98-444Council File # FO � �1 Green Sheet # � `� � RESOLUTfON �1 T PAUL, MINNESOTA �` �_ V Presented By Referred To Committee: Date WHEREAS, the City of Saint Paul through its Division of Pazks and Rscreation provides a variety of special events for youW including a citywide tennis tournawent; and WHEREAS, Macalester College of Saint Paul owns land at 1600 Grand Avenue, including tennis courts; and WHEREAS, the Division of Pazks and Recreation is in need of tennis courts for its Public Parks Tennis Tournamem; and WHEREAS, Macalester College has given permission to the Division of Parks and Recreation to use the tennis courts for its Public Parks Tennis Tournament on June 25-June 28, 1998, and has asked the Ciry to indemnify and hold the College harmless during the use; and WI3EREAS, this event serves a legitimate public purpose by serving the youth of tha City; and - WHEREAS, the expenditure of public funds, which includes the promise of indemnification and defensa, for such a purpose will facilitate and enable it to take place; now therefore, be it RE50LVED, that the City Council of the City of Saint Paul on behalf of the City of Saint Paul hereby agrees to defend, indemnify and hold Macalester College harn�less from any and all damages it may be required to pay as a result of suits, claims, actions, ar judgments arising out of said Public Pazks Tennis Tournament andlor activities connected with such tournaznent which aze amibutable to the negligent act or omission by the Ciiy of Saint Paul, its employaes, agents or contractors. a�q ..y4`� 2 FURTHER RESOLVED, that this indemnification does not include: 1)injuries or 3 damages arising from hidden traps or dangerous conditions of the facilities as to wluch the 4 College had actual or constructive notice; and 2) damages or injuries arising out of occurrences 5 or events wluch are not part of the tennis tour a�m_ent or which do not take place while the 6 premises aze being used as part of the event.
