WHEREAS, the Division of Public Health has requested the City Council to hold public . �;,p
hearings to consider the advisability and necessity of ordering the repair or wrecking and removal of ��
a two story, wood frame, condemned, deteriorated, boarded, single family structure located on �`�

WHEREAS, based upon the records in the Ramsey County Recorder's Office on May 20, 1991 g�"y"`'
and other information available to the Division of Public Health on or befbre 7une 28, 1991, the
following persons are owners, interested and/or responsible parties of the Subject Property: 7eanette
R. Johnson, 689 Van Buren Avenue, St. Paui, MN 55104-1661; Brenda Kolodji, 2201 Bryant
Avenue South, Minneapolis, MN 55405; Jacie Tyler, Sr., 686 Blair Ave�ue, St. Paul, MN 55103;
Exchange State Bank, a Minnesota Corporation, 519 Jackson Street, St. Paul, MN 55101;
Murnane, Colin, White, Brandt & Hoffman, 1800 Meritor Tower, St. Paul, MN 55101; Office

The addresses of the above noted persons were obtained from various sources including
the tax records, phone books, mortgage companies, etc.; and
WHEREAS, the Division of Public Health has issued an order'�identified as an
"Abandonerl Building Notice" dated May 20, 1991 which is attached and incorporated as part of this
Resolution by this reference. This order was served in accordance with the provisions of Chapter
45 of the Saint Paul Legislative Code on all owners, interested and/or res�onsible parties of the
Subject Property then known to the enforcement officer. The notice and order informed these
parties that the two story, wood frame, condemned, deteriorated, boarded, single family structure
located on the Subject Property is an abandoned building and a nuisance pursuant to Sections 45.01,
Subd. 1 and 45.02, Subd. 11 of the Saint Paul Legislative Code. The M�y 20, 1991 order also had
attached to it a list of deficiencies regarding the house on the Subject Property, said list is attached
and incorporated as part of this resolution; and
WHEREAS, the May 20, 1991 order informed all then known owners, interested parties
and responsible parties that they must either repair the structure on the Subject Property by
correcting the list of deficiencies or demolish the structure, either action to take place by 7une 20,
1991; and

WHEREAS, no action has been taken regarding compliance with the May 20, 1991
notice and order, and as a result the Division of Public Health requested that public hearings be`
scheduled to take place on Wednesday, August 7, 1991 before the Neighborhood Services x�.' ` :

WHEREAS, a hearing was held before the Neighborhood Services Committee of the :`�' ��

WHEREAS, the Neighborhood Services Committee after receiving testimony and
evidence recommended that the owners, interested and responsible parties and their assigns shall:
a) post a two thousand ($2,000.00) dollar performance band; and
b) obtain a code compliance inspection by 9:00 a.m. on August 13, 1991;
Providing the aforementioned conditions are met, the owners, interested and responsible parties and
their assigns shall cause the rehabilitation of the exterior of this structure and correct those
deficiencies set forth in the list previously referenced in accordance with all applicable codes and
ordinances. The rehabilitation of the exterior of this structure to be completed within sixty (60)
days of the date of the mailing of this resolution. '
WHEREAS, the Neighborhood Services Committee after receiving testimony and
evidence, further recommended that providing the aforementioned conditions are met, the owners,
interested and responsible parties and their assigns shall make the subject property safe and not
detrimental to the public peace, health, safety and welfare and remove it$ blighting influence on the
community by rehabilitadng the remainder of this structure and conecting those deficiencies set
forth in the list previously referenced in accordance with all applicable codes and ordinances, or in
the alternative by demolishing and removing the structure and filling the site in accordance with all
applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed
within one hundred eighty (180) days of the date of the mailing of this resolution; and
WHEREAS, the Neighborhood Services Committee after receiving tesdmony and
evidence, recommended that if the aforementioned conditions were not met, their recommendation is
to approve the request by the Division of Public Health to order the above referenced owners,
interested parties and responsible parties and their assigns to make the Subject Property safe and not
detrimental to the public peace, health, safety and welfare and remove it� blighting influence on the

WHEREAS, a hearing was held before the Saint Paul City Council on Tuesday, August `E
20, 1991 and all testimony and evidence including the action taken by Neighborhood Services
Committee was considered by the Council; and ;
NOW THEREFORE, BE IT RESOLVED, that based upon alll of the testimony and
evidence presented at the Tuesday, August 20 1991 hearing, the Saint Pai�l City Council hereby
adopts the following Findings and Order concerning the house at 549 Edrilund Avenue:
1. That since June of 1989 the building has been routinely monitored by Nuisance
Buildings Code Enforcement.
2. That since June of 1989 the City of Saint Paul has on two (2) occasions issued
orders to the then known owners to make this house secure and not accessible.
Because of the inaction on the part of the owners, the City has had to hire a
private contractor to make the house secure.
3. That the owners of the Subject Property have repeatedly failed to register and pay
the vacant building fee for this structure as required by,Chapter 43 of the Saint
Paul Legislative Code. �,
4. That there are now and have been since 7une of 1989 ultiple exterior Housing
Code or Building Code violations in e�stence at the S ject Property.
5. That the Division of Public Health of the City of Saint !�aul condemned this
structure as "Unfit for Human Habitation" under Chapter 34 of the Saint Paul
Legislative Code in October of 1988. The building is still subject to this
condemnation order.
6. That the owners, interested parties and responsible parties of this house are as
previously stated in this resoludon. These individuals have been properly served
notice of the Wednesday, August 7, 1991 and the Tuesday, August 13, 1991
hearings concerning this house.

owners, interested parties and responsible parties ordering these persons to either
demolish and remove the house or make repairs and cu2e the list of deficiencies .,.,,,

8. That the order of May 20, 1991 has been disregarded by the then known owners,�� ,�-��� ;

9. That the two story, wood frame, condemned, deteriorated, boarded, single family
structure located on the Subject Property is an abandoned building according to �- . ;�
Section 45.01, Subd. 1, of the Saint Paul Legislative Code in that it is "a building "� ��
or portion thereof which has stood unoccupied for longer than one (1) year" and �`�
during that period of time it has been either "unsecured", "boarded", or has had ;ti:x

"multiple exterior Housing Code or Building Code violations" or has been . �:�
placarded as "Unfit for Human Habitation" pursuant to Chapter 34 of the St. Paul �
Legislative Code.
10. That the two story, wood frame, condemned, deteriora�ed, boarded, single family
structure located on the Subject Property is a nuisance �s mcluded under Saint
Paul Legislative Code Section 45.02, Subd. 11, in that �it is an abandoned building
located in the City of Saint Paul that has created a dangerous or unhealthy
condition or which threatens the public peace, health, safety or sanitary condition
of the City or which is offensive or has a blighting influence on the community.
11. That the costs of abatement of this nuisance are estimated to exceed two thousand
dollars ($2,000.00) or the abatement involves demolition of a building other than a
structure accessory to a residential building.
12. That the owners, interested parties and responsible parties and their assigns have
posted a two thousand dollar ($2,000.00) performance bond.
13. That the owners, interested parties and responsible parties and their assigns have
obtained a code compliance inspection.
ORDER
The Saint Paul City Council hereby makes the following order':
1. The above referenced owners, interested parties and responsible parties and their
assigns shall rehabilitate the exterior of this structure and conect those
deficiencies set forth in the list previously referenced in accordance with all
applicable codes and ordinances. The rehabilitation of the exterior of the structure
must be completed within sixty (60) days of the date of mailing of this resolution.

2. The above referenced owners, interested parties and responsible parties and their
assigns shall make the remainder of the Subject Property safe and not detrimental
to the public peace, health, safety and welfare and remove its blighting influence
on the community by rehabilitating this structure and conecting those deficiencies 3 h�

3. If the above corrective actions are not completed within the sixty (60) or one 2��
hundred eighty (180) day time periods, as outlined above, the proper City officials ��
of the City of Saint Paul are hereby authorizerl to talce whatever steps are ,�;_:... �
necessary to demolish and remove this structure and fill the site and charge the �"`' =
costs incuned against the Subject Property pursuant to the provisions of Section �t 4�� `
45.08 of the Saint Paul Legislative Code. `�� fi�_�_

4. In the event the building is to be demolished and removed by the City of Saint ��:
Paul, all personal property or fixtures of any kind which shall unreasonably -�
in�erfere with the demolition arid removal shall be removed from the building by
the owners, interested parties and/or responsible parties by the end of the sixty '`�
(60) or one hundred eighty (180) day time periods. If the personal property is not
so removed, the City of Saint Paul shall remove and dispose of such property and
'� fixtures as is provided by l�w.
5. IT IS FURTHER ORDERED, that a certified copy of this resolution and the
incorporated Order and list of deficiencies be mailed to the last known address of
the owners, interested parties and responsible parties pursuant to Section 45.11,
Subdivision (5) of the Saint Paul Legislative Code.

Office. Compliance with the attached list of deficiencies will remove your building from the
list of abandoned buildings but it does not mean that the building cbmplies will all applicable
Housing and Building Codes.
The date for compliance with these orders shall not be extended un}ess you receive written
approval from the Division of Public Health. . '
If you wish to have the City demolish and remove your building, you may do so by
requesting a consent form be sent to you from our office, to sign a�hd return to the Division
of Public Health. However, please be aware that all owners and interested parties must sign
a Consent to Raze form before the City can demolish and remove the building without a City

Dear Property Owner:
The Division of Public Health, Section of Housing Code Enforcement
of the City of Saint Paul, Minnesota, has found that the dwelling
and premises at 549 Edmund Avenue is "Unfit �or Human Habitation"
due to the want of repairs, and/or defects in the drainage,
plumbing, lighting or construction of said dwelling and premises,
and/or for cther causes affecting public health.
If you are unable to finance the correction or rehabilitation of
the premises to com�ly with tris order, there are State and Local
rehabilitation programs for which you may qualify. As stated, for
appeals information call 292-7775 .
Al1 repairs and new installations must be made in accordance with
the appropriate codes . Permits must be obtained where changes
and/or additions to an electrical system re ire upgrading of the
service size to present National Electrical C�de requirement. Some
plumbing repairs may necessitate updating of the fixtures and/or
piping involved. A permit is required for any repair or new
installation. Permits may be obtained from tY�e Building Inspection
and Design Division, Room 445 , City Hall . '

On May 20, 1991 the Division of Public Health mailed an order to the then known owners,
interested parties and responsible parties of this building requiring tl�at the building be either
repaired, by correcting the attached list of deficiencies, or demolishdd on or before June 20,
1991.
Inasmuch as the order has not been completed to the satisfaction of this Division and the
continued abandoned condition of the building contributes a blighting influence and potential
hazard to the neighborhood, it is the recommendation of this Divisio$� that the City Council
pass a resolution ordering the owners, interested and/or responsible �arties to either repair or
demolish and remove the building in a timely manner to the satisfaction of the City.
In the event the owners, interested and/or responsible parties fail to comply with the Council
Resolution, the Division of Public Health should be authorized to demolish and remove the
building and assess all costs incurred in the demolition and removal �gainst the real estate as
a special assessment to be collected in the same manner as talces.
This matter will have a Public Hearing before the Neighborhood Services Committee as well
as the full City Council.

The addresses of the above noted persons were obtained from various sources _

WHEREAS, the Division of Public Health has issued an order identified as an
"Abandoned Building Notice" dated May 20, 1991 which is attached and incorporated as part
of this Resolution by this reference. This order was served in accordance with the provisions
of Chapter 45 of the Saint Paul Legislative Code on all owners, inte�rested and/or responsible
parties of the Subject Property then lrnown to the enforcement offic�r. The notice and order
informed these parties that the two story, wood frame, condemned, deteriorated, boarded,
single family structure located on the Subject Property is an abando�ed building and a
nuisance pursuant to Sections 45.01, Subd. 1 and 45.02, Subd. 11 of the Saint Paul
Legislative Code. The May 20, 1991 order also had attached to it a list of deficiencies
regarding the house on the Subject Property, said list is attached and incorporated as part of
this resolution; and

. WHEREAS, the May 20, 1991 order informed ail then known owners, interested
parties and responsible parties that they must either repair the struc�ure on the Subject
Property by correcting the list of deficiencies or demolish the structure, either action to take
place by June 20, 1991; and
WHEREAS, no action has been taken regarding compliance!with the May 20, 1991
notice and order, and as a result the Division of Public Health requested that public hearings
be scheduled to take place on Wednesday, August 7, 1991 before the Neighborhood Services
Committee of the Saint Paul City Council to prepare a recommenda�tion to be reviewed and
decided on Tuesday, August 13, 1991 by the Saint Paul City Counc�il in considering the
advisability and necessity of ordering the conection of the nuisance condition through ttie
rehabilitation or, in the alternative, the demolition and removal of this structure; and
WI�REAS, the above referenced owners, interested and/or responsible parties have
been served notice of the time, place and purpose of the public hearings before the
Neighborhood Services Committee of the City of Saint Paul City Cbuncil on Wednesday,
August 7, 1991 and the Saint Paul City Council on Tuesday, August 13, 1991 in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code; and �
WI3EREAS, a hearing was held before the Neighborhood Services Committee of the
Saint Paul City Council on Werinesday, August 7, 1991 and all testimony and evidence was
considered by the committee; and
WHEREAS, the Neighborhood Services Committee after receiving testimony and
evidence, made the recommendation to approve a request by the Division of Public Health to
order the above referenced owners, interested parties and responsibl� parties and their assigns
to make the Subject Property safe and not detrimental to the public peace, health, safety and
welfare and remove its blighting influence on the community by rehabilitating this structure
and correcting those deficiencies set forth in the list previously referenced in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure and filling the site in accordance with all applicable codes and ordinances. The
rehabilitation or demolition of the structure to be completed within thirty (30) days of the
date of mailing of this resolution; and ,
- - - VVHEREAS, a hearing was held before the Saint Paul City Council on 'I�esday,
August 13, 1991 and all testimony and evidence including the action taken by the
Neighborhood Services Committee was considered by the Council; and
NOW THEREFORE, BE IT RFSOLVED, that based upon all of the testimony and
evidence presented at the Tuesday, August 13, 1991 hearing, the Sa.iint Paul City Council
hereby adopts the following Findings and Order concerning the house at 549 Edmund
Avenue: �
1. That since June of 1989 the building has been routinel'�y monitored by Nuisance
Buildings Code Enforcement.
2. That since June of 1989 the City of Saint Paul has on i,two (2) occasions issued
orders to the then known owners to make this house secure and not accessible.
Because of the inaction on the part of the owners, the City has had to hire a
private contractor to make the house secure.

3. That the owners of the Subject Property have repeatedly failed to register and
pay the vacant building fee for this structure as required by Chapter 43 of the
, Saint Paul Legislative Code.

4. That there are now and have been since 7une of 198�� multiple exterior
Housing Code or Building Code violations in existenre at the Subject Property.
5. lfiat the Division of Public Health of the City of Saint Paul condemnerl this
structure as "Unfit for Human Habitation" under Chapter 34 of the Saint Paul
Legislative Code in October of 1988. The building is still subject to this
condemnation order.
6. That the owners, interested parties and responsible parties of this house aze as
previously stated in this resolution. These individuals have been properly
served notice of the Wednesday, August 7, 1991 and the Tuesday, August 13,
1991 hearings concerning this house.
7. That on May 20, 1991 an Abandoned Building Notice was sent to the then
lrnown owners, interested parties and responsible part�es ordering these
persons to either demolish and remove the house or �ake repairs and cure the
list of deficiencies by June 20, 1991. I
8. That the order of May 20, 1991 has been disregarded' by the then known
owners, interested parties and responsible parties.
9. That the two story, wood frame, condemned, deteriorated, boarded, single
family structure located on the Subject Property is an abandoned building
according to Section 45.01, Subd. 1, of the Saint Paul I.egislative Code in that
it is "a building or portion thereof which has stood unoccupied for longer than
one (1) year" and during that period of time it has been either "unsecured",
"boarded", or has had "multiple exterior Housing Code or Building Code
violations" or has been placarded as "Unfit for Human Habitation" pursuant to
Chapter 34 of the St. Paul Legislative Code.
10. lfiat the two-story, wood frame, condemned,-deteriorated, boarded, single - ---- -- -
family structure located on the Subject Property is a nuisance as included
under Saint Paul Legislative Code Section 45.02, Subid. 11, in that it is an
abandoned building located in the City of Saint Paul t�hat has created a
dangerous or unhealthy condition or which threatens t'Ihe public peace, health,
safety or sanitary condition of the City or which is of�ensive or has a blighting
influence on the community.
11. That the costs of abatement of this nuisance are estimated to exceed two
thousand dollars ($2,000.00) or the abatement involves demolition of a
building other than a structure accessory to a residential building.

,The Saint Paul City Council hereby makes the following order:
L The above referenced owners, interested parties and responsible parties and
their assigns shall make the Subject Property safe ar�d not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on
the community by rehabilitating this structure and correcting those deficiencies
set forth in the list previously referenced in accordance with all applicable
codes and ordinances, � in the alternative by demolishing and removing the -
structure and filling the site in accordance with all applicable codes and �
ordinances. The rehabilitation or demolition and reijnoval of the structure must
be completed-within thirty (30) days of the date of mailing of this resolution.
2. If the above corrective acdon is not completed within the thirty (30) day dme
period, the proper City officials of the City of Saint Paul are hereby authorized
to take whatever steps are necessary to demolish an� remove this structure and
fill the site and charge the costs incuned against the'Subject Property pursuant
to the provisions of Section 45.08 of the Saint Paul Legislative Code.
3. � In the event the building is to be demolished and removed by the City of Saint
� Paul, all personal property or fixtures of any kind which shall unreasonably
interfere with the demolition and removal shall be r�moved from the building
by th.e owners, interested:parties and/or responsible parties by the end of the
thirty (30) day time period. If the personal property is not so removed, the
City of Saint Paul shall remove and dispose of such property and fixtures as is
provided by law.
4. IT IS FURTHER ORDERED, that a certified copy ¢f this resolution and the
incorporated Order and list of deficiencies be mailed' to the last known address
� of the owners, interested parties and responsible parties pursuant to Section
45.11, Subdivision (5) of the Saint Paul Legislative Code.

Economic Development, Rehabilitation Section at (612) 228-3105. Ask to speak to a loan
officer.
If you sell, transfer or convey, in any manner, the ownership or responsibility for this
property, you must�within seven ('n days of such action, provide-the Division of Public
Health with the names and addresses of any new owners or responsible parties.
You must also notify any new owners or responsible parties o� this pending action by
the Division of Public Health.
Any repair or demolition must be completed in accordance will all applicable laws.
If the rehabilitation work is not completed or if you have not demolished and removed the
building by the above date, the Division of Public Health will refer this matter to the City
Council to receive authority to have the building demolished and removed. All costs

Dear Property Owner:
The Division of Public Health, Section of Housing Code Enforcement
of the City of Saint Paul, Minnesota, has found that the dwelling
and premises at 549 Edmund Avenue is "Unfit for Human Habitation"
due to the want of repairs, and/or defe!cts in the drainage,
plumbing, lighting or construction of said dwelling and premises,
and/or for other causes affecting public health.
