1 RESOLVED, that, upon execufion and delivery of a release in fizll to the City of Saint Paul,
2 the proper Ciry officers are hereby authorized and directed to pay from the Tort Liability
3 Fund, 09081-0511, to Robert'I'havis and Juliann Geiss, the sum of $87,000.00; to Ron Schutte
4 and Wendy Schutte, the sum of $56,800.00; in full settlement of their property damage claisns
5 arising out of the July 1, 1997 rain storm. This clann arises from the Ciry and Skafer
6 Contracting's failure to properly separate the storm and sanitary sewers. Shafer Contracting
7 has agreed to pay twenry-five percent (25 %) of the total claims settlement. The net loss
8 payment by the Ciry will be $107,850.00.

During the July 1, 1997 rain storm, the sanitary sewer at Lexington Parkway and Summit Avenue
backed up into the homes at 1134 Summit Avenue and 1126 Summit Avenue. The City of Saint
Paul Public Works Department, and Shafer Contracting, were jointly responsible for improper
sewer separation work which caused this backup of sewage. I have reached a settlement with the
home owners regarding the damage to their property.

RE: Resolution - 48-582 - Settling the properiy damage claims of Robert Thavis
and Juliann Geiss and Ron Schutte and Wendy Schutte against the City of Saint
Paul in the amount of $143,800.00.
At the Council meeting last night the Council passed Resolution 98-582 to settle a
claim against the City for properiy damage. At that time, the Council requested
that they receive a written report from you outlining the steps which have been
taken by your department to prevent reoccurrence of this type of situation. Thank
you for your attention to this matter.
