as
prescribed in this chapter:

Sec. .04. Scheduled penalties and fees.
The city council shall establish, and may amend from
time to time, a schedule of penalties and related fees
to be charged for the violation of any administrative
offense enumerated in this chapter. The maximum
scheduled penalty for any administrative offense,
excluding any related fees, shall be two hundred
dollars ($200. 00) . A copy of the current schedule

clerk's office and in the administrative offense
office.
� Sec. . 05. Enforcement procedures.
(a) Notice of violation. Upon determining that there
has been a violation enumerated in Section .03,
enforcement personnel may issue an administrative
notice. The administrative notice shall set forth the
nature, time, date, and place of the violation; the
name of the person issuing the notice; the amount of
the initial scheduled penalty and any applicable fees;
and the location of the office where the violator must
appear within seven (7) days to admit or deny the
violation. Such notice may contain other information
relevant to the administrative or criminal enforcement
of the Code.
(b) Payment or hearing. Within seven (7) days of the
issuance of the notice, the violator shall either pay
the violation or request a hearing before a hearing
of f icer.
(i) Payment. The violator shall pay the
penalty and any applicable fees on the stated
violation schedule to the administrative
offense division. The penalty and any
applicable fees, including late fees, may be
paid in person or by mail.
(ii) Hearincr. If the violator wishes to
challenge the notice or penalty, that person
shall request a hearing before a hearing
officer who shall hear and determine the
matter. The hearing officer shall have the
authority to dismiss the violation for cause
and may suspend or reduce all or part of the
penalty and fees, upon such terms and
conditions as can be agreed upon by the
parties; however, the reasons for any such
disposition shall be stated in writing by the
hearing officer. If the violation is
sustained by the hearing officer, the
violator shall pay the penalty and any
applicable fees or shall sign an agreement to
pay upon such terms and conditions as
determined by the hearing officer.
(iii) Failure to pay. If the violator fails
to pay the amount imposed by the hearing
officer or fails to answer the administrative
notice in a timely manner, a hearing officer
may recommend the commencement of a civil
action in order to collect any amount due as
a result of the issuance of an administrative
notice, or in the alternative, the issuance
of a criminal complaint.
