WHEREAS, the sanitary sewer known as the Beltline Interceptor is owned and maintained by the
Metropolitan Council (fka Metropolitan Waste Control Commission), and;
WHEREAS, portions of said sewer exist on City of Saint Paul right-of-way and on other properry in
which the City has an interest, as described in the attached Exhibit "A," attached hereto and incorporated
herein by reference,and;
s WHEREAS, in order for the Metropolitan Council to properly maintain these portions of the Beltline
9 Interceptor, it is necessary for the City of Saint Paul to convey to the Metropolitan Council those
io property interests owned by the City of Saint Paul as described in the attached E�ibit "A' ;

iz THEREFORE BE IT RESOLVED, that the Council of the City of Saint Paul hereby approves the
is transfer of those property interests described in the attached E�ibit "A," and that the proper City
ia o�cials are hereby authorized and directed to convey said property by Quit Claim Deeds to the
is Metropolitan Council, subject to the following condition:

is conveying said property interests, agrees to indemnify, defend and save harmless the City of
i9 Saint Paul, its officers and employees, from ail suits, actions or claims of any chazacter brought
zo as a result of injuries or damages received or sustained by any person, persons, or property on
zi account of the existence of said property rights or the Metropolitan Council's use of these
zz property rights, including, but not limited to, a claim brought because of any act of omission,
zs neglect, or misconduct of said petitioner or because of any claims of liability arising from any

Metropolitan Council (fka Metropolitan Waste Control Commission), and;
WHEREAS, portions of said sewer exist on City of Saint Paul right-of-way and on other properry in
which the City has an interest, as described in the attached Exhibit "A," attached hereto and incorporated
herein by reference,and;
s WHEREAS, in order for the Metropolitan Council to properly maintain these portions of the Beltline
9 Interceptor, it is necessary for the City of Saint Paul to convey to the Metropolitan Council those
