THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1
That section 60.513 (3) (d) of the Saint Paul Legislative Code is hereby amended to read
as follows:

Dear Mr. Soderholm:
A close examination of the recently adopted amendments to the
Zoning Code regarding community residential facilities has
disclosed two provisions which were over-looked in our attempt to
conform the Zoning Code to the provisions of the 1989 amendments to
the Federal Fair Housing Act relating to persons with disabilities.
I refer to sections 22 and 23 of ordinance 17845, CF 90-1745,
human service licensed community residential facili�ies. Section
22 amends section 60.513, sub-clause 3, "Mixed Residential and
Office Services" in the OS-1 District, and section 23 amends
section 60.524 (3) , "Mixed Residential and Commercia� Uses" in the
B-1 District. Licensed human service community residential
facilities were to have been allowed in those districts as a
special conditional use but subject to the 1320 foot spacing
distance from other similar facilities.
However the ordinance as adopted contains a restr�ction on the
number of residents that is allowed without first obtaining a
modification of that special condition from the Planning
Commission. Creating a restriction on the number of r�sidents that
may be allowed subject to first receiving a modifi�ation would
conflict with the Federal Fair Housing Act because the', restriction
, is not imposed upon other multi-family uses in the district. Rules
of statutory construction provide a presumption that the
legislative body did not intend to enact a laW which is
unconstitutional or in violation of Federal law. Minn. Stat.
§645. 17 states this legislative intent, and it is my apinion that
the City Council did not intend to enact an ordinanc� provision
which would conflict with the Federal law.
Therefore I recommend that the Council be appris'ed of this
over-sight so that a corrective ordihance may be enacted. I have
