WHEREAS, the Division of Public Health of the Department of Community Services of the City
of Saint Paul has determined that each of the structure's identified in this Resolution constitute
a "nuisance" in accordance with Chapter 45 of the Saint Paul Legislative Code; and
WHEREAS, the known owners, interested parties and responsible parties have been served, in
the manner set forth in the Ordinance, with an Order to either repair each of the structures or
have them demolished; and
WHEREAS, the public is required to be put on notice of the pending action by the Division of
Public Health; now, therefore, be it �
RESOLVED, the Council of the City of Saint Paul hereby directs the Division of Public Health
to file with the City Clerk, a copy of the Orders it has issued regarding the following described
structures and properties, which have been determined to constitute a nuisance:

Each of these buildinga are "nuisances" pursuan���to3�the provieions of Chapter 45 of the
Saint Paul Legislative Code. The owners and known interested and responsible parties have
been given an order to repair or tear down these buildings; failure by the owners,
interested or responsible parties, to comply with the orders may necessitate action by the
City to bring the properties to the attention of the City Co!uncil. The City will request
the City Council to pass a reaolution requiring the owners, interested and responsible
parties to repair or wreck the buildings and, if the work is not completed, City staff
will be authorized to abate the nuisance by cauaing the wrecking of the structures.
ADVANTAGES IF APPROVED:
The public will be placed on notice that the City has issued orders requiring the owners
and known interested parties to repair or tear down these buildings. This notice is
requi�ed to be filed with the Ramsey County Recorder's Office, in accordance with Chapter
45.11 (Subd. 2) of the Saint Paul Legislative Code.

The Division of Public Health has deternuned that the above noted building is an abandoned
building, which Chapter 45 of the Saint Paul Legislative Code defines as:
"any building or portion of a building which has stood with an incomplete exterior
shell for longer than three (3) years or any building or portion thereof which has
stood unoccupied for longer than one (1) year and which meets one or more of the
following criteria;
(a) unsecured, or _ - _ _ _ _
(b) boazded, or
(c) having multiple exterior Housing Code or Building Code violations, or
(d) placarded as "Unfit for Human Habitation" pursuant to Chapter 34 of the Saint
Paul Legislative Code."
The ordinance further states that an abandoned building is a nuisance and it may be ordered
to be demolished and removed by the City.
NOTICE: If you do not want to have the City begin action to have the building
demolished and removed, then the attached list of deficiencies must be repaired or you
must demolish and remove the building on or before August 15. 1991.

If you are unable to finance the correction or rehabilitation of the premises to comply with
this order, there are state and local rehabilitation programs for which you may qualify.
Information about these programs is available from the Department of Planning and
Economic Development, Rehabilitation Section at (612) 228-3105. Ask to speak to a loan
officer.
If you sell, transfer or convey, in any manner, the ownership or responsibility for this
property, you must within seven (� days of such action, provide the Division of Public
Health with the names and addresses of any new owners or responsible parties.
You must also notify any new owners or responsible parties of this pending action by
the Division of Public Health.
Any repair or demolition must be completed in accordance will all applicable laws.

If the rehabilitation work is not completed or if you have not demolished and removed the
building by the above date, the Division of Public Health will refer this matter to the City
Council to receive authority to have the building demolished and removzd. All costs
incurred in wrecldng and removing the building will be charged against the real estate as a
special assessment to be collected in the same manner as taxes. The City Council will
schedule public hearings to consider the necessity and advisability of ordering the building
repaired or demolished and removed. If public hearings become necessary, you will be
notified of the times and dates of the hearings and you will be allowed to present evidence to
the City Council.
A copy of this order will be kept on file in the City Clerk's Office and a Resolution
declaring this property to be a nuisance shall be on file in the Ramsey County Recorder's
Office. Compliance �vith the attached list of deficiencies will remove your building from the
list of abandoned buildings but it does not mean that the building complies will all applicable
Housing and Building Codes.
The date for compliance with these orders shall not be extended unless you receive written
approval from the Division of Public Health. .
If you wish to have the City demolish and remove your building, you may do so by
requesting a consent form be sent to you from our office, to sign and return to the Division
of Public �iealth. However, please be aware that all owners and interested parties must sign
a Consent to Raze form before the City can demolish and remove the building without a City
Council order. Also be aware that the cost of the demolition, if performed by the City,
would become a special assessment against the property.

upgrading of the service size to current National Electrical Code (N.E.C.) requirements.

or roofs which are accessible and which are either collapserl, in danger of
collapsing, or unable to support a person."
The ordinance further states that an abandoned building and a dangerous structure are both
nuisances and may be ordered demolished and removed by the City.

7. The foundation wall in the southeast corner is cracked and defective.
8. There are trees growing up against the sides of the house.

9. The facia boards are missing and some boards have dry rot.
10. There is defective siding.
11. The windows and doors are boarded.

13. The wood siding in contact with ground has dry rot.
14. Chimney is missing bricks and mortar.
15. The brick chimney is defective and missing bricks at the top of the stack.
Interior
16. The common hallway walls and ceiling is soiled.
17. The existing surface on the common hallway steps has loose material and is
hazardous.
First Floor
18. There is an accumulation of rubbish and debris scattered about.
19. There are broken and missing windows.
20. The west side door is ripped off the inside wall
21. The center of the floor area is buckling and sagging due to improper supporting in tr.e
basement area.
22. The walls and ceilings throughout are soiled.
23. The kitchen floor area is heavily soiled and defective.
Second Floor
24. The hallway window is missing glass.
25. The walls and ceilings need cleaning.
26. The floor area carpeting is soiled throughout.
General
27. The electrical service throughout is not adequate for this building
28. Lack of basic facility - water, gas and electric.

The Division of Public Health has determined that the above noted building is an abandoned
building, which Chapter 45 of the Saint Paul Legislative Code defines as:
"any building or portion of a building which has stood with an incomplete exterior
shell for longer than three (3) years or any building or portion thereof which has
stood unoccupied for longer than one (1) year and which meets one or more of the
following criteria;
(a) Unsecured, or
(b) boarded, or - _ _ _ _
(c) having multiple exterior Housing Code or Building Code violations, or
(d) placarded as "Unfit for Human Habitation" pursuant to Chapter 34 of the Saint
Paul Legislative Code."
The Division of Public Health has also determined that there is a dangerous structure in the
form of a deteriorated, dilapidated detached garage accessory to the above noted building,
which Chapter 45 of the Saint Paul Legislative Code defines as:
"any structure which is potentially dangerous to persons or property including but not
limited to:

(a) a structure which is in danger of partial or com�lete collapse; or
(b) a structure which has any exterior parts such as chimneys, eaves, porches,
siding, railings, or trim which aze loose or in danger of falling; or
(c) a structure which has any parts such as porches, stairs, ramps, rails, balconies,
or roofs which are accessible and which are either collapsed, in danger of
collapsing, or unable to support a person."
The ordinance further states that an abandoned building and a dangerous structure are both
nuisances and may be ordered demolished and removed by the City.
NOTICE: If you do not want to have the City begin action to have the buildings torn
down, then the attached list of deficiencies must be repaired or you must demolish and
remove the buildings on or before August 15. 1991.
If you are unable to finance the correction or rehabilitation of the premises to comply with
this order, there are state and local rehabilitation programs for which you may qualify.
Information about these programs is available from the Department of Planning and
Economic Development, Rehabilitation Section at (612) 228-3105. Ask to speak to a loan
officer.
If you sell, transfer or convey, in any manner, the ownership or responsibility for this
property, you must within seven ('n days of such action, provide the Division of Public
Health with the names and addresses of any new owners or responsible parties.
You must also notify any new owners or responsible parties of this pending action by
the Division of Public Health.
Any repair or demolition must be completed in accordance will all applicable laws.
If the rehabilitation work is not completed or if you have not demolished and removed the
house and the garage by the above date, the Division of Public Health will refer this matter
to the City Council to receive authority to have the house and the garage demolished and
removed. All costs incurred in wrecldng and removing the buildings will be charged against

A copy of this order will be kept on file in the City Clerk's Office and a resolution declaring
this property to be a nuisance shall be on file in the Ramsey County Recorder's Office.
Compliance with the attached list of deficiencies will remove your building from the list of
abandoned buildings but it does not mean that the buildings comply with all applicable
housing and building codes.
The date for compliance with these orders shall not be extended unless you receive written
approval from the Division of Public Health.
If you wish to have the City demolish and remove your house and the garage, you may do so
by requesting a consent form be sent to you from our office to sign and return to the
Division of Public Health. However, please be aware that all owners and interested parties

upgrading of the service size to current National Electrical Code (N.E.C.) requirements.
Some plumbing repairs may necessitate updating of the fixtures and/or piping involved. A
pernut is required for any repair or new installation. Permits may be obtained from the
Building Inspection and Design Division, Room 445, City Hall.
REMEDIAL ACTION
The below list of deficiencies is not necessarily all the deficiencies present in the above
referenced property. As fust remedial action, a Code Compliance Inspection must be
obtained from the Building Inspection and Design Division, Room 445, City Hall,
identifying all necessary repaus.
1. The front porch area has rotted wood floors and ceilings. The support beams are
deteriorated, the block holding the support beams aze also deteriorated and crumbling.
2. The entire roof is deterioraterl with missing shingles and appears to have more than
two layers of shingles. The roof area shows signs of sagging and weakening causing
structural damage inside.
3. The wood trim around windows, doors, fascia, soffit and eaves is rotted and
deteriorated.
4. There is cracked and missing siding throughout.

6. The second story has open, missing and broken windows.
7. There are several boarded windows on the first floor and also the front door is
boarded.
8. The brick chimneys are deteriorated with missing bricks and mortar.
9. The concrete steps off the back of the house are crumbling and deteriorated.
10. The foundation wall on the back side is deteriorated with missing mortar.

provisions of Section 34 . 19 as amended, Subsection 5, of the

34 . 19 , Subsection 5, entitled, "Vacation of Condemned and Placarded

NOTICE OF CONDEMNATION
AS UNFIT FOR HUMAN HABITATION

Dear Property Owners:
The Division of Public Health, Section of Housing Code Enforcement
of the City of Saint Paul, Minnesota, has found that the dwelling
and premises at 634 James Avenue is "Unfit for Human Habitation"
due to the want of repairs, and/or defects in the drainage,
plumbing, lighting or construction of said dwelling and premises,
and/or for other causes affecting public health.
If you are unable to finance the correction or rehabilitation of
the premises to comply with this order, there are State and Local
rehabilitation programs for which you may qualify. As stated, for
appeals/hearing information ca11 292-7775.
All repairs and new installations must be made in accordance with
the appropriate codes. Permits must be obtained where changes
and/or additions to an electrical system require upgrading of the
service size to present National Electrical Code requirement. Some
_ plumbing� repairs _may necessitate updating of the fixtures and/or
piping involved. A permit is required for any repair or new
installation. Permits may be obtained from the Building Inspection
and Design Division, Room 445, City Hall .
The following repairs and/or improvement are required before this
dwelling may be reoccupied:
1 . The electrical service is outdated, overfused, inadequate and
improperly installed with unlawful additions and connections,
over use of extension cords and is in a complete state of
disrepair and � is hazardous to the occupants. Rewire in
accordance with the National Electrical Code. An electrical
permit is required.
2 . The plumbing system is defective. Both water lines and drain,
waste and vent piping is leaking, open, and improperly
installed. Repair all defects and reinstall in accordance
with th�e Uniform Plumbing Code. A permit is requi'�.ed.

3 . Generally the walls and ceilings are defective, have broken
and missing plaster and incomplete wall board, are water
damaged or missing. Repair and refinish in a workmanlike
manner in accordance with acceptable trade practices .
4 . Generally the doors do not operate properly, lack proper
hardware, have broken hardware and are defective. Repair/ �
replace. Provide proper door hardware and locks and latches.
5 . Generally the windows are defective, have broken glass, loose
window sashes, mis�sing glass, defective screens and missing
hold open hardware and effective window locks . Repair.

6 . The front porch is improperly constructed, shows signs of' + �
sagging, improper support, and structural deterioration. '
Repair to a sound condition. �

7 . Provide operable smoke detectors in accordance with the :
Uniform Fire Code without delay.
The dwelling must be ��acate� by March 30, 1990 .

improvements and/or repairs are required to bring this/these
dwelling unit (s) into compliance with the Housing Code:
1. Generally _ the floors and floor coverings are deteriorated,
incomplete, buckled and defective. Repair to a sound
condition and provide easily cleanable floor coverings.
2 . The exterior siding has holes, defects, is missing and
incomplete. Reside, repair. .
3 . The exterior woodwork, trim, soffits, eaves , fascia is
� defective, open, deteriorated. Repair. Replace all rotted
wood, close all openings and repaint.

4 . Remove the inoperable automobiles from the yard. Remove all
refuse. Remove all the junk: tires, old tubs, toilets, etc.
and provide proper garbage cans nd weekly removal service.
