RESOLVED, that the Liquor Off Sale, Original Container and Cigarette licenses
held by Broadway Liquor, dba Johnson Brothers Liquor for the premises at 1157 Hudson
Road in Saint Paul are hereby suspended for a period of three days, commencing on the
first Monday following publication of this resolution; provided, however, that the last two
days' suspension is stayed for 18 months upon condition that there be no further
violations of the liquor laws.
This Resolution and the action taken above are based upon the facts contained in
the attached police report dated June 20, 1991. The facts as outlined in the police
report are not contested by the licensee, as evidenced by the attached letter signed by
John E. Daubney, counsel for the licenseholder. The action taken is also based on the
facts, circumstances and arguments presented by and on behalf of the licensee during the
Public Hearing. The downward departure from the presumptive penalty called for by the
penalty matrix is based on the fact that the licensee provided credible evidence to the
Council with respect to its adoption of responsible business practices within the meaning
of section 409.26(g) of the Legislative Code.

RE: All Licenses held by Broadway Liquor Store Inc. , dba Johnson
Brothers for premises located at 1165 Hudson Road.
Dear Mr. Johnson:
I am in receipt of informaticn that could lead to an action against
all your licenses. The basis for adverse action is that
"On June 2 0, 19 91, at about 6:4 0 p.m. , an employee of the
licensed establishment sold a 12-pack of Miller Lite beer
to a minor without checking the aqe and/or identification
of the minor." .
If you do not dispute the allegations or facts, or agree that a
violation occurred, but want to have the opportunity to speak to
the Council to argue for the lightest possible penalty under all
the circumstances, please call me at 298-5121 to work out the
procedures.
If you contest the allegations or dispute the facts, I will take
the necessary steps to schedule a hearing before an independent
hearing examiner and provide you with a proper notice of hearing so
you will know when and where to appear, and what the basis for the
hearing will be. Please respond within ten days. You may be
responsible for costs if I schedule a hearing thereafter and you do
not appear and/or contest the facts.

I am in receipt of informaticn that could lead ta an action against
all your licenses. The basis for adverse action is that
"On June 20, 1991, at about 6:40 p.m. , an employee of the
licensed establishment sold a 12-pack �f Miller Lite beer
to a minor without checking the age and/or identification
of the minor."
� If you do not dispute the allegations or facts, or agree that a
violation occurred, but want to have the opportunity to speak to
the Council to argue for the lightest possible penalty under all
the circumstances, please call me at 298-5121 to work out the
procedures.
If you contest the allegations or dispute the facts, I will take
the necessary steps to schedule a hearing before an independent

RE: Alleged Underage Sale of Beer to a Minor By Jahnson
Brothers Liquor Store, Johnson Parkway & I-94
To President Wilson and Members of the City Council:
An alleged sale to a minor recently took place at Johnson
Brother' s Liquor Store pursuant to an undercover
investigation. Following the sale, and after the customer
had left the store, a St. Paul Police Office dressed in
civilian clothes came to the cashier/check out girl and
stated that an underaged sale had been made. The clerk
stated that she had requested identification from all people
• that she believed might have been underaged and requested
that the alleged buyer be brought back into the store so
that she could determine if in fact she had made a sale to
that individual. The officer refused and informed the
clerk, and the assistant store manager, that notice would be
sent alleging an illegal sale of liquor to a minor.
Under the foregoing circumstances the licensee has an option
of either asking for an Evidentiary Hearing held before an
Administrative Law Judge or, reciting the facts, and placing
the matter before the City Council, citing the customary
steps that it takes to prevent underaged sales and other
extenuating circumstances that exist.
Through meetings with representatives of the St. Paul City
Attorney' s Office I have been informed that if an
Administrative Law Judge conducted a hearing that two St.
Paul Police Officers would testify that they had requested a
20 year old individual to go into the store and attempt to
make a purchase of beer without showing any identification,
and that this did occur. Faced with these allegations a
statement by the checkout clerk that she could not recall
making any such sale, but was refused the opportunity of
seeing the person who made the alleged buy would, in all
likelihood, result in a determination that an illegal sale
had been made.

Store management gives on-going instructions and staff
meetings at which instructions are given that production of
identificat.ion is required if the buyer, even remotely,
appears to be under 21 . On two days a week, Friday and
Saturday, off-duty St. Paul Police Officer� are hired to
assist in checking identification of age. They worY. in
uniform as a visible deterrent to potential underaged
customers; they stand at the door and also pass through the
aisles looking for gossible violators who may have slipped
in. On many occasions an individual might be checked as
many as three times: once at the door, once in the interior
of the store, and again on checking out.
Johnson Brothers Liquor Store operates like a supermarket
with the custamer picking his own merchandise up in a
shopping cart and then passing through a checkout counter at
which time the merchandise is paid for and identification
required if there is a question as to the customer' s age.
Johnson Brothers refuses admission to rainors to the store
for even the purpose of purchasing soft drinks or buying
lottery tickets, which are valid for individuals at least 18
years of age.
• Johnson Brothers has a very substantial investment in the
store and inventory and certainly would not do anything
intentionally to jeopardize this investment.
Johnson Brothers wishes to protest the fact that the police
officers refused to bring the purchaser back into the store
so that the clerk could determine if in fact she had made a
sale to that individual. A recitation of facts from the
varying employees are attached to this letter and point out
that the police officers themselves made purchases of beer
during their visit to the store.
The enclosed �tatements from Johnson Brother emplayees tell
the story of their traininq and practices, and they still
find it difficult to believe that an underaged person in
iact r.made a purchase at the store. However, since a
complaint has been made through official channels the
disposition of this matter is respectfully submitted for
your consideration considering all the relevant facts.

My name is Tony Frederick, and I am 76 years old. I have been employed at
Johnson Brothers Liquor Store for 3 to 4 years. Prior to working at Johnson
Brothers Liquor Store, I was a bartender for 54 years. I have never sold liquor to a
minor. I know the penalty for selling liquor to a minor and so does everyone else
who works at Johnson Brothers Liquor Store.
At Johnson Brothers Liquor Store we are constantly checking identification cards at
the door, in the isles and at the cash registers. Prior to the alleged sale, I had carded
a woman who was 35 years old. Our store�olicy is,when is doubt, ask for a
Minnesota drivers license, or a Minnesota identification card.

attend to customers and cashiers; and 9.f need be, ask customers for 3.dentification or
alert the cashier to ask for 3dent3.fication; 3.e., I, a�yself, when in donbt, l�ave carded
customers who have been between the ages of 26-42 yeaxs of a�e. In fact, I card.ed a
Washington County Deputy Sher3.ff l.ast week who was in un3form and was 23 years of age.

In regard the above mentioned subjec husband and I
think this i very sleazy way for S ul Police Officers
to operate. I e first place , wh the officers have
to go back in th� ' quor store and hase beer, dressed in
plain clothes , refu to look at cashier, if they had
already sent an under person o purchase the same type
of beer they did? Why? eca hey had to get a sales
receipt and the beer for e. They refused to bring
the underage purchaser back, so the cashier could identify
him. Why did they refuse� use undoubtedly there was no
such person in the first ce.

St. Paul Police Depa nt to conduct ir business . It is
very sneaky to say least. The east e of St . Paul is
a high crime area t is not safe to take walk here in
daylight anymor nstead of resorting to m ods like this
to collect fin � r closing up businesses , why en't these
officers patr ; ng the neighborhoods watching the real
criminals a tting more effort into making the t side
a safer p to be. I think it is time these two o ers
were re d with some real men who won't lower thems es
to tr o get away with a deplorable trick like this . It

I have been a customer for over ten years at Johnson's Liquor Store.
• I have been carded many of times, but for about two years I was not carded,
because alot of the employee's know who I am.
Then May of 1990 I got a DWI about two or three weeks later I went to Johnson's
for beer. I was carded that day even thoug'h some people even the manager knew
me they would not sell me any liquor. I was really upset about it for the fact
I have been going there for so long thats why it is really hard for me to see
them selling to someone under age.

President Wilson and Esteemed Members of the City Council:
I would like to take this opportunity to register a letter in support of the
management and employees of the Johnson Brothers Liquor Store located at Johnson
Parkway and Interstate 94.
My wife and I, both aged 29, have been resident in St. Paul for the past four
years during which we have transacted exclusively with establishment presently
under investigation. In all of our visits we have found the staff courteous, and
helpful, canpliant with state laws pertaining to liquor sales, and responsible
toward their customers.
On several occasions I have personally witnessed Johnson Brothers employees
exercise discretion by refusing liquor sales to costumers because of:
1) Improper or no I.D. , 2) Apparent intoxication, 3) Bad checks; I have also seen
juveniles, attempting to sneak into the store, apprehended at the front door by
the store personnel and thereafter ejected from the premises.
• The store policies concerning identification and liquor sales are ostensibly
displayed via sign board at the front door -- unavoidably visible to all
who enter. Ftiirthermore they are enforced. During my first visit to the
Johnson Brothers Liquor Store at Johnson Parkway and I-94, having just relocated
from Iowa, I myself was refused a sale because I was unable to produce a valid
Minnesota I.D. Subsequent to this I have been requested, on occasion, to
provide identification in the checkout lane. My wife, on the other hand,
graced with an interminably youthful appearance, is continually 'harassed' by
Johnson Brothers employees for verification of her age.
I would like to conclude by relating to the Council my positive impressions of
the establishment under review. In every instance my transactions at Johnson
Brothers have been with professionals who conduct their business with the deport-
ment expected of people in their profession. I believe it highly improbable that an
employee of Johnson Brothers would ]mowingly sell alcohol to an under-aged
individual. �irthermore, considering their past record of adhering to store
I.D. and sales policies, which I have witnessed and experienced first hand, I
seriously doubt that a youthful-looking person could enter the store - let alone
pass through the checkout lane with a purchase, without being subjected to an I.D.
check.
I believe that purchase of alcohol by an underaged individual at this store could
be accomplished only by means of deception whereby the physical appearance of the
purchaser grossly over exaggerates his/her true age, a problem not unco�rmlon today.

repeatedly witnessed cashiers asking customers for identification.
I 've also noticed them carding individuals in the aisles before they
approach the check-out. People have been carded in that store that I ,
myself, would not have ever asked to see their identification. I 've
�countered 20 year olds that appear, act and dress much older than
y really are. You' re asking someone to make a judgement call , and
then when they don' t "judge" correctly you want to penalize them.

I was impressed by the fact that this store employs a guard
and it is the only store in the area to do so that I am
aware of. While this is probably done to help stop crime,
I know that this guard is responsible to checK I .O. also .
� I think that Johnson ' s Liquor store has done as much as
possible to stop the sale of liquor to minors. I believe
they are responsible and have instructed the employees to
be aware of checking I .D. I am sure they have done as much
or more as could be expected of any business.

1 WHEREAS,the Tort Liability Account Activity 09070 is used to pay meritorious claims and egotiated settlements approved by
2 the City Attorney and the City Council;and

4 WHEREAS,the payment of claims and settlements approved by the City Council to date will exhaust the available funds and
5 create a deficit of a29,500;and
6
7 WHEREAS,in order to pay these settlements,money has been taken from the accounts for payment of court and other fees in
8 the Tort Liability Budget,and will have to be reimbursed in order to provide sufficient funds for these expenses through the end
9 of 1991;and

11 WHEREAS,the Settlement and Compromise Account Activity 09065 is used to pay court ordered judgments;and
12
13 WHEREAS,Gregory Geissinger has been awarded judgment of$75,000 in United States District Court and payment will create
14 a deficit of$62,000;and
15
16 WHEREAS,the ability of the City Attorney to reasonably compromise claims and suits may be jeopardized if funds are not
17 promptly made available;and
18
19 WHEREAS,citizens who have suffered personal injury or property damage may be seriously inconvenienced by additional
20 delays in payment of their claims;and
21
22 WHEREAS,$253,000 will have to be transferred to the Tort Liability Activity for payments of anticipated claims and settlements
23 during the remainder of this fiscal year;and
24
25 WHEREAS,$1,250,000 has been designated in fund balance for tort liability;and

27 WHEREAS,the Mayor,pursuant to Section 10.07.1 of the City Charter,does certify that there are available for appropriation
28 revenues in excess of those extimated in the 1991 budget;and
