Committee: 57 WI�REAS, the licensee East Side Hospitality, Inc. d/b(a H' crest Entertainment Center (License ID No. 82839), located at 1560 White Beaz Avenue rth in Saint Paul failed cigazette compliance checks on January 14, 1997, and again on April , 1998; and WHEREAS, on Apri12, 1997, under C.F.97361 th Saint Paul City Council imposed a fine in the amount of $200.00 for a first violation of sellin cigazettes to a minor, as identified in the Presumptive penalties for violations, Saint Paul Le ' lative Code §324.07(b), the penalty for a second violation being a$400.00 fine; and WI�REAS, on both occasions, the licen e did not have a valid cigarette license for the license periods 1496-1997 or 1997-1998, b has since obtained a cigazette license for the current license period; and WHEREAS, the licensee should required to pay the license fee far a cigarette license during a111icense periods for which ' is known that he offered cigarettes for sale to the public; now therefare, be it RESOLVED, that the censee is hereby ordered to pay the standard license fee in the amount of $317.00 for a cig ette license for the 1996-1997 license period. The licensee is fitrther ordered to pay the dazd late fee for obtaining the cigazette licenses for the 1996-1997 and the 1997-1998 lice e periods in the amount of $158.50 for each license period. The licensee is further ord ed to pay a fine of $400.00 for the second violation of the sale of tobacco ar tobacco products a minor. The total of fees and fines owed equals $1,034.00. This recommendation is based on the foilowing: On Apri11,1998, you or another employee sold cigarettes to a minor under the age of 18 years in the licensed premises. This is an offense under Minn. Sta� §609.685 and Saint Paul Legislative Code §324.07. Additionally, you are not licensed to sell cigarettes at the licensed establishment. If you do not dispute the above facts, please send me a letter with a statement to that effect by Friday, May 22, 1998. The matter will then be scheduled before ihe City Council for a public hearing to determine what penalty, if any, to impose. You wiil have an opportunity to appeaz before the Council and make a statement on your own behaif as to the penalty, if any, to be imposed. If you do dispute the above facts, a hearing will be scheduled before an Administrative Law Judge. At that hearing both you and the City will be able to appear and present witnesses, evidence and cross-examine the other's witnesses. The St Paul City Council will ultimately decide the case. If this is your choice, please advise my legal assistant, Peter Pangborn, and we will take the necessary steps to set up that ALJ hearing. He can be reached at 266-8710. This is a violation of Saint Paul Legislative Code § 324.07 and Minn. $tat § 609.685. Additionally, since you have no license to sell cigazettes, this sale was a violation of Saint Paul Legislative Code § 324.01(a} . Normally, the City would proceed with an adverse action against your cigarette license, but because you do not have such a license, the City could elect to proceed with adverse action against your other licenses. Another opfion would be for you to obtain a cigarette license, and have the City assess the fine against that license. That option would require you to waive any argument that you did not have such a license, but in return the City would not proceed against your other licenses. It is my understanding from a conversation with Kris Schweinler, the license inspector in this matter, that you told her that you were unawaze that you had no cigarette license, and would take steps to obtain such license and pay the fine fot the violation. In light of that, the second option may be one you aze interested in pursuing, I will shortly be preparing a Notice of Violation letter, and would like to know how you wish to proceed. Committee: 57 WI�REAS, the licensee East Side Hospitality, Inc. d/b(a H' crest Entertainment Center (License ID No. 82839), located at 1560 White Beaz Avenue rth in Saint Paul failed cigazette compliance checks on January 14, 1997, and again on April , 1998; and WHEREAS, on Apri12, 1997, under C.F.97361 th Saint Paul City Council imposed a fine in the amount of $200.00 for a first violation of sellin cigazettes to a minor, as identified in the Presumptive penalties for violations, Saint Paul Le ' lative Code §324.07(b), the penalty for a second violation being a$400.00 fine; and WI�REAS, on both occasions, the licen e did not have a valid cigarette license for the license periods 1496-1997 or 1997-1998, b has since obtained a cigazette license for the current license period; and WHEREAS, the licensee should required to pay the license fee far a cigarette license during a111icense periods for which ' is known that he offered cigarettes for sale to the public; now therefare, be it RESOLVED, that the censee is hereby ordered to pay the standard license fee in the amount of $317.00 for a cig ette license for the 1996-1997 license period. The licensee is fitrther ordered to pay the dazd late fee for obtaining the cigazette licenses for the 1996-1997 and the 1997-1998 lice e periods in the amount of $158.50 for each license period. The licensee is further ord ed to pay a fine of $400.00 for the second violation of the sale of tobacco ar tobacco products a minor. The total of fees and fines owed equals $1,034.00. This is a violation of Saint Paul Legislative Code § 324.07 and Minn. $tat § 609.685. Additionally, since you have no license to sell cigazettes, this sale was a violation of Saint Paul Legislative Code § 324.01(a} . Normally, the City would proceed with an adverse action against your cigarette license, but because you do not have such a license, the City could elect to proceed with adverse action against your other licenses. Another opfion would be for you to obtain a cigarette license, and have the City assess the fine against that license. That option would require you to waive any argument that you did not have such a license, but in return the City would not proceed against your other licenses. It is my understanding from a conversation with Kris Schweinler, the license inspector in this matter, that you told her that you were unawaze that you had no cigarette license, and would take steps to obtain such license and pay the fine fot the violation. In light of that, the second option may be one you aze interested in pursuing, I will shortly be preparing a Notice of Violation letter, and would like to know how you wish to proceed. This is a violation of Saint Paul Legislative Code § 324.07 and Minn. $tat § 609.685. Additionally, since you have no license to sell cigazettes, this sale was a violation of Saint Paul Legislative Code § 324.01(a} . Normally, the City would proceed with an adverse action against your cigarette license, but because you do not have such a license, the City could elect to proceed with adverse action against your other licenses. Another opfion would be for you to obtain a cigarette license, and have the City assess the fine against that license. That option would require you to waive any argument that you did not have such a license, but in return the City would not proceed against your other licenses. It is my understanding from a conversation with Kris Schweinler, the license inspector in this matter, that you told her that you were unawaze that you had no cigarette license, and would take steps to obtain such license and pay the fine fot the violation. In light of that, the second option may be one you aze interested in pursuing, I will shortly be preparing a Notice of Violation letter, and would like to know how you wish to proceed.
