WHEREAS, based upon the records in the Ramsey County Recorder's Off'ice and
information obtained by Division of Code Enforcement on or before March 4, 1998, the following
are the now known interested or responsible parties for the Subject Properry: Andries A. & Andrea

WHEREAS, Division of Code Enforcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance
Building(s)" dated April 9, 1998; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Properry by April 24, 1998; and
WHEREAS, the enforcement officer has posted a placard on the Subject Properry declaring
this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Division of Code
Enforcement requested that the City Clerk schedule public hearings before the L,egislative Hearing
Officer of the City Council and the Saint Paul Ciry Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul I.egislative Code, of the tnne, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the L.egislative Hearing Officer of the Saint Paul City
Council on �esday, June 16, 1998 to hear testimony and evidence, and after receiving testimony

WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, 7une 24,
1998 and the testimony and evidence including the action taken by the Legislative Hearing Officer
was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the S�bject Properry at ll71 Minnehaha Avenue West:
1. That the Subject Properry comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Properry.
4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Division of Code Enforcement has posted a placard on the Subject Property
which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the Department of Fire and Safety
Services, Division of Code Enforcement, VacanUNuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabIlitating this structure and correcung all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Councii Hearing.

2. If the above corrective acrion is not compieted within this period of time the Fire and Safery
Services, Division of Code Enforcement is hereby authorized to take whatever steps are
necessary to demolish and remove this structure, fill the site and charge the costs incurred
against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul
Legislative Code.

3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properry or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the Ciry
of Saint Paul shall remove and dispose of such properry as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul I.egislative Code.

Division of Code Enforcement has declared this buiiding(s) to constitute a"nuisance" as
defined by I,egislative Code, Chapter 45. Division of Code Enforcement has issued an order
to the then known responsible parties to eliminate this nuisance condition by correcting the
deficiencies or by razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remai,
unabated, the community continues to suffer the blighting influence of this property. It is the
recommendation of the Division of Code Enforcement that the City Council pass a resolution
ordering the responsibie parties to either repair, or demolish and remove this building in a
tunely manner, and failing that, authorize the Division of Code Enforcement to proceed to
demolition and removal, and to assess the costs incuned against the real estate as a special
assessment to be collected in the same manner as taxes.

STAFF PRESENT: Chuck Votel, Code Enforcement; Guy Willits, Code Enforcement
Gerry Strathman called the meeting to order at 10:00 am.

Chuck Votel reported this building has been vacant since October 1997. The current property
owners have not discussed their intentions with the Division of Code Enforcement. The City has
issued one summary abatement notice to secure the building. The $200 vacant building fee is
unpaid. The real estate taxes for 1995 and 1996 aze unpaid in the amount of $3,327.77. The cost
to repair is $35,000; the cost to demolish is $5,750.
No one appeared representing the properry.
Gerry Strathman recommended approval of the 15 day order to remove or repair.
1171 Minnehaha Avenue West
Chuck Votel reported this building was condemned in February 1998 and has been vacant since
Mazch 1998. One summary abatement was issued to secure the building. The vacant building
fees and ta�ces are paid. The estimated cost to repair is $60,000, which does not make it feasible
for rehabilitation. The estimated cost to demolish is $5,200.
Chuck Votel stated he received a cali from a Jennifer Watkins who lives next door. Ms. Watkins
said she has acquired the building, plans to demolish it, and adding it as a side lot to her property.
Mr. Votel explained to Ms. Watkins the purpose of this hearing and told her she would have a
reasonable amount of time to demolish the building herself. Ms. Watkins has already hired a
contractor.
Ann Woods, 1184 Minnehaha Avenue West, appeared and sfated she lives across the sueet from
this property. She is concerned about the neighborhood. Ms. Woods urged the City to demolish
1171 Minnehaha. It is a mess. There is a lazge hole in the front yazd. Ms. Woods stated she has
never seen a house look this bad.
Mazjorie Van Dyke, 1178 Minnehaha Avenue West, appeazed and stated she has lived in her
house for fiRy years. The house at I 171 Minnehaha is an eyesore. The front stairs aze in poor
condition and weeds are growing out of them. In the center of the yazd is wire fencing.
Evidently, the fence is there to prevent people from falling over the broken sidewalk. Ms. Van
Dyke would like to see the property demolished.

Cathy Iue, Community Organizer for the Hamline-Midway Coalition, appeared and stated she
fias taiked to neighbors who feeI the house is in bad shape. These neighbors aze hopeful the
property will be demolished.
Beth Randall, Hamline-Midway Area Rehabilitation Corpontion (H-MARC� at 1558 Minnehaha
Avenue West, appeazed and stated H-MARC made an offer to purchase tivs property and Nancy
Watkins made a higher offer. Ms. Randall stated she wouid Iike to see 1171 Minnehaha
demolished. There is a sink hole on the property. Ms. Randail stated she would like Ms.
Watkins to have no more than 45 days to demolish the properry. The door of the house was
standing open, but yesterday it was secured again.
Chuck Votel stated 7ennifer Watkins intends to demolish the house, construct a gazage in the
reaz, and then consiruct a house in the front. Mr. Votel feels this is a good plan for the
neighborhood.
Beth Randall stated Nancy Watkins was arreazs a yeaz in taxes on her own property, therefore
Ms. Randali was concerned that Ms. Watkins wili not be able to maintain two properties and do
improvements. Chuck Votei added that the taxes are paid on 1171 Minnehaha.
Gerry Stratttman recommended approval of the 15 day order to remove or repair.
1005 Tes�ie Street
Susan Mercurio, owner, appeazed and stated she is working on this house. Last month, she
checked on the property almost everyday. She found a summary abatement notice on the door.
There was a windstorm on May 15 and 16. Ms. Mercurio went to the house that weekend to
check on any wznd damage. She later had a uee removed. The code compliance report said that
the shed had to be removed. Since the report was done, the shed was vandalized. Ms. Mercurio
called Steven Magner who gave her until the spring to do the outside work. On May 15 and 16,
the shed was half down. On the weekend of the 23 and 24�', the shed was comptetely down. Ms.
Merourids took her lawn mower and string trimmer to the address on May 30, but the lawn was
already mowed.
Susan Mercurio stated the inspector Steven Magner checks her house everyday. She had asked to
be given until May 3fl to finish the wotk. Also, one of her potted piants is gone.
Guy Willits reported an abatemenT was done. A letter was mailed May 20 to cut the gtass. It
was cut on May 29 because it was not cut by the owner on May 20.
Gerry Strathman asked when the appeal was fled. Susan Mercurio responded the letter on her
door said she had until May 27 to file the appeal. She filed the appeal that day. Mr. Strathman
stated the appeal is stamped received by the City Clerk on May 28. Ms. Mercurio stated she
received a noGce from Shari Moore that the appeal was received on May 27.

Guy Willits stated he was notified on May 29 that the appeal was filed. Ms. Mercurio stated she
has not received anything from the City. The only dme she fmds abatement notices is if they aze
taped to the house.
Gerry Strattiman asked are the metat shed parts gone. Susan Mercurio responded yes. Mr.
Strathman stated the appeal for that issue is moot. However, the order to remove the tall weeds
and grass is appropriate. The summary abatement shouid not have been done if this appeai was
£led by May 27. The stamp from the City Clerk's o�ce is May 28 and that should have stopped
the summary abatement from being done.
Susan Mercurio stated she would like her assessment mailed to 1005 Jessie Street. Chuck Votel
stated the address on file for Ms. Mercurio is 1032 Dnluth Street, Apartment 206. 1005 7essie is
a vacant building, and there has been a problem with the post o�ce not delivering mail to vacant
buildings. Ms. Mercnrio stated she has changed addresses, is now using 1005 Jessie Street as her
mailing address, and has been receiving mail there since last November.
Gerry Strathman recommended denying The appeal citing the orders were correct, however it is
meaningless because the shed parts aze gone and the grass is cut. When the assessment is
received for the lawn, Susan Mercurio should file an appeal, and Mr. Strathman wiIl be
predisposed to grant it.

Gerry Strathman called the meeting to order at 10:00 am.

Chuck Votel reported this building has been vacant since October 1997. The current property
owners have not discussed their intentions with the Division of Code Enforcement. The City has
issued one summary abatement notice to secure the building. The $200 vacant building fee is
unpaid. The real estate taxes for 1995 and 1996 aze unpaid in the amount of $3,327.77. The cost
to repair is $35,000; the cost to demolish is $5,750.
No one appeared representing the properry.
Gerry Strathman recommended approval of the 15 day order to remove or repair.
1171 Minnehaha Avenue West
Chuck Votel reported this building was condemned in February 1998 and has been vacant since
Mazch 1998. One summary abatement was issued to secure the building. The vacant building
fees and ta�ces are paid. The estimated cost to repair is $60,000, which does not make it feasible
for rehabilitation. The estimated cost to demolish is $5,200.
Chuck Votel stated he received a cali from a Jennifer Watkins who lives next door. Ms. Watkins
said she has acquired the building, plans to demolish it, and adding it as a side lot to her property.
Mr. Votel explained to Ms. Watkins the purpose of this hearing and told her she would have a
reasonable amount of time to demolish the building herself. Ms. Watkins has already hired a
contractor.
Ann Woods, 1184 Minnehaha Avenue West, appeared and sfated she lives across the sueet from
this property. She is concerned about the neighborhood. Ms. Woods urged the City to demolish
1171 Minnehaha. It is a mess. There is a lazge hole in the front yazd. Ms. Woods stated she has
never seen a house look this bad.
Mazjorie Van Dyke, 1178 Minnehaha Avenue West, appeazed and stated she has lived in her
house for fiRy years. The house at I 171 Minnehaha is an eyesore. The front stairs aze in poor
condition and weeds are growing out of them. In the center of the yazd is wire fencing.
Evidently, the fence is there to prevent people from falling over the broken sidewalk. Ms. Van
Dyke would like to see the property demolished.

Cathy Iue, Community Organizer for the Hamline-Midway Coalition, appeared and stated she
fias taiked to neighbors who feeI the house is in bad shape. These neighbors aze hopeful the
property will be demolished.
Beth Randall, Hamline-Midway Area Rehabilitation Corpontion (H-MARC� at 1558 Minnehaha
Avenue West, appeazed and stated H-MARC made an offer to purchase tivs property and Nancy
Watkins made a higher offer. Ms. Randall stated she wouid Iike to see 1171 Minnehaha
demolished. There is a sink hole on the property. Ms. Randail stated she would like Ms.
Watkins to have no more than 45 days to demolish the properry. The door of the house was
standing open, but yesterday it was secured again.
Chuck Votel stated 7ennifer Watkins intends to demolish the house, construct a gazage in the
reaz, and then consiruct a house in the front. Mr. Votel feels this is a good plan for the
neighborhood.
Beth Randall stated Nancy Watkins was arreazs a yeaz in taxes on her own property, therefore
Ms. Randali was concerned that Ms. Watkins wili not be able to maintain two properties and do
improvements. Chuck Votei added that the taxes are paid on 1171 Minnehaha.

Susan Mercurio, owner, appeazed and stated she is working on this house. Last month, she
checked on the property almost everyday. She found a summary abatement notice on the door.
There was a windstorm on May 15 and 16. Ms. Mercurio went to the house that weekend to
check on any wznd damage. She later had a uee removed. The code compliance report said that
the shed had to be removed. Since the report was done, the shed was vandalized. Ms. Mercurio
called Steven Magner who gave her until the spring to do the outside work. On May 15 and 16,
the shed was half down. On the weekend of the 23 and 24�', the shed was comptetely down. Ms.
Merourids took her lawn mower and string trimmer to the address on May 30, but the lawn was
already mowed.
Susan Mercurio stated the inspector Steven Magner checks her house everyday. She had asked to
be given until May 3fl to finish the wotk. Also, one of her potted piants is gone.
Guy Willits reported an abatemenT was done. A letter was mailed May 20 to cut the gtass. It
was cut on May 29 because it was not cut by the owner on May 20.
Gerry Strathman asked when the appeal was fled. Susan Mercurio responded the letter on her
door said she had until May 27 to file the appeal. She filed the appeal that day. Mr. Strathman
stated the appeal is stamped received by the City Clerk on May 28. Ms. Mercurio stated she
received a noGce from Shari Moore that the appeal was received on May 27.

Guy Willits stated he was notified on May 29 that the appeal was filed. Ms. Mercurio stated she
has not received anything from the City. The only dme she fmds abatement notices is if they aze
taped to the house.
Gerry Strattiman asked are the metat shed parts gone. Susan Mercurio responded yes. Mr.
Strathman stated the appeal for that issue is moot. However, the order to remove the tall weeds
and grass is appropriate. The summary abatement shouid not have been done if this appeai was
£led by May 27. The stamp from the City Clerk's o�ce is May 28 and that should have stopped
the summary abatement from being done.
Susan Mercurio stated she would like her assessment mailed to 1005 Jessie Street. Chuck Votel
stated the address on file for Ms. Mercurio is 1032 Dnluth Street, Apartment 206. 1005 7essie is
a vacant building, and there has been a problem with the post o�ce not delivering mail to vacant
buildings. Ms. Mercnrio stated she has changed addresses, is now using 1005 Jessie Street as her
mailing address, and has been receiving mail there since last November.
Gerry Strathman recommended denying The appeal citing the orders were correct, however it is
meaningless because the shed parts aze gone and the grass is cut. When the assessment is
received for the lawn, Susan Mercurio should file an appeal, and Mr. Strathman wiIl be
predisposed to grant it.

referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and

Beth Randall stated Nancy Watkins was arreazs a yeaz in taxes on her own property, therefore
Ms. Randali was concerned that Ms. Watkins wili not be able to maintain two properties and do
improvements. Chuck Votei added that the taxes are paid on 1171 Minnehaha.
Gerry Stratttman recommended approval of the 15 day order to remove or repair.
1005 Tes�ie Street
Susan Mercurio, owner, appeazed and stated she is working on this house. Last month, she
checked on the property almost everyday. She found a summary abatement notice on the door.
There was a windstorm on May 15 and 16. Ms. Mercurio went to the house that weekend to
check on any wznd damage. She later had a uee removed. The code compliance report said that
the shed had to be removed. Since the report was done, the shed was vandalized. Ms. Mercurio
called Steven Magner who gave her until the spring to do the outside work. On May 15 and 16,
the shed was half down. On the weekend of the 23 and 24�', the shed was comptetely down. Ms.
Merourids took her lawn mower and string trimmer to the address on May 30, but the lawn was
already mowed.
Susan Mercurio stated the inspector Steven Magner checks her house everyday. She had asked to
be given until May 3fl to finish the wotk. Also, one of her potted piants is gone.
Guy Willits reported an abatemenT was done. A letter was mailed May 20 to cut the gtass. It
was cut on May 29 because it was not cut by the owner on May 20.
Gerry Strathman asked when the appeal was fled. Susan Mercurio responded the letter on her
door said she had until May 27 to file the appeal. She filed the appeal that day. Mr. Strathman
stated the appeal is stamped received by the City Clerk on May 28. Ms. Mercurio stated she
received a noGce from Shari Moore that the appeal was received on May 27.

Guy Willits stated he was notified on May 29 that the appeal was filed. Ms. Mercurio stated she
has not received anything from the City. The only dme she fmds abatement notices is if they aze
taped to the house.
Gerry Strattiman asked are the metat shed parts gone. Susan Mercurio responded yes. Mr.
Strathman stated the appeal for that issue is moot. However, the order to remove the tall weeds
and grass is appropriate. The summary abatement shouid not have been done if this appeai was
£led by May 27. The stamp from the City Clerk's o�ce is May 28 and that should have stopped
the summary abatement from being done.
Susan Mercurio stated she would like her assessment mailed to 1005 Jessie Street. Chuck Votel
stated the address on file for Ms. Mercurio is 1032 Dnluth Street, Apartment 206. 1005 7essie is
a vacant building, and there has been a problem with the post o�ce not delivering mail to vacant
buildings. Ms. Mercnrio stated she has changed addresses, is now using 1005 Jessie Street as her
mailing address, and has been receiving mail there since last November.
Gerry Strathman recommended denying The appeal citing the orders were correct, however it is
meaningless because the shed parts aze gone and the grass is cut. When the assessment is
received for the lawn, Susan Mercurio should file an appeal, and Mr. Strathman wiIl be
predisposed to grant it.
