WHEREAS, on or about June 10, 1991, the Division of Public Health inspected
property located West of Atlantic Street, further described as Lots 11 & 12 of Colling's
Addition, in Saint Paul, Ramsey County, Minnesota, and determined that a nuisance
existed on that property; and
WHEREAS, on or about June 10, 1991, the Division of Public Health sent a
letter to the owner of the subject property, Glacier Park Company, 1011 Western
Avenue, Suite 700, Seattle, Washington 98104, and to the responsible party for the
subject property, Mr. John Madole, D/B/A Cooperative Waste Industries, 713 Merivale
Avenue South, Minnetonka, Minnesota 55343, ordering them to remove all the materials
constituting a nuisance from the property; and
WHEREAS, the letter of the Division of Public Health ordered the owners and
persons responsible for the subject property to summarily abate the nuisance by June 17,
1991; and
WHEREAS, the owner of the subject property, Glacier Park Company, filed an
appeal of the summary abatement order with the City Clerk on June 25, 1991, seeking to
extend the date to eliminate the nuisance; and
WHEREAS, the Saint Paul City Council, on July 18, 1991, conducted a public
hearing on the appeal of Glacier Park Company and affirmed the summary abatement
order and further ordered that the abatement of the nuisance on the subject property be
completed by October l, 1991; NOW, THEREFORE, BE IT
RESOLVED, that the summary abatement order of the Division of Public Health
issued to the property located West of Atlantic Street and further described as Lots 11 &
12 of Colling's Addition, Saint Paul, Ramsey County, Minnesota, on or about June 10,
1991, is hereby affirmed except as modified herein, and be it

FURTHER RESOLVED, in the event that the nuisance is not abated by
October 1, 1991, the City may proceed to perform or complete the work necessary to
abate the nuisance with any costs incuned therefrom to be collected in the manner
provided by law.

As the owner or person responsible for Cooperative Waste Industries, Atlantic Street,
Ca�ost Site, yau are hereby notified to eliminate the following nuisance:
. 1) Acc�lation of grass clippings, leaves and other yard wastes throughout property,
including a rollroff dumpster.
2) Large amo�uit af material still in plastic bags. This compost site has not been
properly handled or maintained since the fall of 1990, resulting in obnoxious odors
' and the creation of vermin harborage. "
3) All compost material and yard wastes, including the plastic garbage bags and dwnpster,
must be rem�ved from the property and properly disposed of.
If remedied action is r�ot taken before the abatement deadline inci�cwt�l below, this matter

If you do not correct the nuisance by June 17, 1991, or file an appeal (appeal information
below), the Cit� will correct the nuisance and charge all costs against the property as a
special assessment to be collected in the same way as property taxes.
You may appeal this order and obtain a hearing before trie City Council by filing a written
request with the city clerk seven calendar days after the date mailed. No appeals may be
filed after that date.
