The City has prepared the necess ry plan and shall perform the engineering and inspection required to complete the items of work hereinafter set forth. Such work as described immediately above shall constitute "Engineering and Inspection" and shall be so referred to hereinafter. 2 . The cost of all labor, materials, and equipmen� x ,. � ,,ti-'��;. The City with their own forces and equipment shall perform the traffic control signal work provided for under State Project No. 6217-34 with the Construction Cost shared as follow: a. Assistant District Engineer at Oakdale or his d ly authorized representative for this purpose and shall be si ned each day by authorized personnel of both parties. Payment or labor, materials and equipment hours shall be based on', these records. All actual and related indirect costs of the City shall be accumulated in accordance with its established accounting procedures. 7. The City Force Account Work provided for herein shall be under the direction and supervision oflthe City. It is agreed, however, that the State shall have the right to periodically inspect said work. 8. The invoice and s ,pporting records are subject to audit by the State's representative at its direction. ' 9. The City shall maintain all book , documents, papers, accounting records and other evidence pertaining�to costs �; { ,-:, incurred in connection with the City Force Account Work perfoXmed hereunder for a period of not less that 3 years after receipt of payment. The City shall make such materials av ilable at its office at all reasonable times during this agreement, for inspection by the State (as provided by Minneso a Statute, Section 16.095) , and copies thereof shall be fu nished upon request. 10. Upon completion of the City Forc�e Account Work provided for in Paragraph 4 hereof to the satisfaction of the State's Assistant District Engineer at Oakdale 'or his authorized representative, the State shall pay to the City the State's share of the actual Construction Cost plus 6 percent of such share for the State�s share of the cost of Engineering a d Inspection (only at the intersection of Trunk Highway No. 52 (Robert Street at ; �� r: �-: 67759 � v - 5 - `X y�E �y �/-/�/�- , Fillmore Avenue) ) incurred by the City in prose ution of said work. The City shall pay any remaining costs. 11. The amount to be encumbered for ayment to the City from Trunk Highway funds for work performe under this Agreement is $6,724.00. In the event that at a y time it appears that such reimbursement will exceed said sum, thle City shall promptly notify the State�s Assistant District �ngineer at Oakdale or his duly authorized representative in writing of the reason for the increase in cost and the amount af additional funds necessary to complete the project. If approved by the State's Assistant District Engineer at Oakdale, ',or his duly � authorized representative, additional funds sha 1 be encumbered by the State and notice given to the City by th State�s Assistant District Engineer at Oakdale or his d ly authorized representative of such additional encumbrance w' ll permit the '� City to complete this project. 12 .
