WHEREAS,The Public Works Street Repair and Cleaning Fund administers the recycling effort �
in the City of Saint Paul; and,
WHEREAS, Ramsey County reimburses the City for the costs of recycling; and,
WHEREAS,1'he Ramsey County Board has approved an additional allocation of funds to the
City of Saint Paul for purchase of recycling bins in 1991, and
WHEREAS,The City is obligated to match the funds 50 - 50 through any combination of City,
corporation or other private funds, district council, etc., funding, and
WHEREAS,The City has entered into a grant agreement with the Metropolitan Council for
$50,000 towards matching funds for the bins to be purchased in 1991, and
WHEREAS, Section 10.10 of the Charter of the City of Saint Paul, does require sufficient
unencumbered and available funds to cover claims or meet obligations in the 1991 budget ; and
WHEREAS, Council File 277510, adopted October 1, 1981, did establish certain Special Fund
Policies; and
WHEREAS, The Mayor recommends that the following changes be made to the 1991 budget:

WHEREAS , Ramsey County and the City of Saint Paul have entered
into an Agreement for a Recycling Grant (hereinafter "the
Agreement" ) for the period of January 1 , 1991 , to December 31 ,
1991 ; and -
WHEREAS , The City .of Saint Paul has requested an amendment to
the Agreement to allow the use of unexpended 1990 Recycling Grant
funds for the purchase of residential recycling containers durinq
1991; and
WHEREAS, Ramsey County has a policy, as stated in the
Rec clin Im lementation Strate , of providing 50 percent fundinq

RESOLVED, The Ramsey County Board of Commissioners approves
Amendment Number 1 to the 1991 Agreement which allows the City of

I.01 Grant Project Acti��ties. The Grantee a;rees to periorm and complete che grant
project as described in the Grantee's appIication for ;rant assistance, incorpo:ated in this
a;reement by reference, and in accordance with the terms and conditions of this
agreement. Specifically, the Grantee agrees to perCorm the worl: program activities
described in Append'v: A which is attached to and incorporated in this a�reement.
1.02 AZaterial Representations. The Grantee a;rees that all representations contained in
its application for erant assistance. including any representations based upon which the
Council Rave the Grantee a preference in the aw�ard of this jrant, are material
representations o:fact upon which the Council relied in awarding this grant and are
incorporated in this agreement by reference. In awarding this grant, tne Council may havc;
established conditions v��hich the Grantee must fulfll in order to receive grant funds. The

Il. AUTHORIZEV USE OF GRAI�'I' YROCEEDS ANU MATCHING FUNDS
2.01 Authorizecl lises. The Grancee is autnorized to use the grant funds onlv in navment

budgeted line item cost, as specified in Appendix B, which is attached to and incorporated �
in this agreement. No other use of grant funds is permittcd. Grant and matching funds
may be used only for the actual purchase price of the residential recycling bins plus
Ireight, and cannot be used to pay for other expenses associated with the projeci.
Recycling bins purchased must contain recycled materials.
III. GRAI�'T AMOUNT AND DISTRIBUTION
3.01 Total Grnnt Amount, The Council shall pay to the Grantee a total grant amount of
$ 50,000 . In no event will the Councii's obligation under this
agreement exceed thc total grant amount, nor will the Coul�cil's obligation exceed fifty
�ercent (SO%) of the actual purchase price of the recycling bins plus freight, nor ��ill the
Council's obli�ation exceed $5.00 per hausehold. The Council shall bear no re.tponsibility
for cost overruns which may be incurred by the Grantee in performance of tl�e �erant
project.
3.02 Grantee's Alatch. Thc: Grantet haa an obligation under this �rant e�reement to

I�'. ACCOUI�'TING Al�'D RECORD REQUIREMEh'TS
4.01 Docume�tation of Proj�et Costs and Ineome. AII costs charged to the grant project,
whether paid wzth grant proceeds or u�ith matching funds, must be supported by proper
documentation, includin� properly executed payrolls, time records, invoices, contracts, or
vouchers, evidencing in detail the nature and propriety of the charges. The Grantee shall
also maintain records of an}� revenue resulting from performance of the grant project,
which is received by the Grantee during the Project Activity Period defined in article VI,
paragraph 6.01.
4.02 Accounts and Records. The Grantee agrees to establish and maintain accurate,
detailed, and complete separate accounts and records relating to the receipt and
expenditure of all grant funds and cash matching funds required by this agreement,
including all project documents, financial records, and supporting documentation. These
project accounts and records shall be retained intact by the �rrantee for at'least three (3)
��ears followzng the end of the Grant Period set forth in article VI, paraeraoh 6.02. These
� requirements shall sun�ive closeout of the arant agreement.
�.03 Audi� The above accounts and records of the Grantee shall be audited in the same
manner as all other accounts and records of the Grantee are audited, and may be audited,
copied, or inspected on the Grantee's premises or otherwise by individuals or
organizations dcsignated and authorized b�• the Council staff at any time followin�

following. These requirements shall survive closeout of the grant agreement. �
=' �?EPORTING AND MONITORING REQUIREMFI\'TS
5.01 Timing and Form of Reports. During the Grant Period, the Crrantee shall provide
the Council with three (3) Annual Reports regarding project activities, due one, two, and
three years from the date of execution of this agreement. The Grantee shall also submit a
Final Narrative Report discussinb results of the project, due no later than two (2) months
after the end oF the Project Activity Period. The Grantee shall submit the Annual
Reports on forms provided by the Council. The Grantee agrees to report com�letely and
to provide the Council with any additional or�follow-up information as ma}� be requested
by Council staff.
:.02 Copies. The Grantee a�rees to provide copies of the reports specired in paragraph
_S.OI to oreanizations and indi��iduals uj�on request durine the Grani Period.

` TII�'IING REQUIREME'�TS
6.01 Yroject Acti�zty Period. The Grantee agrees to place the recycling bins acquired
into use Cor landfill abatement purposes within three (�) months after final execution of
� this agreement. The Grantee further agrees to continue to use.the recycling bins for at
least three (3) years follo�7n, the execution of this agreement (the "Project Activity
Period"). The Grantee aQrees to conduct the work pro�ram activities described in
Appendix A before the end of the Project Activity Period. The Council will not
reimburse the Grantee for any project activities ta�:ing place before this grant was awarded
by the Council or after the end of the Project Acti�ln• Period. However, the Council
encourages the Grantee to continue to use the recyciing bins for landfill abatement
activities beyond the Project .Activin• Period.
6.02 Grant Period. The Grant Period shall extend from the date of final execution of
this a;reement to a date three (3) months following the end of the Project Activity
Period.
VII. GENERAL COTTDITIC�NS
7.01 Amendments. Th� terms of this agreement may be chan�ed b}� mutual aRreement of
- tne parties. �ucn cnanges shall be efiective only upon the execuLion of written
amendments signed b}� authorized representatives of the Council and the Grante�.

V 02 Title. Title to the recycling bins shall remain with the Grantee during the Project- � •
Activity Period. Accordingly, the Grantee shall take reasonable measures to protect and
�.ie[end its title interest and shall keep the recycling bins free and clear of any liens,
:,ncumbrances, or other claims.
7.03 Risk of Loss. The Crrantee bears the risk of loss of, damage to, or destruction of
the recycling bins. No such loss, damage, or destruction shall relieve the Grantee of its
obligations under this a�reement.
7.04 Noncompliance by Grantee. If the Council finds that there has been a failure to
compl}�with the provisions of this aereement, the Council may terminate the agreement at
any time followin� seven (7) days' �Titten notice to the Grantee and upon failure of the
Grantee to cure the default within the seven-day period. If the Council finds that the
Gran�ee's noncompliance is w�Ilful and unreasonable, the Council may terminate or
rescind this agreement and require the Grantee to repay the erant funds i�t full or in a
portion determined h�� thc C�unc�l. Nothing 1lerein sha11 t�c construcd so as to limit the
Council's lc�al remedies to recove- trant funds.

Grantee has made an unauthorized or undocumented use of grant proceeds, and upon a
:�emand for repati�tnent issued by the Council, the Grantee a�rees to promptly repay such
.mounts to the Council.
7.07 Termination by Grantee. This a;reement ma}� be tenninated b�� the G:antee at any
time upon w7itten notice to th,e Council. However, termination will not neces�arily relieve
the Grantee of responsibiliries to the Council under this agrcement.
7.U8 Indemnification. The Grantee assumes liability for, and agrees to indemnify, protect
and hold harmless the Council from any liabilities, obligations, losses, damages, claims,
injuries, penalties, costs and ea-penses, including reasonable attorney's fees, arising flut of
the manufacture, use, condition, operation or ownership of the recyclin� bins.
7.09 Public Data. The Grantee acl:nowledges that the results of the grant project, the
reports submitted, and any new information that is developed with the assistance of this
grant is in the public domain and may not be eopyrighted or patented.
7.10 Equai Employment Opportuait�; �rmative Action. The Graniee agrees to
comply with all applicable Iaws relatin� to nondiscrimination and affirmative action. In
particular, the Grantee agrees not to discriminate aRainst any employee, applicant for
employment, or participant in this project because of race, eplor, creed, reli�ion, sea,
marital status, status with regard ta public assistance, membersnip or activicy in a iocai civii
rights commission, disabilitt�, age, or national ori�;n, and further agrees to ta�:e affirmative
acuon so that appiicants and empioyees are treated equally with respect to all aspects of
emplo}ment and compensatifln.

The City of St. Paul contracts directly with two
neighborhood groups �or program services related to the City's
recycling programs. These contracts are overseen by the
Department of Public Works. The City anticipates this will also
be the case with this project. The City intends to contract with
the St. Paul Neighborhood Energy Consortium to implement this
program.
The NEC Board of Directors will approve their staff's
recommendation as to where the bin distributions will take place.
Each neighborhood will discuss the issue with their appropriate
committee (Land Use, Environment, Human Services, etc. ) and make
a request tp the NEC for bins if they so choose.
Those neighborhoods which are program parrticipants will
designate one can�act person to be responsible for the recyclin�
bin project in their neighborhood. This person k�ill wo�}: with
the NEC to recruit volunteers �rom the community to help with ��in
distribution and fo�low up.
