�GREEMENT
AN AGREEMENT, Dated this 19th day o= r"�r� , 1°98,
by and between the CITY OE SAINT PAUL, hereinaf'ter called "City",
and the DAROTA COUNTY SHERIFF DEPARTMENT, hereinaTLer called
"User",
WITNESSETH:
IT IS MUTUALLY AGREED BY AND BETWEEN THE CITY AND USER, that
the City will provide the User with two-way rad?o and other
electronic eauipment repair, inspection services and technical
assistance subject to the foilowing terms and ccnditions:
1. That iTser shall pay to tne City the sum oi $52.00 per nour
for Communication Technician services and $25.00 per hour for
Technician Helper services provided by the City. A11 material used
by the City in providing the services shall, additionally, be paid
for by the User at the City's actual cost �or such materials plus
15o to cover ordering, handling, shipping and s'tocking.
2. Tna:, the City may, at any time, increase the cost �er hour
stated above upon furnishing User a written statement oz" the Cit_y's
increased operating cost, and/or labor costs as set forth in Lhe
collective bargaining agreement between tne City and the personnel
who perform Lhe servicing tasks.
3. That the City wiil provide services, Monday through Friday
irom i:00 a.m. to 11:D0 n.m. and Saturday from 8:00 a.m. to �:00
p.m. Emergency servicing, at times other than those sLa�ed above,
shall be furnished for User's base sta�ion equipmen� or other
essential equipment on a two (2) hour or less callback basis.
4. That ihe City will provide its services for User's base
station ann associated equipment at such equ_pmeni's us��al
location. The City's servicing oi the User's mobile units,
portables and other equipment shall be periormed at `he City`s
radio maintenance shop_

5. That L'ne Ciry will ir.spect all of the User's radio
transmitting equipment aL leas� once yearly and shall be entitled
to make scch repaizs, replacemen�s and adjustments �s the City
believes may be needed to keeq said e4uipment in aood operatinq
condition and in compliance with Federal Communications Commission
regulations.
6. The City shall save harmless, indemnify and defend to the
limits set zorth in Minnesota Statutes, Chapter a66, the User from
any actions, claims, damages or demands which may be brought
against the User arising out of the negligent per£ormance of the
City's duties pursuan� to this Agreement.
7. That User sha11 provide the City with an inventory list of
all equipment to be serviced hereunder, and the list shall include
ihe location and serial number of the User's equipment. Further,
User shall advise the City of the User's new eauipment as acquired.
8. That this agreement may be terminated without cause by
eitner party upon thirty (30) days' written no�ce.
