WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate
the subject of noise in the C3ty of Saint Paul; and
WHEREAS, §293.11 provides for the granting of variances from the sound level
limitafions contained in §293.09, upon a finding by the City Council that full compliance with
Chapter 293 would consritute an unreasonable hardship on an applicant, other persons or on
the community; and
WHEREAS, the Saint Paul Saint Professional Baseball Club, Inc., represented by Tom
Whaley, Director of Operafions, who has been designated as the responsible person on the
application, has applied for a variance to a11ow live music at Midway Stadium, 1771 Energy
Park Drive, on June 14, 1998, June 27, 1998 and June 28, 1998; and
WHEREAS, applicant is seeking a variance for the hours of 2:00 p.m. to "9:00 p.m. on
June 14, 1998 and far the hours of 1:00 p.m. to 10:00 p.m. on the remaining two dates; and
VJHEREAS, if applicant is not granted a variance it will not be able to present the
concerts; and
WI3EREAS, the Office of License, Inspections, and Environmental Protection has
reviewed the application and has made recommendations regarding conditions for the
variance; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants `a variance to the
Saint Paul Saints Professional Baseball Club, Inc., subject to the following conditions:
1) The variance shall be for the hours of 2:00 pm to 9:00 p.m. on
June 14, 1998 and between the hours of 1:00 p.m. to 10:00 p.m.
on June 27 and 28, 1998.

2) All electronically powered eq�ment used in conjunction with
the event shall not exceed�99-dBA as measured at the closer of
the sound xnix or at a distance of 100 feet from the front of the
stage.

3) The applicant sha11 provide personnel and equipment who shall
provide continuous sound level monitoring between 1:00 p.m.
and 10:00 p.m. on all dates to ensure compliance with Condirion
#2.
