WfiEREAS, there haue been two previous appearances in front of Councii for violafions
of Sale of Alcohol to an Underage Person by the Licensee, in 1992 and 1996; and
WHEREAS, the appearance by the Licensee on the 1996 violation was on September 11,
1996, which is one week outside of the 18-month period which would cause this to be treated as
a second appearance before Council for purposes of the presumptive penalty under Saint Paul
Legislative Code §409.26; and
WFIEREAS, the 1996 appearance involved multiple violations; and
WHEREAS, the Licensee has never passed a compliance check involving sale of alcohol
to an underage person; and
WHEREAS, an upward departure from the presumptive penalty for this violation is
warranted based upon the previous violation history, the failure by the Licensee to ha�e passed
any compliance checks and the lack of any indication that the Licensee has implemented new
policies to prevent a repeat of this type of violation; and
VJFIEREAS, the Council determines that these factors present substantial and compeiling
reasons to deviate from the presumpfive penalty of a one-day suspension; now, therefore, be it
RESOLVED, that a11 licenses held by L& K Corporation, dibJa Quick Stop Liquor for
the premises at 824 7`" Street East (License ID No. 10889) are hereby suspended for a period of
twenty-one days beginning at 12:01 am. on Wednesday, June 3, 1998, unril 11:59 p.m. on
Tuesday, June 23, 1998, far the violation of Sale of an Alcoholic Beverage to an Underage
Person, which occurred on the premises on March 17, 1998.

The D'uector of the Office of License, Inspections and Environmental Protection will recommend
that adverse action be taken against your licenses based on the foilowing information:
On March 17,1998, you or another employee sold alcohol to two underage
persons in the above referenced establishmenk This is a violarion of section
4Q9.08 of the Saint Paul Legislative Code, as well as state law, Minn. State §
340A.503.
If you do not dispute the above facts, please, send me a letter stating that you do not contest the
facts. The matter will then be scheduled before the Saint Paul City Council for a hearing on what
penalty, if any, to impose. You will be allowed to speak on your own behalf at that heazing.
If you believe that the facts stated above are in error, you aze entitled to an evidentiary hearing
before an administrative law judge. In that event, you would receive a notice of hearing, with the
date, time and place of the hearing and the name of the administrative law judge. Piease let me
know in writing no later than April 13, 1998 how you wish to proceed.
If you flave not contacfed us by April 13,1998, I will assume that you are not contesting the
facts and will schedule this matter for a hearing before the City Council.

On March 17,1998, you or another employee sold alcohol to two underage
persons in the above referenced establishmenk This is a violarion of section
4Q9.08 of the Saint Paul Legislative Code, as well as state law, Minn. State §
340A.503.
If you do not dispute the above facts, please, send me a letter stating that you do not contest the
facts. The matter will then be scheduled before the Saint Paul City Council for a hearing on what
penalty, if any, to impose. You will be allowed to speak on your own behalf at that heazing.
If you believe that the facts stated above are in error, you aze entitled to an evidentiary hearing
before an administrative law judge. In that event, you would receive a notice of hearing, with the
date, time and place of the hearing and the name of the administrative law judge. Piease let me
know in writing no later than April 13, 1998 how you wish to proceed.

of Sale of Alcohol to an Underage Person by the Licensee, in 1992 and 1996; and
WHEREAS, the appearance by the Licensee on the 1996 violation was on September 11,
1996, which is one week outside of the 18-month period which would cause this to be treated as
a second appearance before Council for purposes of the presumptive penalty under Saint Paul
Legislative Code §409.26; and
WFIEREAS, the 1996 appearance involved multiple violations; and
WHEREAS, the Licensee has never passed a compliance check involving sale of alcohol
to an underage person; and
WHEREAS, an upward departure from the presumptive penalty for this violation is
warranted based upon the previous violation history, the failure by the Licensee to ha�e passed
any compliance checks and the lack of any indication that the Licensee has implemented new
policies to prevent a repeat of this type of violation; and
VJFIEREAS, the Council determines that these factors present substantial and compeiling
reasons to deviate from the presumpfive penalty of a one-day suspension; now, therefore, be it
