12 Chapter 140.10 of the Legislative Code of the City of�aint Paul is hereby
13 amended as follows:

15 Sec.140.10. Safety Requirements.

17 The owner of a building containing an element of the Saint Paul pedestrian
18 skyway system shall maintain said element in a condition so as not to constitute a
19 hazard to its patrons, and shall also comply with the following requirements:
20
21 (1) On and after June 1, 1991, �" �'°-��„+° vublic easements in buildin�s
22 connected to e€ the skyway pedestrian system shall maintain a minimum light
23 level of€�� ten (10) foot candles and an avera,�e of fifteen �51 foot-
24 candles, horizontal average maintained at the floor surfaces, during all hours
25 of operation. A minimum of fifteen (,151 foot candles must be maintained in
26 the skyway bridges during all hours of operation. ' ,

28 Light installation shall be so designated that failure of one lamp will not leave
29 an area inadequately lighted.

31 (2) All elements of the skyway system shall be maintained in a clean,
32 seasonally adjusted comfortable temperature level; of seventy (70, degrees
33 fahrenheit. plus or minus eigh�8, degrees fahrenheit, sanitary, and safe
34 manner. Building owners shall be responsible for necessary repair and
35 replacement of damaged or deteriorated portions of the skyway pedestrian
36 system. Hazardous and non-hazardous obstacles are prohibited so as to avoid
37 the appearance of clutter.

39 (3) On and after June 1, 1991, all areas of the pedestrian skyway system that,
40 because of design, lighting, decorations, or any other reason may be so

1 construed as a "hiding place", as determined by the Skyway Governance
2 Committee, shall be secured by a physical barrier, eliminated, or monitored.

4 (4) On and after June 1, 1991, a11 ares of the pedestrian skyway system shall
5 provide a continuous, immediate, accessible, and easy to perform means of
6 communicating requests to the emergency dispatch center or "911".
7 Communications may be provided by auto-dialed emergency response call
8 boxes, working pay phones, or other appropriate alarm devices. There shall
9 be a minimum of one (1) means of communication located every 320 feet
10 measured linearly and a minimum of one (1) means of communication per
11 building. These means of communication shall be located in prominent
12 locations as determined by the Skyway Governance Committee and accessible
13 during all hours of operation. In areas where a means of communication is
14 not visible, signage with directions to the nearest location shall be prominently
15 displayed.

17 (5) On and after June 1, 1991, signs providing location names (i.e., building
18 name, concourse name, floor level, and e�uts from the system) and utilizing
19 easily readable lettering, shall be prominently displayed in the pedestrian
20 skyway system. The name utilized shall be unique and descriptive so that calls
21 for aid to that place name can be responded to accurately.

23 (6) On and after June 1, 1991, the owner of a building containing an element
24 of the pedestrian skyway system shall provide in the building owned for the
25 reasonable observation and surveillance of the portions of the pedestrian
26 skyway system located by video cameras or by patrolling security personnel.

28 (a) Video cameras used for observation and surveillance shall be
29 monitored by personnel during all hours of skyway operation. The owner,
30 when placing the video cameras, shall consider building design and internal
31 layout, building usage, and incident trends. The owner shall make every
32 effort during the further development and implementation of a skyway
33 security to achieve the optimum of a coordinated camera and voice
34 communications and surveillance system. All cameras utilized shall provide
35 video output at one (1) volt peak-to-peak, NTSC. The placement of
36 cameras shall be reviewed for compliance with City standards by the
37 Skyway Governance Committee.

39 (b) Patrolling security personnel used for observation or surveillance shall
40 patrol during all hours of skyway operation, and the frequency of patrol
41 shall be determined by the building owner. The building owner, when
42 determining the frequency of patrols, shall consider the size and design of
43 the skyway portion located in the building, the type of uses located in the
44 building, incident trends, and the means of surveillance implemented in
45 adjoining structures. The Skyway Governance Committee shall recommend
46 minimum City standards for patrol and review for compliance, to be
47 approved by the City Council.

When the Skyway Security ordinance was adopted, the License Division was identified as the,
agency responsible for enforcing the various requirements contained in the ordinance. The
License Division, however, lacks the technical and legal ability to effectively enforce the
ordinance as passed. The Fire Department has the expertise and has agreed to assume the
enforcement responsibility as part of the certificate of occupancy program. This delegation
of responsibility has been approved by the Mayor. In addition, modified lighting levels and
a specified temperature range are proposed.

Improved safety for pedestrians utilizing the skyway system. General improvement of
p estrian environment in the skyway. Delegation of enforcement authority to the more

SUBJECT: Enforcement of Skyway Safety
Council File 91-1741 Ordinance amending Chapter 140 of the Legislative Code
On September 17 the ordinance change concerning enforcement of the existing Skyway
Ordinance was referred from City Council to the Public Works Committee and to the
Human Services, Regulated Industries, and Rules & Policy Committee.
On October 2 the Public Works Committee approved the change giving the Fire
Department, rather than the License Division, responsibility for enforcement of Skyway
regulations.
It is not necessary for additional review by the Human Services Committee before
consideration by the full City Council. Therefore I request that you direct the City �
Clerk to put this matter on the City Council agenda as soon as possible so that ' d`-'
enforcement can commence.

Councilmember Thune stated that he is not sure why things that are needed
shouldn't be in the proposed budget. The better way may be to put it back
into the general funds.
Mr. Shetka stated that their capital outlay was always handled through the
sumner funding portion of the budget which did not include a general fund;
winter is funded exclusively by the general fund and that is what the return
portion of this is, 5350,000. The other monies are accumulations through
street and alley assessment which are earmarked for that fund.
Councilmember Rettman asked if any of the items proposed in the spending plan
were included in their 1992 budget request?
Mr. Shetka indicated that they were not included in the 1992 budget.
Councilmember Rettman stated that in their 1992 budget request, they have some
other capital outlays the Council will be reviewing. They are looking at a
major deficit and this does have about �350,000 going back to the general
fund. She would prefer to fold these requests into the 1992 requests and have
them come in as amendments.
Chair Goswitz said this is one of those items where if they don't buy
equipment soon, they are not going to have anything for people to work with.
It doesn't really help them not to have the equipment.
Mr. Shetka stated as an example, one item in there is a new tac coat
distributor for a seal coating operations. The three machines they have now
are over 15 years old and they have spent close to �20,000 in repairs on that
equipment keeping them operating.
Mr. Shetka explained that they started the process back in January 1991 prior
to preparing the 1992 budget. With this process moving forward, they were
anticipating this being acted on so that precluded them from including in the
1992 budget. The cutoff for the Purchasing Department to advertise for bids
for items over 515,000 is October 25.
Councilmember Thune made a motion to approve with the recommendation that
Councilmember Rettman and Mr. Shetka meet and sort this out before it goes to
the full Council ; motion was approved 3 to 0.

the License Division as the agency responible for enforcing the ordinance.
After some discussion with Bob Kessler, it would felt that it would be more
appropriate for the Fire Prevention Office to be enforcing the provisions of
the skyway ordinance.
Bob Kessler, License Division, was present to respond to any questions.

When the Skyway Security ordinance was adopted, the License Division was identified as the
agency responsible for enforcing the various requirements contained in the ordinance. The
License Division, however, lacks the technical and legal ability to effectively enforce the
ordinance as passed. The Fire Department has the expertise and has agreed to assume the
enforcement responsibility as part of the certificate of occupancy program. This delegation
of responsibility has been approved by the Mayor. In addition, modified lighting levels and
a specified temperature range are proposed.
ADVANTAGES IFAPPROVED:
Improved safety for pedestrians utilizing the skyway system. General improvement of
pA��estrian environment in the skyway. Delegation of enforcement authority to the more
