WHEREAS, Chapter 293 of the Saint Paul Legislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul; and
WHEREAS, §293.11 provides for the granting of variances from
the sound level limitations contained in $293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, the Ramsey County Agricultural Society, represented
by Joe Fox, Secretary of the Ramsey County Agricultural Society
Board, who has been designated as the responsible person on the
application, has applied for a variance to allow live music,
fireworks and a carnival on Harriet Island, on July 15-19, 1998;
and
WHEREAS, applicant is seeking a variance for the hours of
5:00 p.m. to 1�:30 p.m, on Ju1y 15 and 16, 1998, 12:00 noon to
11:00 p.m. on July 17, 1998, 10:00 a.m. to 11:00 p.m. on July 18,
1998 and 10:00 a.m. to 10:00 p.m. on July 19, 1998; and
WHEREAS, if applicant is not granted a variance it will not
be able to present a carnival, live music and fireworks at the
Ramsey County Fair to celebrate the opening of the Wabasha
Bridge; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance to the Ramsey County Agricultural Society,
subject to the following conditions:
1) The variance shall be for the hours of 5:00
p.m to 10:30 p.m. on July 15 and 16, 1998,
for the hours of 12:00 noon to 11:00 p.m. on
July 17, 1998, for the hours of 10:00 a.m. to
11:00 p.m. on 3uly 18, 1998 and for the hours
of 10:00 a.m. to 10:00 p.m. on July 19, 1998.
2) Al1 electronically powered equipment used in
conjunction with the live music shall not

exceed 100 dBA as measured at the closer of
the sound mix or at a distance of 100 feet
from the front of the stage.
3) The applicant shall provide personnel and
equipment who shall provide continuous sound
level monitoring between 5:00 p.m. and 10:30
p.m. on July 15-16, 1998, between 12:00 noon
and 11:00 p.m on July 17, 1998, between 10:00
a.m. and 11:00 p.m. on July 18, 1995 and
between 10:00 a.m. and 10:00 p.m. on July
19,1998 to ensure compliance with Condition
#2.
4) All electronically powered equipment, PA
systems, loudspeakers or similar devices
shall be turned off no later than 10:30 p.m.
on July 15 and 16, 1998, no later than 11:00
p.m. on July 17 and 18, 1998, and no later
than 10:00 p.m. on July 19, 1998.

Attached is a sound level variance application from 7oe Fox of Ramsey Ag. Society
Board for the Ramsey County Fair to allow live music on two stages, carnival music,
and fueworks. A variance is requested from 5:00 p.m. to 10:30 p.m. on
July 15 & 16, 1998; 12 Noon - 11:00 p.m. on July 17, 1998; 10:00 a.m. - 11:00 p.m.
on July 18, 1998; and 10:00 a.m. to 10:00 p.m. on July 19, 1998.
Also attached is a copy of the Public Hearing Notice sent to properry owners within 200
feet of Harriet Island.

WHEREAS, Chapter 293 of the Saint Paul Legislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul; and
WHEREAS, §293.11 provides for the granting of variances from
the sound level limitations contained in $293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, the Ramsey County Agricultural Society, represented
by Joe Fox, Secretary of the Ramsey County Agricultural Society
Board, who has been designated as the responsible person on the
application, has applied for a variance to allow live music,
fireworks and a carnival on Harriet Island, on July 15-19, 1998;
and
WHEREAS, applicant is seeking a variance for the hours of
5:00 p.m. to 1�:30 p.m, on Ju1y 15 and 16, 1998, 12:00 noon to
11:00 p.m. on July 17, 1998, 10:00 a.m. to 11:00 p.m. on July 18,
1998 and 10:00 a.m. to 10:00 p.m. on July 19, 1998; and
WHEREAS, if applicant is not granted a variance it will not
be able to present a carnival, live music and fireworks at the
Ramsey County Fair to celebrate the opening of the Wabasha
Bridge; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance to the Ramsey County Agricultural Society,
subject to the following conditions:
1) The variance shall be for the hours of 5:00
p.m to 10:30 p.m. on July 15 and 16, 1998,
for the hours of 12:00 noon to 11:00 p.m. on
July 17, 1998, for the hours of 10:00 a.m. to
11:00 p.m. on 3uly 18, 1998 and for the hours
of 10:00 a.m. to 10:00 p.m. on July 19, 1998.
2) Al1 electronically powered equipment used in
conjunction with the live music shall not

exceed 100 dBA as measured at the closer of
the sound mix or at a distance of 100 feet
from the front of the stage.
3) The applicant shall provide personnel and
equipment who shall provide continuous sound
level monitoring between 5:00 p.m. and 10:30
p.m. on July 15-16, 1998, between 12:00 noon
and 11:00 p.m on July 17, 1998, between 10:00
a.m. and 11:00 p.m. on July 18, 1995 and
between 10:00 a.m. and 10:00 p.m. on July
19,1998 to ensure compliance with Condition
#2.
4) All electronically powered equipment, PA
systems, loudspeakers or similar devices
shall be turned off no later than 10:30 p.m.
on July 15 and 16, 1998, no later than 11:00
p.m. on July 17 and 18, 1998, and no later
than 10:00 p.m. on July 19, 1998.
