WHEREAS , the Council of the City of Saint Paul , on February 28 ,
1991 , by resolution C.F. 91-333 , approve the vacation of part of
Arundel Street described as follows :
All that part of Arundel Street lying between the north
and south right-of-way line of Orange Avenue in Cottage
Homes
WHEREAS , the Department of Public Works in its letter of August
6 , 1991 , to the Department of Finance and Management Services
states that condition no . 2 of said resolution no . 91-333 which
refers to the dedication of street right-of-way to the City from
the petitioner is no longer required .
THEREFORE BE IT R�SOLVED, that condition no. 2 of said resolution
C.F. 91-333 is hereby deleted . The description of said condition
no. 2 reads as follows:
That the petitioner , its successors , and assigns shall ,
by recordable deed , grant a permanent easement for
right-of-way purposes , to the City of Saint Paul , on ,
over and across the following described property:
All that part of Lot 40 , Cottage Homes which lies within
the arc of a circle whose radius is located 50 feet
south of Orange Avenue and 15 feet westlof the
centerline of Arundel Street
BE IT FURTHER RESOLVED , that in all other respects , resolution
C.F. 91-333 shall remain in full force and effect.

RESOLVED, that upon the petition of Jasaka Company, per Finance
Department File No. 26-1990 that part of Arundel Street lying
between the north and south right-of-way line pf Orange Avenue,
hereinafter described , is hereby vacated and! discontinued as
public property.
The vacated land is described as follows:

I spoke with Bill Freeman today. He is interested in pursuing the
above referenced street vacation in accordance with the agreement
referred to in the attached memo to Marvin Bunnell. The Department
of Public Works has agreed to eliminate their previous requirement
of dedicating a turn-around described in condition no. 2 of the
resolution, C.F. # 91-333. In return the petitioner has agreed to
grant a permanent access easement to the City, as described in
condition no. 3 of the same resolution. '
Therefore, the Department of Public Works has nol,objection to the
approval of an amended resolution eliminating cor�dition no. 2,
pertaining to the dedication of a turn-around. '

Attached is a memo dated January 4, 1991 from our Street Engineer,
Tom Kuhfeld, regarding an agreement with Bill Freeman as partl, of a
vacation approval of the intersection of Orange and Arundel. The
agreement included three conditions. The vacation was approve�d by
City Council February 26, 1991. Now, four months, later nonejof the
conditions of the resolution have been met. Instead a site plan and
variance application have been submitted requesting permissiqn to use
this same area of right-of-way, rather than vacate it.
Mr. Freeman spoke to me recer.tly about his concern regarding the
fairness of condition #2 of the vacation resolution requiring him to �
give up a significant piece of his property to provide a turn-around. '
After consultation with Tom Kuhfeld, we agreed the greatest �oncern �`�
. is in acquiring the access easement referred to in condition #3 of `,
the resolution. I spoke with Mr. Freeman and explained that we are
willing to eliminate the turn-around requirement, but are still
requiring the attached access easement document be recorded.
Therefore, the Department of Public Works has no objection to the
requested variance, provided they are able to meet the other conditions
of the site plan review and the above referenced access ease�ent is
recorded prior to issuance o� any buil ding permits.
