The Director denied the req�}est because ';�ie property was not in compliance with of sectidn 71. 06 of ''';��e Legislative Code (no public sewer, water or improWed street) , ���d that the development moratorium enacted by the �ity Council w`as still in effect. � Mr. Anderson a ealed this decision to the Cit Council i�� � PP Y � the manner provided in section 71. 06 of the Code, 'and the Council,�t, following a hearing, indicated that it would allo� the issuance of a house number. Our office was requested to prepare the resolution ` � which would over-rule the decision of the Direct�or of the Public Works Department. ' I have prepared the resolution requested by �you for the City Council, but wish to advise you and the Council th�t the moratorium will not permit the issuance of building permits. The moratorium does not address specifically the granting of �odifications for issuance of house numbers and therefor may be gr�nted but it does prohibit issuance of building permits. � Therefore, even though the Public Works Dire�tor were to issue an official house number, Mr. Anderson couldl not obtain the necessary permits for building until either the �ompletion of the study and adoption of amendments to the Compr�,hensive Plan and Zoning Code or the expiration of the moratorium, � whichever should occur first. I understand that the studies are now complieted and that the Council will receive the recommended amendments !from the Planning Commission. I am also advised that the amendmer�ts may be enacted . , . : . . . ; �j►/-�.5�° � by the Council within the next two months, and Mr. Anderson may apply for building permits when that happens. � Please advise if you or the Council should have any questions. However, I have been waiting for three }tears for polic�*�, s,� changes and when changes were made we were left out. The�efore, I am leftnw*�`, with the one system septic which is in the area now. I, �along with severayl homes on McKnight Road have no access to city sewer syste�s. When talking with Tom Eggums department, it seems there a�e no plans for sewer in the near future. Also there is no access or out�.et at the end of '��� . Mailand Road. Boys Totem Town is to the west, Highwood R�c Center ball fields � , ;,. � are to the north and private property to the south. Also I have si natures of all home owners on Mailand Roa� who are o osed , 8 � PP to the city sewers. With the over sized lots in the neig�borhood there have been no problems with drain fields. This system has beeln here for over 30 years. These are some of my reasons I should be granted a waiver. We can be more specific about other problems if they arise.
