This Abstract ,; property is legally described as: � Lot 18, and all of Lot 19 except the East 30 feet thereof; Block A, Marshall � Boulevard Addition to the City of St. Paul, according to the r�ecorded plat thereof, and situate in Ramsey County, Minnesota. ; WHEREAS, based upon the records in the Ramsey Co'unty Recorder's Office on November 2, 1990 and oral information'obtained through 7uly l, 1991 and other information available to the Division of Public Health on or before 7une 28, 1991, the following persons are owners, interested and/or responsible parties of the Subject Propert�: Administrator of Veterans Affairs, Fort Snelling, Room 266 C, St. Paul, MN 55111; Donna Kapaun, 380 Wheelock Pkwy E. #359, St. Paul, MN 55109; 7ames Green, 965 Marshall Avenue, St. Paul, MN 55104; Minnesota Housing Finance Agency, 400 Sibley Street, S�. Paul, MN 55101; Carole P. Herzog, 926 Hall Avenue, West St. Paul, MN 55118. � The addresses of the above noted persons were obtained from various sources including the Ramsey County ta�c records, phone books; mortgage companies, etc.; and WHEREAS, the Division of Public Health has issued orders identified as an "Abandoned Building Notice" with "Dangerous Accessory Structure" dated November 21, 1990 which is attached and incorporated as part of this Resolution by this refer�,nce. This order was served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code on all owners, interested and/or responsible parties of the Subject P'roperty then known to the enforcement officer. T'he notice and order informed these partiQs that the Two story, wood frame, condemned, boarded, deteriorated, dilapidated, residential structure located on the subject property is an abandoned building pursuant to Section 45.b1, Subd. 1 of the Saint Paul Legislative Code; the deteriorated, dangerous detached garage lo�ated on the Subject Property is a dangerous structure pursuant to Section 45.01, Subd. 3 of the Saint Paul Legislative Code; and both buildings are nuisances gursuant to Sections 45.02, Subd: 10 and Subd. 11 of the Saint Paul Legislative Code. The November 21, 1990 order also had attached to it a list of deficiencies regarding the structures on the Subject Property, said list is attached and incorporated as part of this resolution; and �Ri��l�Al� �,'c�i--t� �L ���; '•J: NOW, THEREFORE, BE IT RESOLVED that based upon all of the testimony and ¢ evidence resented at the Tuesda Au ust 13 1991 hearin the Saint Paul Cit Council hereb �`�"'`�' P Y, g � g� Y Y +�. � adopts the following Findings and Order concerning the structures at 965 Marshall Avenue: � , {.�,a 1. That since September of 1989 the buildings have been routinely monitored by �`'` Nuisance Buildings Code Enforcement. 2. That the Division of Public Health of the City of Saint Paul condemned this structure as "Unfit for Human Habitakion" according to Chapter 34 of the Saint ;�; Paul Legislative Code in June of 1989. `; � 3. That since September of 1989 the City of Saint Paul has on four (4) occasions � issued orders to the owners to make these buildings secure and not accessible. Because of the inaction on the part of the owners, the City has had to hire a private contractor to make the buildings secure and not open to access. 4. That the owners of the Subject Property have repeatedly failed to register and pay - the vacant building fee for this property as required by City Ordinance. 5. That there are now and have been since September of 1989 multiple exterior Housing Code or Building Code violations in existence at the Subject Property. 6. That the owners, interested parties and responsible parties of these buildings are as previously stated in this resolution. These individuals have been properly served notice of the Wednesday, August 7, 1991 and the Tuesday, August 13, 1991 hearings concerning these buildings. 7. That on November 21, 1990 an Abandoned Building Notice with Dangerous Accessory Structure was sent to the owners, interested parties and responsible parties ordering these persons to either demolish and remove these buildings or make repairs and cure the list of deficiencies by December 21, 1990. 8. That on January 17, 1991 the owners were granted an extension until April 17, 1991 to complete the demolition or rehabilitation of the structures. 9. That on April 12, 1991 the owners were granted an extension until June 12, 1991 to complete the demolition or rehabilitation of the structures. 10. That the order of November 21, 1990 and the extensions of January 17, 1991 and April 12, 1991 have been disregarded by the owners, interested parties and responsible parties. 11. That the two story, wood frame, condemned, boardeti, deteriorated, dilapidated, residendal structure located on the Subject Property is an abandoned building according to Section 45.01, Subd. 1, of the Saint Paul Legislative Code in that it is "a building or portion thereof which has stood unoccupied for longer than one (1) year" and during that period of time has been either "unsecured" or "boarded" or has had "multiple exterior Housing Code or Building Code violations". _�_ �RIGfINAl. , �=��--�� ; � .: , � , �� � 12. 1'hat the two story, wood frame, condemned, boarde�l, deteriorated, dilapidated, ;� �. residential structure located on the Subject Propert� is a nuisance as defined :`���:�, according to Saint Paul Legislative Code Section 45.02, Subd. 11, in that it is an �'�� `� abandoned building located in the City of Saint Paul that has created a dangerous : � or unhealthy condition or which threatens the public peace, health, safety or �,`�,� sanitary condition of the City or which is offensive or has a blighting influence on the community. `M� 13. That the deteriorated, dangerous detached garage located on the Subject Property ,�:_;� is a dangerous structure according to Section 45.01, Subd. 3 of the Saint Paul Legislative Code in that it is "a structure which is potentially dangerous to ,`� p ersons or pro p e rt y" includin g bein g "a structure which has been contaminated - from the storage of hazardous waste material". 14. That the deteriorated, dangerous detached garage loca�ted on the Subject Property is a nuisance as defined according to Saint Paul Legi�lative Code Section 45.02, Subd. 10, in that it is a dangerous structure located ir1 the City of Saint Paul that has created a dangerous or unhealthy condition or �vhich threatens the public peace, health, safety or sanitary condition of the City or which is offensive or has a blighting influence on the community. 15. That the costs of abatement of these nuisances are estimated to exceed two thousand dollars ($2,000.00) or the abatement involves demolition of a building other than a structure accessory to a residential building. RDER The Saint Paul City Council hereby makes the following order: 1. The above referenced owners, interested parties and responsible parties and their assigns shall make the Subject Property safe and nqt detrimental to the public peace, health, safety and welfare and, remove its Iblighting influence on the community by rehabilitating these buildings and con ting those deficiencies set forth in the list previously referenced in accordance ith all applicable codes and ordinances, Q in the alternative by demolishing and �removing the buildings and filling the site in accordance with all applicable codes and ordinances. The rehabilitation or demolition and removal of these buildings must be completed within thirty (30) days of the date of mailing of this resolution. 2. That since September of 1989 the City of Saint Paul has on four (4) occasions issued orders to the owners to rnake these buildings secure and not accessible. Because of the inaction on the part of the owners, the City has had to hire a private contractor to make the buildings secure and not open to access. 4. That the owners of the Subject Property have repeatedly failed to register and pay the vacant building fee for this property as required by City Ordinance. 5. That there are now and have been since September of 1989 multiple exterior Housing Code or Building Code violations in existence at the Subject Property. 6. That the ownzrs, interested parties and responsible parties of these buildings are as previously ctated in this resolution. These individuals have been pioperly served notice of the Wednesday, August 7, 1991 and the Tuesday, August 13, 1S91 hear�ngs concerning these buildings. 7. That on November 21, 1990 an Abandoned Building Notice with Dangerous Accessery Structure was sent to the owners, interested parties and responsible parties ordering these persons to either demolish and remove these buildings or make repairs and cure the list of deficiencies by December 21, 1990. 8. That on 7anuary 17, 1991 the owners were granted an extension until April 17, 1991 to complete the demolition or rehabilitation of the structures. 9. That the two story, wood frame, condemned, boarded, deteriorated, dilapidated, residential structure located on the Subject Property is a nuisance as defined according to Saint Paul Legislative Code Section 45.0�, Subd. 11, in that it is an abandoned building located in the City of Saint Paul t�lat has created a dangerous or unhealthy condition or which threatens the public peace, health, safety or sanitary condition of the City or which is offensive or has a blighting influence on the community. 13. That the deteriorated, dangerous detached garage locatl d on the Subject Property is a dangerous structure according to Section 45.01, ,Subd. 3 of the Saint Paul Legislative Code in that it is "a structure which is potentially dangerous to persons or property" including being "a structure which has been contaminated from the storage of hazardous waste material". 14. That the deteriorated, dangerous detached garage locat�d on the Subject Property is a nuisance as defined according to Saint Paul Legis�ative Code Section 45.02, Subd. 10, in that it is a dangerous structure located in the City of Saint Paul that has created a dangerous or unhealthy condition or which threatens the public peace, health, safety or sanitary condition of the City or which is offensive or has a blighting influence on the community. 15. That the costs of abatement of these nuisances are estimated to exceed two thousand dollars ($2,000.00) or the abatement involves demolition of a building other than a structure accessory to a residential building. ORDER The Saint Paul City Council hereby makes the following order: 1. The above referenced owners, interested parties and responsible parties and their assigns shall make the Subject Property safe and no� detrimental to the public peace, health, safety and welfare and, remove its t�lighting influence on the community by rehabilitating these buildings and correcting those deficiencies set forth in the list previously referenced in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the buildings and filling the site in accordance with all applicable codes and ordinances.
