3 A RESOLUTION CONCERNING THE DEVELOPMENT OF POLLUTED LANDS

6 WHEREAS, Minnesota cities have difficulty in redeveloping sites that require clean-up of pollution;
7 and
8
9 WHEREAS, inability to clean-up and redevelop contaminated sites has significantly negative effects
10 on the area in which the sites are located and has broad implications for general public health and
11 safety; and
12
13 WHEREAS, recent changes in tax increment law have rendered hazardous substance subdistricts
14 useless in providing assistance with clean-up costs, and Superfund dollars are nut sufficient to
15 address the need; and
16
17 WHEREAS, redevelopment of polluted sites could proceed faster than it presently does if there
18 were a statewide revolving fund to help cities finance clean-up costs for sites that have potential for
19 redevelopment when state and federal "superfund" money is not available; and
20
21 WHEREAS, the Minnesota Pollution Control Agency's approval process for clean-up remediation
22 plans is unpredictable and can be a deterrent to a developer; and
23
24 WHEREAS, "no action letters" are often insufficient to secure private financing unless there is also
25 a covenant not to sue;

2 . NOW, THEREFORE, BE IT RESOLVED, that the City of Saint Paul supports legislation that
3 would do the following:

5 • provide a source of funding for a state-wide revolving loan fund and/or grant program
6 for assessment and clean-up of contaminated sites that have development potential; and
7
8 • restructure tax increment financing with respect to redevelopment of polluted lands;
9 and
10
11 • make "no action letters" available to the private sector as well as the public sector and
12 make sure they provide for certainty with respect to exposure and extent of liability;
13 and
14
15 • create and enforce a development action response timeline.

otherwise desirable land vacant and tends to penalize core cities.
