WI�REAS, the Division of Public Health has requested the City Council to hold
public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a two story, wood frame, fire damaged, boarded, deteriorated and
dilapidated, condemned duplex structure located on property hereafter refened to as the
"Subject Property" and commonly known as 682 Mendota Street. This Abstract property is
legally described as:
Lot 15, Robert P. Lewis Subdivision of Block 106 of Lym�n Dayton's
Addition to St. Paul.
WHEREAS, based upon the records i� the Ramsey County Recorder's Office on April
24, 1991 and other information available to the Division of Public Health on or before 7une
24, 1991, the following persons are owners, interested and/or responsible parties of the
Subject Property: David Gossen, 318 Burkley Place, Willernie, MN 55090; David Gossen,
P.O. Box 663, Willernie, MN 55090; A1 Schmidt, C/O Payless Appliance, 1200 Forest, St.
Paul, MN 55106; Canyon Ridge Company, Inc., 7165 Cahill Avenue, Inver Grove Heights,
MN 55076; 7oan Warke, 2488 Taylor Avenu�, White Bear TownShip,�MN 55110; Larry
Warke, 2488 Taylor Avenue, White Bear Township, MN 55110.
The addresses of the above noted persons were obtained from various sources
including the tax records, phone books, mortgage companies, etc.; and
WHEREAS, the Division of Public Health has issued an order identified as an
"Abandoned Building Notice" dated Apri129, 1991 which is attached and incorporated as
part of this Resolution by this reference. This order was serverl in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code on all owners, interested and/or
responsible parties of the Subject Property then known to the enforcement officer. The
notice and order informed these parties that the two story, wood fi�ame, fire damaged,
boarded, deteriorated and dilapidated, condemned duplex structure located on the Subject
Property is an abandoned building and a nuisance pursuant to Secti�ons 45.01, Subd. 1 and
45.02, Subd. 11 of the Saint Paul Legislative Code. The Apri129, 1991 order also had
attached to it a list of deficiencies regarding the house on the Subj�ct Property, said list is
attached and incorporated as part of this resolution; and .

WHEREAS, the Apri129, 1991 order informed all then known owners, interested
parties and responsible parties that they must either repair the structure on the Subject
Property by conecting the list of deficiencies or demolish the structure, either action to take
place by May 29, 1991; and
WHEREAS, no action has been taken regarding compliance with the April 29, 1991
notice and order, and as a result the Division of Public Health requested that public hearings
be scheduled to take place on Wednesday, August 7, 1991 before the Neighborhood Services
Committee of the Saint Paul City Council to prepaze a recommendation to be reviewed and
decided on Tuesday, August 13, 1991 by the Saint Paul City Council in considering the
advisability and necessity of ordering the conection of the nuisance condition through the
rehabilitation or, in the alternative, the demolition and removal of this structure; and
WHEREAS, the above referenced owners, interested and/or responsible parties have
been served notice of the time, place and purpose of the public hearings before the
Neighborhood Services Committee of the City of Saint Paul City Council on Wednesday,
August 7, 1991 and the Saint Paul City Council on Tuesday, August 13, 1991 in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code; and -
WHEREAS, a hearing was held before the Neighborhood Services Committee of the
Saint Paul City Council on Wednesday, August 7, 1991 and all testimony and evidence was
considered by the committee; and
WHEREAS, the Neighborhood Services Committee after receiving testimony and
evidence, made the recommendation to approve a request by the Division of Public Health to
order the above referenced owners, interested parties and responsible parties and their assigns
to make the Subject Property safe and not detrimental to the public peace, health, safety and
welfare and remove its blighting influence on the community by rehabilitating this structure
and conecting those deficiencies set forth in the list previously referernced in accordance with
all applicable codes and ordinances, Q in the alternative by demolishing and removing the
structure and filling the site in accordance with all applicable codes and ordinances. The
rehabilitation or demolition of the structure to be completed within thirty (30) days of the
date of mailing of this resolution; and
WHEREAS, a hearing was held before the Saint Paul City Council on Tuesday,
August 13, 1991 and all testimony and evidence including the action taken by the
Neighborhood Services Committee was considered by the Council; and
NOW THEREFORE, BE IT RESOLVED, that based upon all of the testimony and
evidence presented at the Tuesday, August 13, 1991 hearing, the Saint Paul City Council
hereby adopts the following Findings and Order concerning the house at f 82 Mendota Street:
1. That since February of 1990 the building has been routinely monitored by
Nuisance Buildings Code Enforcement.
2. That the Division of Public Health of the City of Saint �aul condemned this
structure as "Unfit for Human Habitation" under Chapt�r 34 of the Saint Paul
Legislative Code in April of 1991. The building is still subject to this
condemnation order. '

3. That since February of 1990 the City of Saint Paul has on one (1) occasions
issued an order to the then known owners to make thi5 house secure and not
accessible. Because of the inaction on the part of the owners, the City had to
hire a private contractor to make the house secure.
4. That the owners of the Subject Property have repeatedly failed to register and
pay the vacant building fee for this structure as required by Chapter 43 of the
Saint Paul Legislative Code.
5. That there are now and have been since February of 1990 multiple exterior
Housing Code or Building Code violations in existence at the Subject Property.
6. That the owners, interested parties and responsible parties of this house are as
previously stated in this resolution. These individuals have been properly
served notice of the Wednesday, August 7, 1991 and the Tuesday, August 13,
1991 hearings concerning this house.
7. That on April 29, 1991 an Abandoned Building Notice was sent to the then
known owners, interested parties and responsible parti�s ordering these
persons to either demolish and remove the house or make repairs and cure the
list of deficiencies by May 29, 1991.
8. That the order of April 29, 1991 has been disregarded by the then known
owners, interested parties and responsible parties.
9. That the two story, wood frame, fire damaged, boarded, deteriorated and
dilapidated, condemned duplex structure located on the Subject Property is an
abandoned building according to Section 45.01, Subd. 1, of the Saint Paul
Legislative Code in that it is "a building or portion the�eof which has stood
unoccupied for longer than one (1) year" and during that period of time it has
been either "unsecured", "boarded", or has had "multiple exterior Housing
Code or Building Code violations" or has been placarded as "Unfit for Human
Habitation" pursuant to Chapter 34 of the St. Paul Legislative Code.
10. That the two story, wood frame, fire damaged, boarded, deteriorated and
dilapidated, condemned duplex structure located on the Subject Property is a
nuisance as included under Saint Paul Legislative Code Section 45.02, Subd.
11, in that it is an abandoned building located in the City of Saint Paul that has
created a dangerous or unhealthy condition or which threatens the public
peace, health, safety or sanitary condition of the City or which is offensive or
has a blighting influence on the community.
11. That the costs of abatement of this nuisance are estimated to exceed two
thousand dollars ($2,000.00) or the abatement involves demolition of a
building other than a structure accessory to a residential building.

RDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced owners, interested parties and responsible parties and
their assigns shall make the Subject Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on �
the community by rehabilitating this structure and correcting those deficiencies
set forth in the list previously referenced in accordance with all applicable
codes and ordinances, Qr in the alternative by demolishing and removing the
structure and filling the site in accordance with all applicable codes and
ordinances. The rehabilitation or demolition and removal of the structure must
be complete�d within thirty (30) days of the date of ma�ling of this resolution.
2. If the above conective action is not completed within the thirty (30) day time
period, the proper City officials of the City of Saint Paul are hereby authorized ::
to take whatever steps are necessary to demolish and remove this structure and `$A
fill the site and charge the costs incurred against the Subject Property pursuant
to the provisions of Secdon 45.08 of the Saint Paul Legislative Code.
3. In the event the building is to be demolished and removed by the City of Saint
Paul, all personal property or fixtures of any kind which shall unreasonably
interfere with the demolition and removal shall be removed from the building
by the owners, interested parties and/or responsible parties by the end of the
thirty (30) day dme period. If the personal property is not so removed, the
City of Saint Paul shall remove and dispose of such property and fixtures as is
. provided by law.
4. IT IS FURTHER ORDERED, that a certified copy of this resolution and the
incorporated Order and list of deficiencies be mailed to the last known address
of the owners, interested parties and responsible parties pursuant to Section
45.11, Subdivision (5) of the Saint Paul Legislative Cade.

Dear Sir or Madam:
The Division of Public Health has determined that the above noted building is an abandoned
building, whicr. Chapter 45 of the Saint Paul Legislative Code defines as:
any building or portion of a building which has stood with an incomplete exterior
shell for longer than three (3) years or any building or portion thereof which has
stood unoccupied for longer than one (1) year and which meets one or more of the
following criteria;
(a) unsecured, or
@) boarded, or
(c) having multiple exterior Housing Code or Building Code violations, or
(d) placarded as "Unfit for Human Habitation" pursuant to Chapter 34 of the Saint
Paul Legislative Code.°
The ordinance further states that an abandoned building is a nuisance and it may be ordered
to be demolished and removed by the City.
NOTICE: If you do not want to have the City begin action to have the building
demolished and removed, then the attached list of deficiencies must be repaired or you
must demolish and remove the building on or before May 29, 1991.

If you are unable to finance the correction or rehabilitation of the premises to comply with
this order, there are state and local rehabilitatio� programs for which you may qualify.
Information about these programs is available from the Department of Planning and
Economic Development, Rehabilitation Section at (612) 228-3105. Ask to speak to a loan
officer.
If you sell, transfer or convey, in any manner, the ownership or responsibility for this
property, you must within seven ('n days of such action, prov�de the Division of Public
Health with the names and addresses of any new owners or responsible parties.
You must also notify any new owners or responsible parties of this pending action by
the Division of Public Health.
Any repair or demolition must be completed in accordance will all applicable laws.
If the rehabilitation work is not completed or if you have not demolished and removed the
building by the above date, the Division of Public Health will refer this matter to the City
Council to receivz authority to have the building demolished and removed. All casts
incuned in wrecking and removing the building will be charged against the real estate as a
special assessmznt to be collectetl in the same manner as taxes. The City Council will
schedule public hearings to consider the necessity and advisability of ordering the building
repaired or demolished and removed. If public hearings become necessary, you will be
notified of the times and dates of the hearings and you will be allowed to present evidence to
the City CounciL
A copy of this order will be kept on file in the City Clerk's Office and a Resolution
declaring this property to be a nuisance shall be on file in the Ramsey County Recorder's
Office. Compliance with the attached list of deficiencies will remove your building from the
list of abandoned buildings but it does not mean that the building complies will all applicable
Housing and Building Codes. '
The date for compliance with these orders shall not be extended unless you receive written
approval from the Division of Public Health. �
If you wish to have the City demolish and remove your building, you may do so by
requesting a consent form be sent to you from our office, to sign and return to the Division
of Public Health. However, please be aware that all owners and interested parties must sign
a Consent to Raze form before the City can demolish and remove the building without a City
Council order. Also be aware that the cost of the demolition, if performed by the City,
would become a special assessment against the property.

All repairs and new installations must be made in accordance with the appropriate codes.
Permits must be obtained where changes and/or additions to an electrical system require
upgrading of the service size to cunent National Electrical Code (N.E.C.) requirements.
Some plumbing repairs may necessitate updating of the fixtures and/or piping invo?ved. A
permit is required for any repair or new installation. Permits may b�e obtained from the
Building Inspection and Design Division, Room 445, City Hall.
North Side of Building - North Entry
1. Fire damaged walls, siding, eaves and possibly roof areas. Repair all fired damaged
areas.
2. Foundation area around ground area is deteriorated concrete with mortar missing.
There is skirting around most of the area. Remove skirting and repair all foundation
areas.
3. Windows are boarded. Remove boards and install windows as needed.
4. �aves are missing. Install eaves and soffits.
5. Wood trim needs paint. Paint all wood siding.
6. Siding is missing. Reside as necessary.
7. Elcisting gutter system has been removed. Downspout remains and originates from
second floor. Install or remove.
8. Front porch area entry way is sagging and deteriorating. Repair as needed.
9. Illegal wiring running to light fixture from front entry way on west side. Remove or
install as per National Electrical Code Requirements.

10. Combination windows are missing. Install combination windows as needed.
11. Trees growing up along foundation area. Remove all trees and brush from this area.

Dear Property Owner:
The Division of Public Health, Housing Code Enforcement Section of the City of Saint Paul,
Minnesota has determined that the dwelling and premises at 682 Mendota Street is "Unfit for
Human Habitation". In accordance with Saint Paul Legislative Code, Chapter 34, Section
19, the premises will be placarded on April 30, 1991 and ordered vacated no later than April
30, 1991.
Your attention is called to the following provisions of Section 34.19, Subsections E and F
entitled, "Vacation of Condemned and Placarded Dwellings":
"Any dwelling or multiple dwelling which has been condemned and
placarded Unfit for Human Habitation by the enforcement officer shall be
vacated within a reasonable time as required by the enforcement officer,
and it shall be unlawful for any owner or operator to let to any person for
human habitation said dwelling, multiple dwelling or dwelling unit; and no
person shall occupy said dwelling or multiple dwelling unit which has been
condemned and placarded by the enforcement officer after the date set
forth in the placard of condemnation,"

WHEREAS, the Division of Public Health has requested the City Council to hold
public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a two story, wood frame, fire damaged, boarded, deteriorated and
dilapidated, condemned duplex structure located on property hereafter referred to as the
°Subject Property" and commonly known as 682 Mendota Street. This Abstract property is
legally described as: '

VVHEREAS, based upon the records i� the Ramsey County Recorder's Office on April
24, 1991 and other information available to the Division of Public Health on or before June
24, 1991, the following persons are owners, interested and/or responsible parties of the
5ubject Property: David Gossen, 318 Burkley Place, Willernie, MN 55090; David Gossen,
P.O. Box 663, Willernie, MN 55090; A1 Schmidt, C/O Payless Appliance, 1200 Forest, St.

The addresses of the above noted persons were obtained from various sources
including the tax records, phone books, mortgage companies, etc.; and
WHEREAS, the Division of Public Health has issued an order identified as an
"Abandoned Building Notice" dated April 29, 1991 which is attached �nd incorporated as
part of this Resolution by this reference. This order was served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code on all owners, interested and/or
responsible parties of the Subject Property then known to the enforcement officer. The
notice and order informed these parties that the two story, wood frame, fire damaged,
boarded, deteriorated and dilapidated, condemned duplex structure located on the Subject
Property is an abandoned building and a nuisance pursuant to Sections 45.01, Subd. 1 and
45.02, Subd. 11 of the Saint Paul I.egislative Code. The April 29, 1991 order also had
attached to it a list of deficiencies regarding the house on the Subject Property, said list is
attached and incorporated as part of this resolution; and .

WHEREAS, the April 29, 1991 order informed all then known owners, interested
parties and responsible parties that they must either repair the structure on the Subject
Property by conecting the list of deficiencies or demolish the structure, either action to take
place by May 29, 1991; and
WHEREAS, no action has been taken regarding compliance with the Apri129, 1991
notice and order, and as a result the Division of Public Health requested that public hearings
be scheduled to take place on Wednesday, August 7, 1991 before the Neighborhood Services
Committee of the Saint Paul City Council to prepare a recommendatian to be reviewed and
decided on Tuesday, August 13, 1991 by the Saint Paul City Council in considering the
advisability and necessity of ordering the correction of the nuisance condition through the
rehabilitation or, in the alternative, the demolition and removal of this structure; and
WHEREAS, the above referenced owners, interested and/or re�ponsible parties have -
been served notice of the time, place and purpose of the public hearings before the �
Neighborhood Services Committee of the City of Saint Paul Ciry Council on Wednesday,
August 7, 1991 and the Saint Paul City Council on Tuesday, August 13, 1991 in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code; and
WHEREAS, a hearing was held before the Neighborhood Services Committee of the
Saint Paul City Council on Wednesday, August 7, 1991 and all testimony and evidence was
considered by the committee; and
WHEREAS, the Neighborhood Services Committee after receiving testimony and
ev?dence, made the recommendation to approve a request by the Division of Public Health to
order the above referenced owners, interested parties and responsible parties and their assigns
to make the Subject Property safe and not detrimental to the public peace, health, safety and
welfare and remove its blighting influence on the community by rehabilitating this structure
and conecting those deficiencies set forth in the list previously referenced in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure and filling the site in accordance with all applicable codes and ordinances. The
rehabilitation or demolition of the structure to be completed within thirty (30) days of the
date of mailing of this resolution; and
WHEREAS, a hearing was held before the Saint Paul City Council on Tuesday,
August 13, 1991 and all testimony and evidence including the action taken by the
Neighborhood Services Committee was considered by the Council; and
NOW THEREFORE, BE IT RESOLVED, that based upon all of the testimony and
evidence presented at the Tuesday, August 13, 1991 hearing, the Saint Paul City Council
hereby adopts the following Findings and Order concerning the house �t 682 Mendota Street:
1. That since February of 1990 the building has been routinely monitored by
Nuisance Buildings Code Enforcement.
2. That the Division of Public Health of the City of Saint Paul condemned this
structure as "Unfit for Human Habitation" under Chapter 34 of the Saint Pau1
Legislative Code in April of 1991. The building is still subject to this

3. That since February of 1990 the City of Saint Paul has on one (1) occasions
issued an order to the then known owners to make this house secure and not
accessible. Because of the inaction on the part of the owners, the City had to
hire a private contractor to make the house secure.
4. That the owners of the Subject Property have repeatedly failed to register and
pay the vacant building fee for this structure as required by Chapter 43 of the
Saint Paul I,egislative Code.
5. That there are now and have been since February of 1990 multiple exterior
Housing Code or Building Code violations in existence at the Subject Property.
6. That the owners, interested parties and responsible parties of this house are as
previously stated in this resolution. These individuals have been properly
served notice of the Wednesday, August 7, 1991 and the Tuesday, August 13,
1991 hearings concerning this house.
7. That on April 29, 1991 an Abandoned Building Notice was sent to the then
known owners, interested parties and responsible parties ordering these
persons to either demolish and remove the house or make repairs and cure the
list of deficiencies by May 29, 1991.
8. That the order of April 29, 1991 has been disregarded by the then known
cwners, in�erested parties and responsible parties.
°. That the two story, wood frame, fue damaged, boarded, deteriorated and
dilapidated, condemned duplex structure located on the Subject Property is an
abandoned building according to Section 45.01, Subd. 1, of the Saint Paul
Legislative Code in that it is "a building or portion thereof which has stood
unoccupied for longer than one (1) year" and during that period of time it has
been either "unsecured", "boarded", or has had "multiple exterior Housing
Code or Building Code violations" or has been placarded as "Unfit for Human
Habitation" pursuant to Chapter 34 of the St. Paul Legislative Code.
10. That the two story, wood frame, fire damaged, boarded, deteriorated and
dilapidated, condemned duplex structure located on the Subject Property is a
nuisance as included under Saint Paul Legislative Code Section 45.02, Subd.
11, in that it is an abandoned building located in the City of Saint Paul that has
created a dangerous or unhealthy condition or which �hreatens the public
peace, health, safety or sanitary condition of the City or which is offensive or
has a blighting influence on the community.
11. That the costs of abatement of this nuisance are estimated to exceed two
thousand dollars ($2,000.00) or the abatement involv�s demolition of a
building other than a structure accessory to a residential building.

RDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced owners, interested parties and responsible parties and
their assigns shall make the Subject Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on
the community by rehabilitating this structure and correcting those deficiencies
set forth in the list previously referenced in accordance with all applicable
codes and ordinances, Qr in the alternative by demolishing and removing the
structure and filling the site in accordance with all appl�cable codes and
ordinances. The rehabilitation or demolition and removal of the structure must
be complete.d within thirty (30) days of the date of mailing of this resolution.
2. If the above conective action is not completed within the thirty (30) day time
period, the proper City officials of the City of Saint Pat�l are hereby authorized
to take whatever steps are necessary to demolish and remove this structure and
fill the site and charge the costs incurred against the Su;bject Property pursuant
to the provisions of Section 45.08 of the Saint Paul I.egislative Code.
3. Iri the event the building is to be demolished and removed by the City of Saint
Paul, a11 personal property or fixtures of any kind which shall unreasonably
interfere with the demolition and removal shall be removed from the building
by the owners, interested parties and/or responsible parties by the end of the
thirty (30) day time period. If the personal property is not so removerl, the
City of Saint Paul shall remove and dispose of such prqperty and fixtures as is
provided by law.
4. TT IS FURTHER ORDERED, that a certified copy of this resolution and the
incorporated Order and list of deficiencies be mailed to the last known address
of the owners, interested parties and responsible parties pursuant to Section
45.11, Subdivision (5) of the Saint �aul Legislative Code.

The Divisicn of Public Health, Housing Code Enforcement Section of the City of Saint Paul,
I�iinnesota has deter.mined that the dwelling and premises at 682 Mendota Street :s "Unfit fer
Human Habitation". In ac.cordance with Saint Paul Legislative Code, Chapter 34, Section
1.9, �'ne premises will be placarded on April 3U, i991 and ordered vacated no later than April
3�, 1991.
Your attention is called to the following provisions of Section 34.19, Subsections E and F
entitled, "Vacation of Condemned and Placarded Dwellings":
"Any dwelling or multiple dwelling which has been condemned and
placarded CTnfit for Human Aabitation by the enforcement officer shall be
vacated within a reasonable time as required by the enforcement officer,
and it shall be unlawful for any owner or operator to Iet to any person for
human habitation said dwelling, multiple dwelling or dwelling unit; and no
person shall occupy said dwelling or multiple dwelling unat which has been
condemned and placarded by the enforcement officer after the date set
forth in the placard of condemnation."
THIS DWELLING SHALL NOT AGAIN BE USED FOR HUMAN HABITATION UNTIL
WRITTEN APPROVAL IS SECURED FROM THE DIVISION OF PUBLIC HEALTH,
HOUSING CODE ENFORCEMENT SECTION.

VIOLATION LIST:
North Side of Building - North Entry
l. Fire damaged walls, siding, eaves and possibly roof areas. Repair all fired damaged
areas.
2. Foundation area around ground area is deteriorated concrete with mortar missing.
There is skirting around most of the area. Remove skirting and repair all foundation
areas.
3. Windows are boarded. Remove boards and install windows as neecied.
4. Eaves are missing. Install eaves and soffits.
5. Wood trim needs paint. Paint all wood siding.
6. Siding is missing. Reside as necessary.
7. Existing gutter system has been removed. Downspout rernains and originates from
second floor. Ir_stall or remove.
8. Front porch area entry way is sagging and deteriorating. Repair as needed.
9. Illegal wiring running to light fixture from front entry way on west side. Remove or
install as per National Electrical Code Requirements. '
West Side of Building
10. Combination windows are missing. Install combination windows as needed.
11. Trees growing up along foundation area. Remove all trees and brush from this area.
12. Foundation area is buckling and has cracked and�missing mortar. Remove all skirting
and repair foundation area.
13. The windows are boarded. Remove boards and install windows as needed.
14. The soffits do not fit properly, are separating and has cracked wood in corner areas.
Repair as needed.

and repair foundation area. �
16. The windows are broken and boarded. Remove boards, remove and install new
windows as needed.
East Side of Building
17. The wood trim and siding is unfinished. Repaint wood as needed. -
18. Foundation area is buckling and has cracked and missing mortar. Remove all skirting
and repair foundation area.

General
21. Lack of basic fa.cility - gas and electricity. Restore basic facilities.
Authorization to reoccupy this/these dwelling unit(s) will not be given until it is demonstrated
that these violations have been corrected, and that this/these dwelling(s) have been made to
comply with all applicable provisions of the Housing Code and all other applicable existing
laws.
All repairs and new installations must be made in accordance with the appropriate codes.
Permit information may be obtained from the Building Inspection and Design Division,
Room 445 City Hall, 298-4212.
Appeals information may be obtained by calling 292-7775.
It is the responsibility of the property owner to keep all buildings secured, and to properly
maintain the premises at all times.
