The basis for adverse action �s that on: "On June 20, 1991, at about 5:50 p.m. , an employee of the licensed establishment sold a 12-pack of Milwaukee beer to a minor without checking the age and/or identification of the minor. " If you do not dispute the allegations or facts, or agree that a violation occurred, but want to have the opportunity to speak to the Council to argue for the lightest possible penalty under all the circumstances, please call me at 298-5121 to work out the procedures. I have d i scussed th i s wi th my c 1 i ent and i t appears they will not object to or otherwise dispute the allegation regarding the June 20, 1991 liquor sale. I would greatly appreciate it if you would forward to me copies of the police reports regarding this matter. You are aware that my clients were previously charged with an illegal liquor sale. That previous matter was not disputed and the St. Paul City Council assessed a three day suspension of their license as penalty. Two days of that suspension were stayed for a period of 18 months provided there be no similar offenses. This recent incident is an obvious violation of those �►revious condi- tions. I would ask that my clients be able to break up the periods of suspension levied from the previous incident and any period of suspension that might be levied due to this recent incident . For example, if my clients could suspend operations for two days to satisfy the prior incident, resume operation for a ;period of time, then suspend operation for whatever period of time, is required as a result of this second incident . The one day suspension that take r', place on the second Monday following publication of �his Resolution. This Resolution and the action taken above are based upon the facts contained in the attached police report dated January 29, 1991. The facts as outlined in the police report �are not contested by the licensee, as evidenced by the attached letter dated February 25, 1991, signed by Jerome A. Ritter, Counsel for the licenseholder. The action taken is also based on the facts, circumstances and arguments presented by and on behalf of the licensee during the Public Hearing. The action taken represents a downward departure from the presumptive penalty in Section 409. 26 of the Legislative Code. I have discussed this with my client and it appears they will not object to or otherwise dispute the allegation regarding the June 20, 1991 liquor sale. I would greatly appreciate it if you would forward to me copies of the police reports regarding this matter. You are aware that my clients were previously charged with an illegal liquor sale. That previous matter was not disputed and the St. Paul City Council assessed a three day suspension of their license as penalty. Two days of that suspension were stayed for a period of 18 months provided there be no similar offenses. This recent incident is an obvious violation of those previous condi- tions. I would ask that my clients be able to break up the periods of suspension levied from the previous incident and any period of suspension that might be levied due to this recent incident . For example, if my clients could suspend operations for two days to satisfy the prior incident , resume operation for a period of time, then suspend operation for whatever period of time is required as a result of this second incident .
