WHEREAS, Department of Fire and Safety Services, Division of Code Enforcement has
requested the City Council to hold public hearings to consider the advisability and necessity of
ordering the repair or wrecking and removal of a one-story, wood frame structure with a detached,
one-stall, wood frame garage located on property hereinafter referred to as the "Subject Property"
and commonly known as 1068 Arundel Street. This properiy is legally described as follows, to wit:
Lot 1b, Block 2, Holcombe's Subdivision of Lots 70 to 75 inclusive of Wilkin and
Heyward's Outlots to St. Paul, Minn.
WHEREAS, based upon the records in the Ramsey County Recarder's Office and
information obtained by Division of Code Enforcement on ar before February 11, 1998, the

WHEREAS, Division of Code Enforcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance
Building(s)" dated March 23, 1948; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Properry by April 22, 1998; and
WHEREAS, the enforcement officer has posted a piacard on the Subject Properry declaring
this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been conected and Division of Code
Enforcement requested that the City Clerk schedule public hearings before the Legislative Hearing
Officer of the City Council and the Saint Paul City Council; and

WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul I,egislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the I.egislative Heatiug Qfficer of the Saint Paui Ciry
Council on Tuesday, June 2, 1998 to hear testimony and evidence, and after receiving testimony and
evidence, made the recommendation to agprove the request to order the interested or responsible
parties to make the Subject Properry safe and not detrimental to the public peace, health, safety and
welfare and remove its blighting influence on the community by rehabilitating this structure in
accordance with all applicable codes and ordinances, or in the alternadve by demolishing and
removing the structure in accordance with all applicable codes and ardinances. The rehabilitation or

EREAS, a he g was held before the Saint Paul Ciry Council on Wednesday, June 10,
1998 and the testimony and evidence includin$ the action taken by the Legislative Hearing Officer
was considered by the Council; now therefore
BE IT RESQLVED, that based ugon the testimony and evidence presented at the above
referenced public hearings, the Saint Panl City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1068 Arundel Street:
1. That the Subject Property comprises a nuisance condition as de�ned in Saint Paul
I.egislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Division of Code Enforcement has posted a piacard on the Subject Properry
which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the Department of Fire and Safety
, Services, Divisian of Code Enforcement, VacanUNuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been �Ifilled.
ORDER
The Saint Paul City Council hereby makes the following order:

1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building{s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all appiicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within��{1{ after the
date of the Council Hearing. S+x�6� moY.�-i�s
2. If the above carrective action is not completed within this period of time the Fire and Safety
Services, Division of Code Enforcement is hereby authorized to take whatever steps are
necessary to demolish and remove this suucture, fill the site and charge the costs incurred
against the Stizbject Property pursuant to the provisions of Chapter 45 of the Saint Paul
L.egislative Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properry or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time period.
If all personal properiy is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such properiy as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

Gerry Stcathman called the meeting to order at 9:59 a.m.
598 Lawson Avenue East
Chuck Votel reported the building was condemned in October 1997 and vacant since December
1997. One summary abatement was issued for removing refuse from yazd. The vacant buiiding
fees are paid. The real estate taYes are unpaid. The cost to repair is estimated at $40,000; the
estimated cost to demolish is $6,740.
Mazk Munger, owner, agpeazed and stated he had a purchase agreement from a Randy Radunz,
care of Millennium Real Estate Company, but Mr. Radunz is unable to be reached. Mr. Munger
plans to take NIr. Radunz to court for money owed. Patrick Olawsky from Delisle Real Estate
Company has an offer and the property wiil be closed on tonight.
Patrick Olawsky, Delisle Real Estate Company at 1146 Rice Street, appeared and stated he has
offered Mark Munger $1Q900 for the property. Mr. Olawsky plans to go m with a crew, fix the
property, and resell it.
Gerry Strathman recommends allowing the owner six months to complete rehabilitation on
condition that a code compliance inspection is completed and a$2,000 bond is posted by noon of
June 10.
1068 Arundel Street
Chuck Votel reported this building has been vacant since September 1996. The owner Tammy
Swetman has not discussed her intentions with Mr. Votei's office. Seven summary abatement
notices have been issued for cutting grass and weeds, removing refuse, and securing the gazage.
The vacant building fees and real estate taaces are unpaid. A code compliance inspection was
done for Housing and Urban Development (HiJD). A bond has not been posted. The estimated
cost to repair is $20,000; the estimated cost to demolish is $5,164.
Beth Asmussen, represenflng Industry Mortgage Company, appeared and stated Industry has an
unrecorded mortgage on the properiy, however they have been unabie to foreclose the mortgage
because the original has been lost or misplaced. There will probably be court action in order to
do that. Industry would like time to make a decision as to whether to repair the property. They
have also been unable to contact Tazimiy Swetman. Ms. Asmussen requested Indushy be
allowed to post the bond and asked did a new code compliance need to be done. Gerry

Strafliman and Chuck Votel responded they did not think so. Ms. Asmussen stated she would
like a copy of the code compliance to see if Industry should be doing anything at this tima. Ms.
Asmussen will recommend to Industry that the vacant building fee be paid in June.
Chuck Votel stated the inspector indicates that Tammy Swetman has moved to Colorado and left
no forwarding address. Mr. Votel was concerned that no one is taking care of the properry. Beth
Asmussen responded she will recommend to the mortgage company that the outside of the
properiy be maintained.
Gerry Strathman asked how long is needed to acquire this properiy. Beth Asmussen responded if
the mortgage can be located, a quick foreclosure can be done on the property. Otherwise, there
will be court action to foreclose it, which can take up to six months before the company has
controL However, the company has the right to secure it and do property preservation type of
work.
Gerry Strathman asked about the effect of the property on the neighborhood. Chuck Votel
responded routine complaint calls were done. Mr. Votel was concerned that the mortgage
company will not want to foreclose on the property after viewing it. Beth Asmussen stated she
did not think Industry Mortgage would expend the funds if they were not going to foreclose.
Gerry Strathman recommends allowing the owner six months to complete rehabilitation on

590 York Avenue
No one appeared representing the property.
Chuck Votei reported the building was condemned in December 1997 and has been vacant since
January 1998. The owner David Enright has not discussed Yus intentions with Mr. Votel's office.
There has been three summary abatement no6ces issued for removing refuse, discarding
appliances, metal tanks, building debris, feces, and securing the building. The vacate building
fees aze due. One of the problems is the real estate taYes aze unpaid in the amount of $8,102.50.
The estimated cost to repair is $55,000; the estimated cost to demolish is $7,110.
Craig Telin, 594 York, appeared and stated he lives next door. 590 York has been an eyesore for
a long time. Gerry Strathman asked did Mr. Telin have a recommendation. Mr. Telin responded
he would like it to be torn down. Mr. Telin stated his house is approximately three feet away and
was concerned about his house being damaged if 590 York is demolished. Ais aluminum siding
cannot be gurchased anymore. Chuck Votel resgonded the contractors his office deals with are
good, and they are responsible for making sure other property as not damaged. The contractor
will take care of any damage issues. Mr. Votel gave Mr. Telin a phone number to find out which
contractor will demolish the properiy.

Craig Telin expressed interest in huying the property if it is up for auction. Gerry Strathman
cautioned Mr. Telin to check pending assessments against this progerty before buying it. Mr.
Telin stated he is willing to mow the propetty once the house is gone. Mr. 5trathman stated that
would help because the property is less likely to have garbage dumped on it when it looks cased
for.
Gerry Strathman recommends approval of the fifteen day order to remove or repair.
726 Thomas Avenue
No one appeazed repzesenting the property.
Chuck Votel reported this property is owned by H[ID. It is estimated that the cost to repair is
$60,000. There has not been any d"uect conversations with anyone from HUD about viability of
repairing this building. It is not suitable for renovation.
Gerry Strathman recommends approval of the five day order to remove or repair.

timely manner, and failing that, authorize the Division of Code Enforcement to proceed to
demolition and removal, and to assess the costs incuned against the real estate as a special

1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building{s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all appiicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within��{1{ after the

2. If the above carrective action is not completed within this period of time the Fire and Safety
Services, Division of Code Enforcement is hereby authorized to take whatever steps are
necessary to demolish and remove this suucture, fill the site and charge the costs incurred
against the Stizbject Property pursuant to the provisions of Chapter 45 of the Saint Paul
L.egislative Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properry or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time period.
If all personal properiy is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such properiy as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

Gerry Stcathman called the meeting to order at 9:59 a.m.
598 Lawson Avenue East
Chuck Votel reported the building was condemned in October 1997 and vacant since December
1997. One summary abatement was issued for removing refuse from yazd. The vacant buiiding
fees are paid. The real estate taYes are unpaid. The cost to repair is estimated at $40,000; the
estimated cost to demolish is $6,740.
Mazk Munger, owner, agpeazed and stated he had a purchase agreement from a Randy Radunz,
care of Millennium Real Estate Company, but Mr. Radunz is unable to be reached. Mr. Munger
plans to take NIr. Radunz to court for money owed. Patrick Olawsky from Delisle Real Estate
Company has an offer and the property wiil be closed on tonight.
Patrick Olawsky, Delisle Real Estate Company at 1146 Rice Street, appeared and stated he has
offered Mark Munger $1Q900 for the property. Mr. Olawsky plans to go m with a crew, fix the
property, and resell it.
Gerry Strathman recommends allowing the owner six months to complete rehabilitation on
condition that a code compliance inspection is completed and a$2,000 bond is posted by noon of
June 10.
1068 Arundel Street
Chuck Votel reported this building has been vacant since September 1996. The owner Tammy
Swetman has not discussed her intentions with Mr. Votei's office. Seven summary abatement
notices have been issued for cutting grass and weeds, removing refuse, and securing the gazage.
The vacant building fees and real estate taaces are unpaid. A code compliance inspection was
done for Housing and Urban Development (HiJD). A bond has not been posted. The estimated
cost to repair is $20,000; the estimated cost to demolish is $5,164.
Beth Asmussen, represenflng Industry Mortgage Company, appeared and stated Industry has an
unrecorded mortgage on the properiy, however they have been unabie to foreclose the mortgage
because the original has been lost or misplaced. There will probably be court action in order to
do that. Industry would like time to make a decision as to whether to repair the property. They
have also been unable to contact Tazimiy Swetman. Ms. Asmussen requested Indushy be
allowed to post the bond and asked did a new code compliance need to be done. Gerry

Strafliman and Chuck Votel responded they did not think so. Ms. Asmussen stated she would
like a copy of the code compliance to see if Industry should be doing anything at this tima. Ms.
Asmussen will recommend to Industry that the vacant building fee be paid in June.
Chuck Votel stated the inspector indicates that Tammy Swetman has moved to Colorado and left
no forwarding address. Mr. Votel was concerned that no one is taking care of the properry. Beth
Asmussen responded she will recommend to the mortgage company that the outside of the
properiy be maintained.
Gerry Strathman asked how long is needed to acquire this properiy. Beth Asmussen responded if
the mortgage can be located, a quick foreclosure can be done on the property. Otherwise, there
will be court action to foreclose it, which can take up to six months before the company has
controL However, the company has the right to secure it and do property preservation type of
work.
Gerry Strathman asked about the effect of the property on the neighborhood. Chuck Votel
responded routine complaint calls were done. Mr. Votel was concerned that the mortgage
company will not want to foreclose on the property after viewing it. Beth Asmussen stated she
did not think Industry Mortgage would expend the funds if they were not going to foreclose.

590 York Avenue
No one appeared representing the property.
Chuck Votei reported the building was condemned in December 1997 and has been vacant since
January 1998. The owner David Enright has not discussed Yus intentions with Mr. Votel's office.
There has been three summary abatement no6ces issued for removing refuse, discarding
appliances, metal tanks, building debris, feces, and securing the building. The vacate building
fees aze due. One of the problems is the real estate taYes aze unpaid in the amount of $8,102.50.
The estimated cost to repair is $55,000; the estimated cost to demolish is $7,110.
Craig Telin, 594 York, appeared and stated he lives next door. 590 York has been an eyesore for
a long time. Gerry Strathman asked did Mr. Telin have a recommendation. Mr. Telin responded
he would like it to be torn down. Mr. Telin stated his house is approximately three feet away and
was concerned about his house being damaged if 590 York is demolished. Ais aluminum siding
cannot be gurchased anymore. Chuck Votel resgonded the contractors his office deals with are
good, and they are responsible for making sure other property as not damaged. The contractor
will take care of any damage issues. Mr. Votel gave Mr. Telin a phone number to find out which
contractor will demolish the properiy.

Craig Telin expressed interest in huying the property if it is up for auction. Gerry Strathman
cautioned Mr. Telin to check pending assessments against this progerty before buying it. Mr.
Telin stated he is willing to mow the propetty once the house is gone. Mr. 5trathman stated that
would help because the property is less likely to have garbage dumped on it when it looks cased
for.
Gerry Strathman recommends approval of the fifteen day order to remove or repair.

No one appeazed repzesenting the property.
Chuck Votel reported this property is owned by H[ID. It is estimated that the cost to repair is
$60,000. There has not been any d"uect conversations with anyone from HUD about viability of
repairing this building. It is not suitable for renovation.

The Legislative Hearing O�cer recommends approval of the fifteen day order to remove
or repair.

Gerry Stcathman called the meeting to order at 9:59 a.m.
598 Lawson Avenue East
Chuck Votel reported the building was condemned in October 1997 and vacant since December
1997. One summary abatement was issued for removing refuse from yazd. The vacant buiiding
fees are paid. The real estate taYes are unpaid. The cost to repair is estimated at $40,000; the
estimated cost to demolish is $6,740.
Mazk Munger, owner, agpeazed and stated he had a purchase agreement from a Randy Radunz,
care of Millennium Real Estate Company, but Mr. Radunz is unable to be reached. Mr. Munger
plans to take NIr. Radunz to court for money owed. Patrick Olawsky from Delisle Real Estate
Company has an offer and the property wiil be closed on tonight.
Patrick Olawsky, Delisle Real Estate Company at 1146 Rice Street, appeared and stated he has
offered Mark Munger $1Q900 for the property. Mr. Olawsky plans to go m with a crew, fix the
property, and resell it.
Gerry Strathman recommends allowing the owner six months to complete rehabilitation on

1068 Arundel Street
Chuck Votel reported this building has been vacant since September 1996. The owner Tammy
Swetman has not discussed her intentions with Mr. Votei's office. Seven summary abatement
notices have been issued for cutting grass and weeds, removing refuse, and securing the gazage.
The vacant building fees and real estate taaces are unpaid. A code compliance inspection was
done for Housing and Urban Development (HiJD). A bond has not been posted. The estimated
cost to repair is $20,000; the estimated cost to demolish is $5,164.
Beth Asmussen, represenflng Industry Mortgage Company, appeared and stated Industry has an
unrecorded mortgage on the properiy, however they have been unabie to foreclose the mortgage
because the original has been lost or misplaced. There will probably be court action in order to
do that. Industry would like time to make a decision as to whether to repair the property. They
have also been unable to contact Tazimiy Swetman. Ms. Asmussen requested Indushy be
allowed to post the bond and asked did a new code compliance need to be done. Gerry

Strafliman and Chuck Votel responded they did not think so. Ms. Asmussen stated she would
like a copy of the code compliance to see if Industry should be doing anything at this tima. Ms.
Asmussen will recommend to Industry that the vacant building fee be paid in June.
Chuck Votel stated the inspector indicates that Tammy Swetman has moved to Colorado and left
no forwarding address. Mr. Votel was concerned that no one is taking care of the properry. Beth
Asmussen responded she will recommend to the mortgage company that the outside of the
properiy be maintained.
Gerry Strathman asked how long is needed to acquire this properiy. Beth Asmussen responded if
the mortgage can be located, a quick foreclosure can be done on the property. Otherwise, there
will be court action to foreclose it, which can take up to six months before the company has
controL However, the company has the right to secure it and do property preservation type of
work.
Gerry Strathman asked about the effect of the property on the neighborhood. Chuck Votel
responded routine complaint calls were done. Mr. Votel was concerned that the mortgage
company will not want to foreclose on the property after viewing it. Beth Asmussen stated she
did not think Industry Mortgage would expend the funds if they were not going to foreclose.

590 York Avenue
No one appeared representing the property.
Chuck Votei reported the building was condemned in December 1997 and has been vacant since
January 1998. The owner David Enright has not discussed Yus intentions with Mr. Votel's office.
There has been three summary abatement no6ces issued for removing refuse, discarding
appliances, metal tanks, building debris, feces, and securing the building. The vacate building
fees aze due. One of the problems is the real estate taYes aze unpaid in the amount of $8,102.50.
The estimated cost to repair is $55,000; the estimated cost to demolish is $7,110.
Craig Telin, 594 York, appeared and stated he lives next door. 590 York has been an eyesore for
a long time. Gerry Strathman asked did Mr. Telin have a recommendation. Mr. Telin responded
he would like it to be torn down. Mr. Telin stated his house is approximately three feet away and
was concerned about his house being damaged if 590 York is demolished. Ais aluminum siding
cannot be gurchased anymore. Chuck Votel resgonded the contractors his office deals with are
good, and they are responsible for making sure other property as not damaged. The contractor
will take care of any damage issues. Mr. Votel gave Mr. Telin a phone number to find out which
contractor will demolish the properiy.

Craig Telin expressed interest in huying the property if it is up for auction. Gerry Strathman
cautioned Mr. Telin to check pending assessments against this progerty before buying it. Mr.
Telin stated he is willing to mow the propetty once the house is gone. Mr. 5trathman stated that
would help because the property is less likely to have garbage dumped on it when it looks cased
for.
Gerry Strathman recommends approval of the fifteen day order to remove or repair.

No one appeazed repzesenting the property.
Chuck Votel reported this property is owned by H[ID. It is estimated that the cost to repair is
$60,000. There has not been any d"uect conversations with anyone from HUD about viability of
repairing this building. It is not suitable for renovation.
Gerry Strathman recommends approval of the five day order to remove or repair.

recommendation of the Division of Code Enforcement that the Ciry Council pass a resolution
ordering the responsible parties to either repair, or demolish and remove this buiiding in a
timely manner, and failing that, authorize the Division of Code Enforcement to proceed to
demolition and removal, and to assess the costs incuned against the real estate as a special
assessment to be collecTed 'an the same manner as taxes.
