The on-duty bartender insists alcohol was not being served after 1:00am, but we all recognize the fact that people should have been long gore. It is our wish that you do not judge the owners on the action(s) of the part time help. Our operation has been clean, and up to this time, trouble free. We hope that the city of St. Paul will take that into consideration when it judges our case. The said bartender has been reprimanded and all of our bartenders have been reminded once again in writing, what the regulation is. In closing, let me say again that we do not contest the allegations and we hope that our "track record" will encourage the city to reprimand us but not close us. This recommendation is a departure from previous practices and is being offered for the Council's consideration for this violation and all similar first time violations in the future for the following reasons: 1. The adverse action process is expensive and the assessment of fines in liet. of suspensions will provide a source of badly needed income. A typical uncontested case costs the City roughly $300 to $600. Contested hearings run between $2,500 and $3, 000. The annual cost for the entire Adverse Action process is approaching $100,000. 2 . Suspensions are labor intensive to enforce and place a drain on staff resources for both the License Division and the Police Department. 3 . Suspensions affect all the employees of the establishment not just the owner or manager responsible for the infraction. 4. The effect of the suspension lasts much longer than just the period of time the establishment is closed.
