condition has not been met. Addirional shrubbery has not been planted.
4.) "The properry owners will maintain the lilacs on both Davem and Shepard Road so
they do not encroach on the right-of-way." - This condition has not been met. The lilacs
have not been planted.
Said fine is suspended for a period of 60 days for the licensee to come into compliance
with all license conditions, or to obtain a waiver of the conditions.

Pursuant to our conversations, we are willing to admit that Park `n Jet is in violation of the
conditions set forth for its license and would like the opportunity to address the situation with the
City.
We believe that we have good reason for those violations and are willing to meet with the
City Council. We are in the final stages of designing a pazking deck for the site and wouid like
the opportunity to request that the City Council suspend the license conditions, pending the
outcome of our application for the construction of the new parking deck.

Thank you for your letter of April 14, 1998 responding to the Notice of Violation letter dated
Apri16, 1998.
I have discussed this matter w�ith my client, and while we appreciate that your current plans may
alter the need for a permanent structure and the landscape plans, these are currently conditions on
the license which have not been met Additionally, because it may be some time before the
pernut is issued for consiruction of a parking deck, it is not appropriate to simply ignore the
violation of the curi�ent conditions. However, in light of your explanation, Council may wish to
extend the time in which the conditions aze to be met, or to waive the necessity for the
conditions.
This could be accompiished if the Licensee wishes to admit to the violation and appeaz in front
of the City Council to make that request. Please let me know if this is how you would like to
�roceed.

I am writing in response to your Apri16, 19981etter directed to Park `n 7et, L.L. C. For
your information, we also own the offce property at 2751 Shepard Road, wluch is directly west
of the Park 'n Jet operation.
Shortly after starting the Park `n Jet operation in Mazch, 1997 we commenced successful
negotiations for a long-term lease of the 2751 Shepard Road building. U.S. Bank (formerly
known as First Bank) started their move into the 2751 Shepazd Road building last week. The
building will now be known as the RiverBank Business Center. We have spent millions of dollars
upgrading the building -- including new landscaping, parking surfaces, windows and facade. All
ofthese improvements are above and beyond any City of St. Paul requ'uements. �th U.S. Bank
as the tenant of tlus building 1,800 new lugh-paying jobs will be brought into this area of St. Paul.
Along with continuing the Park `n Jet off-airport parking operation we are committed to
providing adequate parlflng spaces for employees of the U.S. Bank operation. In working with
U. S. Bank, and to give them the assurances that they needed to allow U. S. Bank to commit to
leasing the entire building, pazking issues for the oflice building had to be resolved. Those issues
necessarily involved the neighboring Park `n 7et sites.
Currently our commitments to U.S. Bank necessitate construction of a parking deck at
1460 Davem Street. We are in final design discussions for construction of that deck with Graelic,
Inc. Enclosed for your information are copies of the prelinunary deck plans.

Given the planned parking deck facility at 1460 Davem Street, there will be no need for a
separate permanent structure to house Park `n Jet's operations, as it will be housed in the deck
facility. In addition, landscape plans similar to the standard we have already set may also be
incorporated into the design of the new pazking deck.
Our completion of the renovation of the RiverBank Business Center and occupancy of the
building by U.S. Bank, along with construction of the parking deck, will greatly enhance the ta�z
base ofthe properties and the adjoining neighborhood.
As outliued above, construction of the parking deck will negate any need for a separate
permanent stsucture for Park `n Jet's operations. As we will be applying for the construcrion
permit for the parking deck at 1460 Davem Street in the very near future, with construction to
commence immediately, we respectfully ask that you cancel any further action as outlined in your
Apri16, 1998 letter.

The Director of the Office of License, Inspections and Environmental Protection is recommending
that adverse action be taken against your license. The basis for the adverse action is:
�° `' At the time the license was issued for this location, there were eight condiHons
placed on the license. The first condition required that the temporary office
building located on the site be replaced by a permanent structure with sewer
and water connecfion, no Iafer fhan Octo6er 31,1997. As of March 31,1998,
this condition has not been met Conditions 4& 5 require the licensee to plant
common lilac on the property along Shepard Road, and to continue the planting
- y around the corner onto Davern Street Condition 6 requires that the property
along Davern Street, from the Park & Fly entrance to Stewart, be planted with
appropriately spaced ornamental shrubbery which will not eaceed three feet in
height No planting has been done since the license was issued in March of 1997.
If you do not dispute the above facts, please send me a letter with a statement to that effect. The
matter wiil then be scheduled for a hearing before the St. Paul City Council to determine what
penalty, if any, to impose. You will have an oppor[unity to appeaz and speak on your own behalf,
or to have someone appeaz there for you.
On the other hand, if you wish to dispute the above facls, I will schedule an evidenYiary hearing

Please initiate adverse action against the Pazking Lot License for Pazk N 3et at the
referenced property based on noncompliance with conditions 1 and 4-7. Attached is a
copy of the computer information and the paper file for this license.
The condifions attached to the license, and the license holder's compliance with those
conditions, aze as follows:
1. The temporary office building located on the site will be replaced by a peru�anent
structure with sewer and water connections, no later than October 31, 1997. Site
plan approval and building pemuts from this office aze required.
This condition has not been met. A permanent structure has not been
constructed and no sewer and water connections have been made. However,
a site plan for the area around the buiiding was reviewed and approved.
2. Changes to the pazldng layout planned for spring 1997 must have prior approval
from this office. Site plan approval fzom this office is required.
This condition has been met.
3. The entrance to the lot on Davern shail be constructed per the attached site plan,
dated February 4, 1997. Electrical connections for the control arms and ticket
machines require an electrical permit. Instatlation must be completed by a
licensed electrician. The former entrance on Stewart must be closed off and
properly abandoned in accordance with city requirements and a permit from

is no curbing along Stewart Ave., staff from Public Works indicated that

4. The properry along Shepazd Road will be pianted with a variety of "common
lilac". The lilacs shall be placed no more than 5' apart. -
This condition has not been met. The lilacs have not been planted.
5. The plantings will continue around the comer onto Davern Street faz enough as
not to interfere with the Park & Fly sign.

6. Davern Street from the Park & Fly entrance to Stewart, the owner will plant

I have discussed this matter w�ith my client, and while we appreciate that your current plans may
alter the need for a permanent structure and the landscape plans, these are currently conditions on
the license which have not been met Additionally, because it may be some time before the
pernut is issued for consiruction of a parking deck, it is not appropriate to simply ignore the
violation of the curi�ent conditions. However, in light of your explanation, Council may wish to
extend the time in which the conditions aze to be met, or to waive the necessity for the
conditions.
This could be accompiished if the Licensee wishes to admit to the violation and appeaz in front
of the City Council to make that request. Please let me know if this is how you would like to

I am writing in response to your Apri16, 19981etter directed to Park `n 7et, L.L. C. For
your information, we also own the offce property at 2751 Shepard Road, wluch is directly west
of the Park 'n Jet operation.
Shortly after starting the Park `n Jet operation in Mazch, 1997 we commenced successful
negotiations for a long-term lease of the 2751 Shepard Road building. U.S. Bank (formerly
known as First Bank) started their move into the 2751 Shepazd Road building last week. The
building will now be known as the RiverBank Business Center. We have spent millions of dollars
upgrading the building -- including new landscaping, parking surfaces, windows and facade. All
ofthese improvements are above and beyond any City of St. Paul requ'uements. �th U.S. Bank
as the tenant of tlus building 1,800 new lugh-paying jobs will be brought into this area of St. Paul.
Along with continuing the Park `n Jet off-airport parking operation we are committed to
providing adequate parlflng spaces for employees of the U.S. Bank operation. In working with
U. S. Bank, and to give them the assurances that they needed to allow U. S. Bank to commit to
leasing the entire building, pazking issues for the oflice building had to be resolved. Those issues
necessarily involved the neighboring Park `n 7et sites.
Currently our commitments to U.S. Bank necessitate construction of a parking deck at
1460 Davem Street. We are in final design discussions for construction of that deck with Graelic,
Inc. Enclosed for your information are copies of the prelinunary deck plans.

Given the planned parking deck facility at 1460 Davem Street, there will be no need for a
separate permanent structure to house Park `n Jet's operations, as it will be housed in the deck
facility. In addition, landscape plans similar to the standard we have already set may also be
incorporated into the design of the new pazking deck.
Our completion of the renovation of the RiverBank Business Center and occupancy of the
building by U.S. Bank, along with construction of the parking deck, will greatly enhance the ta�z
base ofthe properties and the adjoining neighborhood.
As outliued above, construction of the parking deck will negate any need for a separate
permanent stsucture for Park `n Jet's operations. As we will be applying for the construcrion
permit for the parking deck at 1460 Davem Street in the very near future, with construction to
commence immediately, we respectfully ask that you cancel any further action as outlined in your
Apri16, 1998 letter.

Please initiate adverse action against the Pazking Lot License for Pazk N 3et at the
referenced property based on noncompliance with conditions 1 and 4-7. Attached is a
copy of the computer information and the paper file for this license.
The condifions attached to the license, and the license holder's compliance with those
conditions, aze as follows:
1. The temporary office building located on the site will be replaced by a peru�anent
structure with sewer and water connections, no later than October 31, 1997. Site
plan approval and building pemuts from this office aze required.
This condition has not been met. A permanent structure has not been
constructed and no sewer and water connections have been made. However,
a site plan for the area around the buiiding was reviewed and approved.
2. Changes to the pazldng layout planned for spring 1997 must have prior approval
from this office. Site plan approval fzom this office is required.
This condition has been met.
3. The entrance to the lot on Davern shail be constructed per the attached site plan,
dated February 4, 1997. Electrical connections for the control arms and ticket
machines require an electrical permit. Instatlation must be completed by a
licensed electrician. The former entrance on Stewart must be closed off and
properly abandoned in accordance with city requirements and a permit from

were obtained by a licensed electrician. The former entrance on Stewart has
been closed off, however no permit was issued by Public Works. Since there
is no curbing along Stewart Ave., staff from Public Works indicated that
they do not see the necessity of requiring a curb cut permit.
4. The properry along Shepazd Road will be pianted with a variety of "common
lilac". The lilacs shall be placed no more than 5' apart. -
This condition has not been met. The lilacs have not been planted.
5. The plantings will continue around the comer onto Davern Street faz enough as
not to interfere with the Park & Fly sign.
This condition has not been met. The lilacs have not been planted.
6. Davern Street from the Park & Fly entrance to Stewart, the owner will plant
appropriately spaced ornamental shrubbery which will not exceed 3 feet in height.

I have discussed this matter w�ith my client, and while we appreciate that your current plans may
alter the need for a permanent structure and the landscape plans, these are currently conditions on
the license which have not been met Additionally, because it may be some time before the
pernut is issued for consiruction of a parking deck, it is not appropriate to simply ignore the
violation of the curi�ent conditions. However, in light of your explanation, Council may wish to
extend the time in which the conditions aze to be met, or to waive the necessity for the
conditions.
This could be accompiished if the Licensee wishes to admit to the violation and appeaz in front
of the City Council to make that request. Please let me know if this is how you would like to

I am writing in response to your Apri16, 19981etter directed to Park `n 7et, L.L. C. For
your information, we also own the offce property at 2751 Shepard Road, wluch is directly west
of the Park 'n Jet operation.
Shortly after starting the Park `n Jet operation in Mazch, 1997 we commenced successful
negotiations for a long-term lease of the 2751 Shepard Road building. U.S. Bank (formerly
known as First Bank) started their move into the 2751 Shepazd Road building last week. The
building will now be known as the RiverBank Business Center. We have spent millions of dollars
upgrading the building -- including new landscaping, parking surfaces, windows and facade. All
ofthese improvements are above and beyond any City of St. Paul requ'uements. �th U.S. Bank
as the tenant of tlus building 1,800 new lugh-paying jobs will be brought into this area of St. Paul.
Along with continuing the Park `n Jet off-airport parking operation we are committed to
providing adequate parlflng spaces for employees of the U.S. Bank operation. In working with
U. S. Bank, and to give them the assurances that they needed to allow U. S. Bank to commit to
leasing the entire building, pazking issues for the oflice building had to be resolved. Those issues
necessarily involved the neighboring Park `n 7et sites.
Currently our commitments to U.S. Bank necessitate construction of a parking deck at
1460 Davem Street. We are in final design discussions for construction of that deck with Graelic,
Inc. Enclosed for your information are copies of the prelinunary deck plans.

Given the planned parking deck facility at 1460 Davem Street, there will be no need for a
separate permanent structure to house Park `n Jet's operations, as it will be housed in the deck
facility. In addition, landscape plans similar to the standard we have already set may also be
incorporated into the design of the new pazking deck.
Our completion of the renovation of the RiverBank Business Center and occupancy of the
building by U.S. Bank, along with construction of the parking deck, will greatly enhance the ta�z
base ofthe properties and the adjoining neighborhood.
As outliued above, construction of the parking deck will negate any need for a separate
permanent stsucture for Park `n Jet's operations. As we will be applying for the construcrion
permit for the parking deck at 1460 Davem Street in the very near future, with construction to
commence immediately, we respectfully ask that you cancel any further action as outlined in your
Apri16, 1998 letter.

Please initiate adverse action against the Pazking Lot License for Pazk N 3et at the
referenced property based on noncompliance with conditions 1 and 4-7. Attached is a
copy of the computer information and the paper file for this license.
The condifions attached to the license, and the license holder's compliance with those
conditions, aze as follows:
1. The temporary office building located on the site will be replaced by a peru�anent
structure with sewer and water connections, no later than October 31, 1997. Site
plan approval and building pemuts from this office aze required.
This condition has not been met. A permanent structure has not been
constructed and no sewer and water connections have been made. However,
a site plan for the area around the buiiding was reviewed and approved.
2. Changes to the pazldng layout planned for spring 1997 must have prior approval
from this office. Site plan approval fzom this office is required.
This condition has been met.
3. The entrance to the lot on Davern shail be constructed per the attached site plan,
dated February 4, 1997. Electrical connections for the control arms and ticket
machines require an electrical permit. Instatlation must be completed by a
licensed electrician. The former entrance on Stewart must be closed off and
properly abandoned in accordance with city requirements and a permit from

This condition has, for the most part, been met. Permits for the electric work
were obtained by a licensed electrician. The former entrance on Stewart has
been closed off, however no permit was issued by Public Works. Since there
is no curbing along Stewart Ave., staff from Public Works indicated that
they do not see the necessity of requiring a curb cut permit.
4. The properry along Shepazd Road will be pianted with a variety of "common
lilac". The lilacs shall be placed no more than 5' apart. -
This condition has not been met. The lilacs have not been planted.
5. The plantings will continue around the comer onto Davern Street faz enough as
not to interfere with the Park & Fly sign.
This condition has not been met. The lilacs have not been planted.
6. Davern Street from the Park & Fly entrance to Stewart, the owner will plant
appropriately spaced ornamental shrubbery which will not exceed 3 feet in height.
This condition has not been met. Additional shrubbety has not been planted.
7. The property owners will maintain the lilacs on both Davern and Shepazd Road,
i.e. so they do not encroach on the right-of-way.
This condition has not been met. The lilacs have not been planted.
8. The Pazk & Fly operators will park airport shuttles in such a manner that they will
not need to back up to enter or leave the pazking lot.
As far as we know, this condition is met.
