(CCSP); and WHEREAS, pursuant to that franchise, at Article III, Section 304.(a)(3),CCSP is required to make a 1998 capital payment equivalent to $630,000 in 1997 dollars pro-rated to reflect the period of time that the franchise is effective in 1998; and WI3EREAS, pursuant to Article III, Section 304(a)(4), if CCSP has a valid and binding contract with an entity designated to manage any public access channel, the Ciry may authorize CCSP to offset amounts owed under Section 304(a)(3) by amounts it pays under that contract; and WHEREAS, CCSP has a valid and binding contract wiih Cable Access St. Paul, Inc., dlbia as the St. Paul Nelghborhood Network ("SPI3N"); and WI3EREAS, CCSP and SPNN have asked the City to authorize an offset of all amounts that would otherwise be owed for 1998 under Section 304.(a)(3), and have represented that the funds will be used to support the PEG operations of SPNN; and WHEREAS, the contract pursuant to which the payments will be made is binding on SPNN's successors and assigns, and aze to be made to whatever organization is the entity responsible for managing public access, so that the funds will accrue to the benefit of the public generally, and not just SPNN; WHEREAS, the City finds that it is in the public interest to allow such offset, and that it wili enhance the services available to the residents of the City. � a 3 4 5 6 7 8 9 10 11 c��-44°I NOW THEREFORE BE IT RE50LVED, Pursuant to Article III, Section 304 (a)(4) of the franchise held by CCSP, CCSP is hereby authorized to offset any amount it pays to SPNN for 1998 against the capital payments it would otherwise owe for 1998 under Article III, Section 304 (a)(3), up to the entire amount owed under Section 304 (a)(3) for 1998; and BE IT FURTHER RESOLVED, CCSP shall provide to the Ciry a statement showing amounts paid to SPNN within 10 days after such payment is made, so that the City may determine that the offset is being made properly. �. Yes No Explain all yes answers on separete sheet and attach to green sheet Initiating Problem, Issue, Opportunity (Who, What, When, Where, Why): The City's new cable television franchise does not provide operating funding for the "designated entity" and the provision of public, educational and government access services, and community television to protect the City in the event the franchisee would claim these funds are &anchise fees. Therefore, certain capital requirements, which aze not subject to the same threat, were required by the new cable franchise. Section 304 (a) of the new cable franchise provides the mechanism to convert certain capital funds into operating funds for access services and community progra.mining, which is done annually via resolution. Advantages If Approved: The designated entity will have operating support and will be able to provide access services and progranuning and perform according to its contract with the Ciry. Disadvantages If Approved: None Disadvantages If Not Approved: The designated entity would not haue operating dollars. Access services, including playback of City Channel 18, would cease without operating funds.
