WI�IEREAS, the Zoning Committee of the Saint Paul Pianning Commission conducted a
public hearing on Apri12, 1998, after having provided notice to affected property owners and
submitted its recommendation to the Planning Commission. The Commission, by its resolution
No. 98-25 adopted April 10, 1998, deternvned to grant the application based upon the foilowing
findings and conclusions:
1. The applicant has a purchase agreement for the property proposed for
development. Ten dwelling units aze proposed, 5 buildings of two units each.
Access to the parcel is proposed from Lexina on Parkway via private street
connecting with an existing a11ey which ea�its to St. Clair Avenue. Under this
proposal, a11 ten units would be able to access the site either by Lexington or St.
Clair.
2. Chapter 60.413(13) of the Zoning Code pernuts cluster developments subject Yo
the following conditions:
a. There sha11 be a minimam of two (2) units.
This condifion is met. Ten units are planned.
b. The units shall be attached, common wall, single-family, with no unit
intruding on the vertical airspace of any other unit.
This condition is met. The units aze paired side-by-side, with no unit inhuding on
the vertical air space of any other unit.
c. The parcel shall meet the lot area required per unit in the zoning district.
This condition can be met. The lot azea, including half of the alley is 107,380.5
squaze feet. This allows 10,738.05 squaze feet per unit, exceeding the 5,000
square feet per unit requirement.

2 d. The parcel shall have a minimum frontage of eighty (80) feet on an
3 improved street.
5 This condition is met. The parcel has 183.93 feet of frontage on Le�ngtnn
6 Parkway.
e. The strnctare shall conform to the schedule of regulafions for height, lot
coverage, setbacks and parl�ng.

11 This condition is met. As proposed, the development meets the requirements for
12 height, lot coverage and parking prescribed by the zoning district. Seven visitor
13 pazking spaces will be provided in addition to a double garage and two spaces in
14 front of the garage for each unit. Zoning enforcement has deternuned the front
15 yatd to be on Lexington, and the reaz yard to be the farthest northwest corner of
16 the parceL The plan meets all setback requirements.

f. The design shall be compatibie with the surrounding neighborhood.
Overail the proposed design is compafible with the surrounding neighbarhood
wich consists of a mixture of 1, 1-1/2, and 2 story structures with gabled and
hipped roofs. Materials used in the surrounding neighbarhood include stucco,
clapboard, metal siding and composite shingles. Windows aze a mixture of
double hung and fixed "picture" windows.
The proposed units are 1 to 2 stories in height with intersecting hipped roofs.
(See drawings attached.) The applicant has not specified which units wili be one
or two stories, but rather proposes that decision be made with the potential buyer.
The overall design concept is prairie style with hipped roofs, large roof overhangs,
divided 13ght windows and enclosed enhy porches. This overali design concept is
in keeping with many homes in the area which were built in the 1920's and 1930's.
Ea�terior material is proposed to be narrow vinyl siding in a palette of colors, with
a potential buyer upgrade to stucco. The overall massing, while larger than the
typical home in the neighborhood due to the paired unit design, is broken up by a
central gabled bay. A variety of exterior colors and materials would provide
additional compatibility with the neighborhood.
g. Individual lots, buildings, street and parking areas shall be designed and
situated to minimize alteration of the natural features and topography.
A finai grading plan has not been submitted for the site. The proposai indicates
m;n;mal changes to existing topography except where necessary.

The applicant submitted a site plan and building elevations along with a written
descriprion detailing the specifics of the development. Landscaping plans haue
not yet been submitted.
3. Section 64300(d) of the zoning code requires that before the Planning
Commission may grant approval of a principal use subject to special conditions,
the Commission shall fmd that:
a. The extent, location and intensity of the use will be in substanrial
compliance with the Saint Paul Comprehensive Plan and any applicable
subarea plans which were approved by the City Council.

The District 16 Plan does not inciude any proposals relevant to this matter. There
are no appiicable smail area plans for this area.
The Saint Pau1 Housing Policy for the 1990's recommends "expansion of housing
opportunities for middie and higher income households where this market is or
can be addressed in Saint Paul.° The units in this proposal will be priced at
$139,900 - $20Q,OOQ, addressing middle income populations.
b. The use will provide adequate ingress and egress to minimize traffic
congestion in the public streets.
This condition is met. A private street will provide access from Lexington
Parkway into the site connecting to the e�sting public alley. The north-south
alley shall be widened to a paved width of 24 feet from Lexington onto the
applicanYs property from Lexington to the "T" junction to provide access for
emergency vehicles and allow two-way traffic. The northern-most portion of the
north/south alley which provides the access to St. Clair Avenue will be widened
to a paved width of 20 feet from the "T" junction to the sidewalk and 24 feet from
the sidewaik to the street. The eastJwest portion of the alley to the "T° junction
shall be widened to a paued width of 24 feet.
c. The use shall not be detrimental to the esisting character of development
in the immediate neighborhood or endanger the public health, safety and
general welfare.
This condition is met. The private street would accommodate emergency vehicles
and all requirements for water, sewer and storm water have been met.

d. The nse will not impede the normal and orderly development and �� J�z`l
improvement of the surrounding property for uses permitted in the district.
4 This condition is met. The surrounding properry is fully developed. The new
5 housing will serve as a buffer between the single family homes on St Clair and
6 Lexington and the raikoad - Ayd Mill Road corridor.

WHEREAS, acting pursuant to Section 64.206 through 64.208 and upon notice to
affected parfies, a public hearing on the appeai of the neighborhood residents was duly conducted
by the Saint Paul City Councii on May 13, 1998, where all interested parties were given an

f. The design shall be compatibie with the surrounding neighborhood.
Overail the proposed design is compafible with the surrounding neighbarhood
wich consists of a mixture of 1, 1-1/2, and 2 story structures with gabled and
hipped roofs. Materials used in the surrounding neighbarhood include stucco,
clapboard, metal siding and composite shingles. Windows aze a mixture of
double hung and fixed "picture" windows.
The proposed units are 1 to 2 stories in height with intersecting hipped roofs.
(See drawings attached.) The applicant has not specified which units wili be one
or two stories, but rather proposes that decision be made with the potential buyer.
The overall design concept is prairie style with hipped roofs, large roof overhangs,
divided 13ght windows and enclosed enhy porches. This overali design concept is
in keeping with many homes in the area which were built in the 1920's and 1930's.
Ea�terior material is proposed to be narrow vinyl siding in a palette of colors, with
a potential buyer upgrade to stucco. The overall massing, while larger than the
typical home in the neighborhood due to the paired unit design, is broken up by a
central gabled bay. A variety of exterior colors and materials would provide
additional compatibility with the neighborhood.
g. Individual lots, buildings, street and parking areas shall be designed and
situated to minimize alteration of the natural features and topography.
A finai grading plan has not been submitted for the site. The proposai indicates
m;n;mal changes to existing topography except where necessary.

The applicant submitted a site plan and building elevations along with a written
descriprion detailing the specifics of the development. Landscaping plans haue
not yet been submitted.
3. Section 64300(d) of the zoning code requires that before the Planning
Commission may grant approval of a principal use subject to special conditions,
the Commission shall fmd that:
a. The extent, location and intensity of the use will be in substanrial
compliance with the Saint Paul Comprehensive Plan and any applicable
subarea plans which were approved by the City Council.

The District 16 Plan does not inciude any proposals relevant to this matter. There
are no appiicable smail area plans for this area.
The Saint Pau1 Housing Policy for the 1990's recommends "expansion of housing
opportunities for middie and higher income households where this market is or
can be addressed in Saint Paul.° The units in this proposal will be priced at
$139,900 - $20Q,OOQ, addressing middle income populations.
b. The use will provide adequate ingress and egress to minimize traffic
congestion in the public streets.
This condition is met. A private street will provide access from Lexington
Parkway into the site connecting to the e�sting public alley. The north-south
alley shall be widened to a paved width of 24 feet from Lexington onto the
applicanYs property from Lexington to the "T" junction to provide access for
emergency vehicles and allow two-way traffic. The northern-most portion of the
north/south alley which provides the access to St. Clair Avenue will be widened
to a paved width of 20 feet from the "T" junction to the sidewalk and 24 feet from
the sidewaik to the street. The eastJwest portion of the alley to the "T° junction
shall be widened to a paued width of 24 feet.
c. The use shall not be detrimental to the esisting character of development
in the immediate neighborhood or endanger the public health, safety and
general welfare.
This condition is met. The private street would accommodate emergency vehicles
and all requirements for water, sewer and storm water have been met.

d. The nse will not impede the normal and orderly development and �� J�z`l
improvement of the surrounding property for uses permitted in the district.
4 This condition is met. The surrounding properry is fully developed. The new
5 housing will serve as a buffer between the single family homes on St Clair and
6 Lexington and the raikoad - Ayd Mill Road corridor.
e. The use shall, in all other respects, conform to the applicable regulations
of fhe district in which it is located.

This condition is met.
WI�REAS, pursuant to the provisions of Saint Paul Legislative Code § 64.206, a�oup
of neighbarhood residents representing themselves as"The Neighborhood" including Mr. Pat
Byrne, duly filed with the City Clerk an appeal from the determination made by the Plam�in.g
Commission, requesting that a hearing be held before the City Council for the purpose of
considering the actions taken by the said Commission; and
WHEREAS, acting pursuant to Section 64.206 through 64.208 and upon notice to
affected parfies, a public hearing on the appeai of the neighborhood residents was duly conducted
by the Saint Paul City Councii on May 13, 1998, where all interested parties were given an
opportunity to be heard; and
WI�EREAS, the Council, having heazd the statements made, and having considered the
application, the report of staff, the record, minutes and resolution of the Zoning Committee and
the Planning Commission, does hereby;
RESOLVE, that the Council of the City of Saint Paul does hereby �rm the decision of
the Planning Commission in this matter, based on the following findings of the Council:
31 The Council, based upon the evidence and the record presented, fmds that the Planning
32 Commission did not make any enor as to fact, finding or procedure and, accordingly, adopts the
33 findings of the Saint Paul Plamiiug Commission as contained in their resolution No. 48-25 dated
34 April 10, 1998, as its own; and
