WHEREAS, the Division of Public Health has requested the City Council to hold public �
hearings to consider the advisability and necessity of ordering t�e repair or wrecking and =
a
removal of a Two story, wood frame, condemned, boarded, deteriorated, dilapidated,residential �
structure with a deteriorated, dangerous detached garage which aze lpcated on property hereafter
referred to as the "Subject Property" commonly known as 965 Marshall Avenue. This Abstract ,;
property is legally described as: �
Lot 18, and all of Lot 19 except the East 30 feet thereof; Block A, Marshall �
Boulevard Addition to the City of St. Paul, according to the r�ecorded plat thereof,
and situate in Ramsey County, Minnesota. ;
WHEREAS, based upon the records in the Ramsey Co'unty Recorder's Office on
November 2, 1990 and oral information'obtained through 7uly l, 1991 and other information
available to the Division of Public Health on or before 7une 28, 1991, the following persons are
owners, interested and/or responsible parties of the Subject Propert�: Administrator of Veterans
Affairs, Fort Snelling, Room 266 C, St. Paul, MN 55111; Donna Kapaun, 380 Wheelock
Pkwy E. #359, St. Paul, MN 55109; 7ames Green, 965 Marshall Avenue, St. Paul, MN
55104; Minnesota Housing Finance Agency, 400 Sibley Street, S�. Paul, MN 55101; Carole
P. Herzog, 926 Hall Avenue, West St. Paul, MN 55118. �
The addresses of the above noted persons were obtained from various sources including
the Ramsey County ta�c records, phone books; mortgage companies, etc.; and
WHEREAS, the Division of Public Health has issued orders identified as an "Abandoned
Building Notice" with "Dangerous Accessory Structure" dated November 21, 1990 which is
attached and incorporated as part of this Resolution by this refer�,nce. This order was served
in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code on all
owners, interested and/or responsible parties of the Subject P'roperty then known to the
enforcement officer. T'he notice and order informed these partiQs that the Two story, wood
frame, condemned, boarded, deteriorated, dilapidated, residential structure located on the
subject property is an abandoned building pursuant to Section 45.b1, Subd. 1 of the Saint Paul
Legislative Code; the deteriorated, dangerous detached garage lo�ated on the Subject Property
is a dangerous structure pursuant to Section 45.01, Subd. 3 of the Saint Paul Legislative Code;
and both buildings are nuisances gursuant to Sections 45.02, Subd: 10 and Subd. 11 of the Saint
Paul Legislative Code. The November 21, 1990 order also had attached to it a list of
deficiencies regarding the structures on the Subject Property, said list is attached and
incorporated as part of this resolution; and

NOW, THEREFORE, BE IT RESOLVED that based upon all of the testimony and ¢

adopts the following Findings and Order concerning the structures at 965 Marshall Avenue: � ,

1. That since September of 1989 the buildings have been routinely monitored by �`'`
Nuisance Buildings Code Enforcement.
2. That the Division of Public Health of the City of Saint Paul condemned this
structure as "Unfit for Human Habitakion" according to Chapter 34 of the Saint ;�;
Paul Legislative Code in June of 1989.

3. That since September of 1989 the City of Saint Paul has on four (4) occasions �
issued orders to the owners to make these buildings secure and not accessible.
Because of the inaction on the part of the owners, the City has had to hire a
private contractor to make the buildings secure and not open to access.
4. That the owners of the Subject Property have repeatedly failed to register and pay -
the vacant building fee for this property as required by City Ordinance.
5. That there are now and have been since September of 1989 multiple exterior
Housing Code or Building Code violations in existence at the Subject Property.
6. That the owners, interested parties and responsible parties of these buildings are
as previously stated in this resolution. These individuals have been properly
served notice of the Wednesday, August 7, 1991 and the Tuesday, August 13,
1991 hearings concerning these buildings.
7. That on November 21, 1990 an Abandoned Building Notice with Dangerous
Accessory Structure was sent to the owners, interested parties and responsible
parties ordering these persons to either demolish and remove these buildings or
make repairs and cure the list of deficiencies by December 21, 1990.
8. That on January 17, 1991 the owners were granted an extension until April 17,
1991 to complete the demolition or rehabilitation of the structures.
9. That on April 12, 1991 the owners were granted an extension until June 12, 1991
to complete the demolition or rehabilitation of the structures.
10. That the order of November 21, 1990 and the extensions of January 17, 1991 and
April 12, 1991 have been disregarded by the owners, interested parties and
responsible parties.
11. That the two story, wood frame, condemned, boardeti, deteriorated, dilapidated,
residendal structure located on the Subject Property is an abandoned building
according to Section 45.01, Subd. 1, of the Saint Paul Legislative Code in that it
is "a building or portion thereof which has stood unoccupied for longer than one
(1) year" and during that period of time has been either "unsecured" or "boarded"
or has had "multiple exterior Housing Code or Building Code violations".

13. That the deteriorated, dangerous detached garage located on the Subject Property ,�:_;�
is a dangerous structure according to Section 45.01, Subd. 3 of the Saint Paul
Legislative Code in that it is "a structure which is potentially dangerous to ,`�
p ersons or pro p e rt y" includin g bein g "a structure which has been contaminated -
from the storage of hazardous waste material".
14. That the deteriorated, dangerous detached garage loca�ted on the Subject Property
is a nuisance as defined according to Saint Paul Legi�lative Code Section 45.02,
Subd. 10, in that it is a dangerous structure located ir1 the City of Saint Paul that
has created a dangerous or unhealthy condition or �vhich threatens the public
peace, health, safety or sanitary condition of the City or which is offensive or has
a blighting influence on the community.
15. That the costs of abatement of these nuisances are estimated to exceed two
thousand dollars ($2,000.00) or the abatement involves demolition of a building
other than a structure accessory to a residential building.
RDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced owners, interested parties and responsible parties and their
assigns shall make the Subject Property safe and nqt detrimental to the public
peace, health, safety and welfare and, remove its Iblighting influence on the
community by rehabilitating these buildings and con ting those deficiencies set
forth in the list previously referenced in accordance ith all applicable codes and
ordinances, Q in the alternative by demolishing and �removing the buildings and
filling the site in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of these buildings must be completed
within thirty (30) days of the date of mailing of this resolution.
2. If the above conective action is not completed within the thirty (30) day time
period, the proper City officials of the City of Saint Paul are hereby authorized
to take whatever steps are necessary to demolish and remove these buildings and
fill the site and charge the costs incurred against the Subject Property pursuant
to the provisions of Section 45.08 of the Saint Paul Legislative Code.

The owners, interested parties and responsible partiea known to he Division of Public

The Division of Public Health has determined that the above noted building is
an abandoned building, which Chapter 45 of the Saint PaLil Legislative Code
defines as:
"any building or portion of a building which has stood with an
incomplete exterior shell for longer than three (�) years or any
building or portion thereof which has stood unoccupied for longer than
one (1) year and which meets one or more of the following criteria;
(a) Unsecured, or
(b) boarded, or
(c) having multiple exterior Housing Code or Bu�lding Code violations,
or �
(d) placarded as "Unfit for Human Habitation" pursuant to Chapter 34
of the Saint Paul Legislative Code."
The Division of Public Health has also determined that there is a dangerous
structure in the form of a garage accessory to the above noted building, which
Chapter 45 of the Saint Paul Legislative Code defines as:

rails, balconies, or roofs which are accessible and which are
either collapsed, in danger of collapsing, or unable to support a

The ordinance further states that an abandoned building and a dangerous
structure are both nuisances and may be ordered demolished and removed by the
City. �
NOTICE: If you do not want to have the City begin action to have the
buildings torn down, then the attached list of deficiencies must be repaired
or you must tear the buildings down on or before December 21. 1990
�
If you sell, transfer or convey, in any manner, the ownership or
responsibility for this property, you must within seven (7} days of such
action, provide the Division of Public Health with the names and addresses of
any new owners or responsible parties.
You must also notify any new owners or responsible parties of this pending
action by the Division of Public Health.
Any repair or demolition must be completed in accordance will all applicable
laws.
If the rehabilitation work is not cornpleted or if you have n�t demolished and
removed the house and garage by the above date, the Division of Public Health
will refer this matter to the City Council to receive authority to have the
house and garage demolished and removed. Al1 costs incurred in wrecking and
removing the buildings will be charged against the real eGtate as a special
assessment to be collected in the same manner as taxes. The City Council will
schedule public hearings to consider the necPSSity and advisability of
ordering the buildings repaired or demolished and removed, If public hearings
become necessary, you will be notified of the times and dates of the hearings
and you will be allowed to present evidence to the City Council.
A copy of this order will be kept on file in the City Clerk's Office and a
resolution declaring this property to be a nuisance shall be on file in the
Ramsey County Recorder's Office. Compliance with the attached list of
deficiencies will remove your building f rom the list of abandoned buildings
but it does not mean that the buildings comply with all applicable housing and
building codes.
The date for compliance with these orders shall not be extended unless you
receive written approval from the Division of Public Health,
If you wish to have the City tear down your house and garage, you may requect
a consent form be sent to you from our office to sign and return to us.
However, please be aware that all owners and interested parties must sign the
form before the City can tear the buildings down without a City Council order.
Also be aware that the cost of the demolition, if performed by the City, would
become a special assessment against the property.

appropriate codes. Per7nits must be obtained where changes and/or additions to
an electrical system require upgrading of the service size to current National
Electrical Code (N.E.C. ) requirements. Some plumbing repaira may necessitate =
updating of the fixtures and/or piping involved. A permit is required for any ,.F:�
repair or new installation. Permits may be obtained from the Building
Inspection and Design Division, Room 445, City Hall.
Front of Building
1 . The f ront porch foundation has loose and missing mortar. Repair
foundation.
2. The f ront porch steps are severely rotted and decayed. Replace all
decayed wood and rebuild the steps in compliance with the code.
3. The f ront porch floor boards are rotted, decayed and settled out of
level. Remove all decayed wood and rebuild the porch in compliance with
the code.
4. The plate glass f ront window has broken glass. Replace this glass.
5 . The front window nearest to the front door is boarded over. Remove the
board.
6. The second floor window by the west side has broken glass. Replace this
glass.
7 . The eaves above the second floor have loose and '�missing paint, rodent
holes and some missino and decayed wood. Replace all damaged and
decayed wood and repaint.
8. The eaves above the attic have loose and missing paint, decayed wood and
rodent holes. Replace all damaged and decayed wood and repaint.

9. The foundation has loose and missing mortar. Repair.
10. The siding has loose and missing paint. Repaint.
11 . The eaves have loose and missing paint, rotted, decayed and loose wood.

of the City of Saint Paul, Minnesota, has found that the dwelling
and premises at 965 Marshall Avenue is "Unfit for Human Habitation"
due to the want of repairs, and/or defects in the drainage,
plumbing, lighting or construction. of said dwelling and premises,
and/or for other causes affecting public health.
If you are unable to finance the correction or rehabilitation of

The subject property has been routinely monitored by the Nuisance Buildings Code
Enforcement Program since September of 1989.
The buildings meet one or more of the conditions that constitute an �bandoned Building and
a Dangerous Structure as defined in Chapter 45 of the Saint Paul Legislative Code.
On November 21, 1990 the Division of Public Health mailed an order to the then known
owners, interested parties and responsible parties of this building requiring that the building
be either repaired, by correcting the attached list of deficiencies, or demolished on or before
December 21, 1990. An extension was granted on 7anuary 17, 199� with a compliance date
of April 17, 1991, and an extension was granted on April 12, 1991 with a compliance date
of June 12, 1991.
Inasmuch as the order has not been completed to the satisfaction of this Division and the
continued abandoned and dangerous condition of the buildings contri�butes a blighting
influence and potential hazard to the neighborhood, it is the recommendation of this Division
that the City Council pass a resolution ordering the owners, interest�d and/or responsible
parties to either repair or demolish and remove the buildings in a timely manner to the

WHEREAS, the Division of Public Health has requested the �ity Council to hold public
hearings to consider the advisability and necessity of ordering the repair or wrecking and
removal of a Two story, wood frame, condemned, boarded, deteriorated, dilapidated, residential
structure with a deterioraterl, dangerous detached garage which are located on property hereafter
referrecl to as the "Subject Property" commonly known as 965 Marshall Avenue. This Abstract
property is legally described as:
Lot 18, and all of Lot 19 except the East 30 feet thereof, 'Block A, Marshall
Boulevard Addition to the City of St. Paul, according to the recorded plat thereof,
and situate in Ramsey County, Minnesota.
WHEREAS, based upon the records in the Ramsey County Recorder's Office on
November 2, 1990 and oral information��obtained through 7uly 1, 1�991 and other information
available to the Division of Public Health on or before June 28, 1991, the following persons are
owners, interested and/or responsible parties of the Subject Property: Administrator of Veterans
Affairs, Fort Snelling, Room 266 C, St. Paul, MN 55111; Donna Kapaun, 380 Wheelock
Pkwy E. #359, St. Paul, MN 55109; James Green, 965 Marshall Avenue, St. Paul, MN

The addresses of the above noted persons were obtained from various sources including
the Ramsey County tax records, phone books;�mortgage companies, etc.; and
WHEREAS, the Division of Public Health has issued orders i�entifierl as an''Abandoned
Building Notice" with "Dangerous Accessory Structure" dated No'�vember 21, 1990 which is
attached and incorporated as part of this Resolution by this reference. This order was served
in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code on all
owners, interested and/or responsible parties of the Subject Property then known to the
enforcement officer. The notice and order informed these parties that the Two story, wood
frame, condemned, boarded, deteriorated, dilapidated, residentiall structure located on the
subject property is an abandoned building pursuant to Section 45.01, Subd. 1 of the Saint Paul
Legislative Code; the deteriorated, dangerous detached garage located on the Subject Property
is a dangerous structure pursuant to Section 45.01, Subd. 3 of the Saint Paul Legislative Code;
and both buildings are nuisances pursuant to Sections 45.02, Subd. 10 and Subd. 11 of the Saint
Paul Legislative Code. The November 21, 1990 order also ha�d attached to it a list of
deficiencies regarding the structures on the Subject Property, I said list is attacherl and
incorporated as part of this resolution; and

WHEREAS, the November 21, 1990 order informed all then known owners, interested
parties and responsible parties that they must either repair the structures on the Subject Property
by conecting the list of deficiencies or demolish the buildings, eith�r action to take place by
December 21, 1990. '
WHEREAS, on 7anuary 17, 1991, one of the owners of the $ubject Property requested
and was granted an extension until April 17, 1991 to complete the r�habilitation or demolition
of the structure; and
WHEREAS, on April 12, 1991 one of the owners of the Subj�ct Property requested and
was granted an extension until7une 12, 1991 to complete the rehabilitation or demolition of the
structure; and
WHEREAS, no action has been taken regarding compliance w�th the November 21, 1990
notice and order, and the Apri1 12, 1991 and the 7une 12, 1991 extensions, and as a result the
Division of Public Health requested that public hearings be scherluled to take place on
Wednesday, August 7, 1991 before the Neighborhood Services Committee of the Saint Paul City
Council to prepare a recommendation to be reviewed and decided on Tuesday, August 13, 1991
by the Saint Paul City Council in considering the advisability and necessity of ordering the
conection of the nuisance condition through the rehabilitation oz�, in the alternative, the
demolition and removal of this structure; and '
WHEREAS, the above referenced owners, interested and/or responsible parties have been
served notice of the time, place and purpose of the public hearings� before the Neighborh�od
Services Committee of the City of Saint Paul City Council on Wednesday, August 7, 1991 and
the Saint Paul City Council on Tuesday, August 13, 1991 in accordance with the provisians af
Chapter 45 of the Saint Paul Legislative Code; and
WHEREAS, a hearing was held before the Nei hborhood Services Committee of the

Saint Paul City Council on Wednesday, August 7, 1991 and all testimony and evidence was
considered by the committee; and �
WHEREAS, the Neighborhood Services Committee after receiving testimony and
evidence, made the recommendation to approve a request by the D�vision of Public Health to
order the above referenced owners, interested parties and responsibl!e parties and their assigns
to make the Subject Property safe and not detrimental to the public peace, health, safety and
welfare and remove its blighting influence on the community by rehabilitating the structures and
conecting those deficiencies set forth in the list previously referen�ed in accordance with all
applicable codes and ordinances, or in the alternative by demolishing and removing the
structures and filling the site in accordance with aal applicable codes and ordinances. The
rehabilitation or demolition and removal of the structures to be compl�ted within thirty (30) days
of the date of mailing of this resolution; and
WHEREAS, a hearing was held before the Saint Paul City Council on Tuesday, August
13, 1991 and all testimony and evidence including the action ta�cen by the Neighborhood
Services Committee was considered by the Council; and

NOW, THEREFORE, BE IT RESOLVED that based upon all of the testimony and
evidence presented at the Tuesday, August 13, 1991 hearing, the Saint Paul City Council hereby
adopts the following Findings and Order concerning the structures at 965 Marshall Avenue:
1. That since September of 1989 the buildings have been routinely monitored by
Nuisance Buildings Code Enforcement.
2. That the Division of Public Health of the City of Saint Paul condemned this
structure as "Unfit for Human Habitation" according to Chapter 34 of the Saint
Paul Legislative Code in 7une of 1989.
3. That since September of 1989 the City of Saint Paul has on four (4) occasions
issued orders to the owners to rnake these buildings secure and not accessible.
Because of the inaction on the part of the owners, the City has had to hire a
private contractor to make the buildings secure and not open to access.
4. That the owners of the Subject Property have repeatedly failed to register and pay
the vacant building fee for this property as required by City Ordinance.
5. That there are now and have been since September of 1989 multiple exterior
Housing Code or Building Code violations in existence at the Subject Property.
6. That the ownzrs, interested parties and responsible parties of these buildings are
as previously ctated in this resolution. These individuals have been pioperly
served notice of the Wednesday, August 7, 1991 and the Tuesday, August 13,
1S91 hear�ngs concerning these buildings.
7. That on November 21, 1990 an Abandoned Building Notice with Dangerous
Accessery Structure was sent to the owners, interested parties and responsible
parties ordering these persons to either demolish and remove these buildings or
make repairs and cure the list of deficiencies by December 21, 1990.
8. That on 7anuary 17, 1991 the owners were granted an extension until April 17,
1991 to complete the demolition or rehabilitation of the structures.
9. That on April 12, 1991 the owners were granted an extension until 7une 12, 1991
to complete the demolition or rehabilitation of the structures.
10. That the order of November 21, 1990 and tk►e extensions of January 17, 1991 and
April 12, 1991 have been disregarded by the owners, interested parties and
responsible parties.
11. That the two story, wood frame, condemned, boarded, deteriorated, dilapidated,
residential structure located on the Subject Property is an abandoned building
according to Section 45.01, Subd. 1, of the Saint Paul Legislative Code in that it
is "a building or portion thereof which has stood unoccupied for longer than one
(1) year" and during that period of time has been either "unsecured" or "boarded"
or has had "multiple exterior Housing Code or Building Code violations".

12. That the two story, wood frame, condemned, boarded, deteriorated, dilapidated,
residential structure located on the Subject Property is a nuisance as defined
according to Saint Paul Legislative Code Section 45.0�, Subd. 11, in that it is an
abandoned building located in the City of Saint Paul t�lat has created a dangerous
or unhealthy condition or which threatens the public peace, health, safety or
sanitary condition of the City or which is offensive or has a blighting influence
on the community.
13. That the deteriorated, dangerous detached garage locatl d on the Subject Property
is a dangerous structure according to Section 45.01, ,Subd. 3 of the Saint Paul
Legislative Code in that it is "a structure which is potentially dangerous to
persons or property" including being "a structure which has been contaminated
from the storage of hazardous waste material".
14. That the deteriorated, dangerous detached garage locat�d on the Subject Property
is a nuisance as defined according to Saint Paul Legis�ative Code Section 45.02,
Subd. 10, in that it is a dangerous structure located in the City of Saint Paul that
has created a dangerous or unhealthy condition or which threatens the public
peace, health, safety or sanitary condition of the City or which is offensive or has
a blighting influence on the community.
15. That the costs of abatement of these nuisances are estimated to exceed two
thousand dollars ($2,000.00) or the abatement involves demolition of a building
other than a structure accessory to a residential building.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced owners, interested parties and responsible parties and their
assigns shall make the Subject Property safe and no� detrimental to the public
peace, health, safety and welfare and, remove its t�lighting influence on the
community by rehabilitating these buildings and correcting those deficiencies set
forth in the list previously referenced in accordance with all applicable codes and
ordinances, or in the alternative by demolishing and removing the buildings and
filling the site in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of these bu�ldings must be completed
within thirty (30) days of the date of mai�ing of this tesolution.
2. If the above conective action is not completed within the thirty (30) day time
period, the proper City officials of the City of Saint Paul are hereby authorized
to take whatever steps are necessary to demolish and zemove these buildings and
fill the site and charge the costs incurred against the j Subject Property pursuant
to the provisions of Section 45.08 of the Saint Paul Legislative Code.

3. In the event the buildings are to be demolisheri and re�moved by the City of Saint
Paul, all personal property or fixtures of any kind which shall unreasonably
interfere with the demolition and removal shall be removed from the buildings by
the owners, interested parties and/or responsible parties by the end of the thirty
(30) day time period. If the personal property is not so removed, the City of
Saint Paul shall remove and dispose of such property land fixtures as is provided
by law.
4. IT IS FURTHER ORDERED that a certified copy of this resolution and the
incorporated order and list of deficiencies.be mailed to the last known address of
the owners, interested parties and responsible parties ,pursuant to Section 45.1 l,
Subdivision (5). '

The Division of Public Health has determined that the above noted building is
an abandoned building, which Chapter 45 of the Saint Paul LeGislative Code
defines as:
"any building or portion of a building which has stood with an
incomplete exterior shell for longer than three (3) years or any
building or portion thereof which has stood unoccupied for longer than
one (1) year and which meets one or more of the following criteria;
(a) Unsecured, or
(b) boarded, or
(c) having multiple exterior Housing Code or �3uilding Code violations,
or
(d) placarded as "Unfit for Human Habitation"� pursuant to Chapter 34
of the Saint Paul Legislative Code."
The Division of Public Health has also determined that there is a dang�erous
structure in the form of a garage accessory to the above noted building, which
Chapter 45 of the Saint Paul Legislative Code defines as:

including but not limited to:
(a) a structure which is in danger of partial or complete collapse; or
(b) a structure which has any exterior parts such as chimneys, eaves,
porches, siding, railings, or trim which are loose or in danger of
falling; or
(c) a structure which has any parts such a5 porches, stairs, ramps,
rails, balconies, or roofs which are accessible and which are
either collapsed, in danger of collapsing, or unable to support a

The ordinance further states that an abandoned buildil'ng and a dangerous
structure are both nuisances and may be ordered demolished and removed by the
City.
NOTICE: If you do not want to have the City begin action to have the
buildings torn down, then the attached list of defici�ncies must be repaired
or you must tear the buildings down on o r before Decei�ber 21 1990
If you sell, transfer or convey, in any manner, the ownership or
responsibility for this property, you must within seven (7) days of sucYi
action, provide the Division of Public Health with the names and addresses of
any new owners or responsible parties.
You must also notify any new owners or responsible pai�ties of this pending
action by the Division of Public Health.
Any repair or demolition must be completed in accordance will all applicable
laws.
If the rehabilitation work is not completed or if youlhave not demolished and
removed the house and garage by the above date, the Division of Public Health
will refer this matter to the City Council zo receive authorit;� to have the
house and garage demolished and removed. All costs incurred in krecking and
removing the buildings will be charged against the real estate as a special
assessment to be collected in the same manner as taxes, The City Council will
schedule public hearings to consider the necessity and advisability of
ordering the buildings repaired or demolished and remolved. If public hearings
become necessary, you will be notified of the times and dates of the hearings
and you will be allowed to present evidence to the City Council.
A copy of this order will be kept on file in the City Clerk's Office and a
resolution declaring tYiis property to be a nuisance shall be on file in the
Ramsey County Recorder's Office. Compliance with the ttached list of
deficiencies will remove your building f rom the list o� abandoned buildings
but it does not mean that the buildings comply with all applicable housing and
building codes.
The date for compliance with these orders shall not be extended unless you
receive written approval from the Division of Public Health.
If you wish to have the City tear down your house and I
a consent for7n be sent to �arage, you may request
you f rom our off ice to sign and return to us.
However, please be aware that all owners and interested parties must sign the
form before the City can tear the buildings down without a City Council order.
Also be aware that the cost of the demolition, if performed by the City, would
become a special assessment against the property.
