RESOLVED, that the Intoxicating Liquor Off Sale license held by The Mao
Family Corporation, dba Wolter Brothers Pharmacy & Liquor $or the premises at 436-
438 University Avenue West in Saint Paul are hereby suspended for a period of
��� 1�-r �� consecutive days. The suspension shall take place on the second Monday
following publication of this Resolution.
This Resolution and the action taken above are based upon the facts contained in
the attached police report dated June 20, 1991. The facts as outlined in the police
report are not contested by the licensee, as evidenced by the at'tached letter dated
August 2, 1991, signed by Jerome A. Ritter, Counsel for the licenseholder. The action
taken is also based on the facts, circumstances and arguments presented by and on
behalf of the licensee during the Public Hearing.
A copy of this resolution as adopted shall be sent by first class mail to counsel for
the licenseholder.

I am in receipt of information that could lead to ah action against
all your licenses. The basis for adverse action �s that on:
"On June 20, 1991, at about 5:50 p.m. , an employee of the
licensed establishment sold a 12-pack of Milwaukee beer
to a minor without checking the age and/or identification
of the minor. "
If you do not dispute the allegations or facts, or agree that a
violation occurred, but want to have the opportunity to speak to
the Council to argue for the lightest possible penalty under all
the circumstances, please call me at 298-5121 to work out the
procedures.
If you contest the allegations or dispute the facts, I will take
the necessary steps to schedule a hearing before an independent
hearing examiner and provide you with a proper notiGe of hearing so
you will know when and where to appear, and what the basis for the
hearing will be. Please respond within ten day�s. You may be

referenced matter. I have d i scussed th i s wi th my c 1 i ent and i t
appears they will not object to or otherwise dispute the allegation
regarding the June 20, 1991 liquor sale.
I would greatly appreciate it if you would forward to me copies of
the police reports regarding this matter.
You are aware that my clients were previously charged with an
illegal liquor sale. That previous matter was not disputed and the
St. Paul City Council assessed a three day suspension of their
license as penalty. Two days of that suspension were stayed for
a period of 18 months provided there be no similar offenses. This
recent incident is an obvious violation of those �►revious condi-
tions. I would ask that my clients be able to break up the periods
of suspension levied from the previous incident and any period of
suspension that might be levied due to this recent incident . For
example, if my clients could suspend operations for two days to
satisfy the prior incident, resume operation for a ;period of time,
then suspend operation for whatever period of time, is required as
a result of this second incident .

Mao Family Corporation, dba Wolter Brothers Pharmacy & Liquor for the
premises at 440 University Avenue West (business address of 436-38
University West) in Saint Paul are hereby suspended for a period of three
days, provided that two days of the suspension are stayed for a period of
18 months on condition that the said licensee shall have no further
violations of law during that period. The one day suspension that take r',
place on the second Monday following publication of �his Resolution.
This Resolution and the action taken above are based upon the facts
contained in the attached police report dated January 29, 1991. The
facts as outlined in the police report �are not contested by the licensee,
as evidenced by the attached letter dated February 25, 1991, signed by
Jerome A. Ritter, Counsel for the licenseholder. The action taken is
also based on the facts, circumstances and arguments presented by and on
behalf of the licensee during the Public Hearing. The action taken
represents a downward departure from the presumptive penalty in Section
409. 26 of the Legislative Code. The basis for the downward departure is
that this violation occurred when the licensee had been in business for
just a short period of time, and has since becoming aware of the
violation instituted procedures for demanding identi�ication from
customers of the business which will help avoid similar violations in the
future.

RESOLVED, that the Intoxicating Liquor Off Sale license held by The Mao
Family Corporation, dba Wolter Brothers Pharmacy & Liquor for the premises at 436-
438 University Avenue West in Saint Paul are hereby suspended for a period of
consecutive days. The suspension shall take place on the second Monday
following publication of this Resolution.
This Resolution and the action taken above are based upon the facts contained in
the attached police report dated June 20, 1991. The facts as outlined in the police
report are not contested by the licensee, as evidenced by the attached letter dated
August 2, 1991, signed by Jerome A. Ritter, Counsel for the licenseholder. The action
taken is also based on the facts, circumstances and arguments pre�ented by and on
behalf of the licensee during the Public Hearing.
A copy of this resolution as adopted shall be sent by first class mail to counsel for

Dear Ms. Yon Ho:
I am in receipt of information that could lead to an action against
all your licenses. The basis for adverse action is that on:
"On June 20, 1991, at about 5:50 p.m. , an employee of the
licensed establishment sold a 12-pack of Milwaukee beer �
to a minor without checking the age and/or identification
of the minor. "
If you do not dispute the allegations or facts, or agree that a
violation occurred, but want to have the opportur�ity to speak to
the Council to argue for the lightest possible penalty under all
the circumstances, please call me at 298-5121 to work out the
procedures. �
If you contest the allegations or dispute the faGts, I will take
the necessary steps to schedule a hearing before an independent
hearing examiner and provide you with a proper notice of hearing so
you will know when and where to appear, and what the basis for the

Dear Mr. Byrne:
I apologize for my delay in getting back to you regarding the above- -
referenced matter. I have discussed this with my client and it
appears they will not object to or otherwise dispute the allegation
regarding the June 20, 1991 liquor sale.
I would greatly appreciate it if you would forward to me copies of
the police reports regarding this matter.
You are aware that my clients were previously charged with an
illegal liquor sale. That previous matter was not disputed and the
St. Paul City Council assessed a three day suspension of their
license as penalty. Two days of that suspension were stayed for
a period of 18 months provided there be no similar offenses. This
recent incident is an obvious violation of those previous condi-
tions. I would ask that my clients be able to break up the periods
of suspension levied from the previous incident and any period of
suspension that might be levied due to this recent incident . For
example, if my clients could suspend operations for two days to
satisfy the prior incident , resume operation for a period of time,
then suspend operation for whatever period of time is required as
a result of this second incident .

University West) in Saint Paul are hereby suspended for a period of three
days, provided that two days of the suspension are stayed for a period of
18 months on condition that the said licensee shall have no further
violations of law during that period. The one day suspension that take
place on the second Monday following publication of this Resolution.
This Resolution and the action taken above are based upon the facts -�.�
contained in the attached police report dated Janua�y 29, 1991. The ';a�
facts as outlined in the police report -are not contested by the licensee, `'
as evidenced by the attached letter dated February 25, 1991, signed by
Jerome A. Ritter, Counsel for the licenseholder. The action taken is
also based on the facts, circumstances and arguments presented by and on
behalf of the licensee during the Public Hearing. The action taken
represents a downward departure from the presumptive penalty in Section
409 . 26 of the Legislative Code. The basis for the downward departure is
that this violation occurred when the licensee had been in business for
just a short period of time, and has since becoming aware of the
violation instituted procedures for demanding identification from
customers of the business which will help avoid similar violations in the
future.
