WHEREAS, on June 14, 1991, the Division of Public Health inspected property
located at 499 Maryland Avenue East in Saint Paul, Minnesota 55101, and determined
that a nuisance existed on that property; and
WHEREAS, on June 14, 1991, the Division of Public Health sent a summary
abatement order to the owner or responsible person for the property located at 499
Maryland Avenue East, Mr. John R. Davidson, ordering him to remove all the materials
constituting a nuisance as described in the summary abatement order from the back yard
and rear of the property; and
WHEREAS, the summary abatement order of the Division of Public Health
required the nuisance located at 499 Maryland Avenue East to be abated by June 17,
1991; and
WHEREAS, the owner or responsible person, Mr. John R. Davidson, filed a
timely appeal of the summary abatement order with the City Clerk on June 10, 1991;
and
WHEREAS, the Saint Paul City Council, on July 18, 1991, conducted a public
hearing on the appeal of Mr. John R. Davidson and affirmed the summary abatement
order and further ordered that the abatement of the nuisance located at 499 Maryland
Avenue East, Saint Paul, Minnesota 55101, be completed within 72 hours after the
publication of this resolution; NOW, THEREFORE, BE TT
RESOLVED, that the summary abatement order of the Division of Public Health
issued to the property located at 499 Maryland Avenue East, Saint Paul, Minnesota
55101 on June 4, 1991, is hereby affirmed except as modified herein, and be it

FURTHER RESOLVED, in the event that the nuisance is not abated within the
seventy-two (72) hours following the publication of this resolution, the City may proceed
to perform or complete the work necessary to abate the nuisance with any costs incurred
therefrom to be collected in the manner provided by law.
