l WFIEREAS, The Boazd of Water Commissioners and the City of Saint Paul have been apprised
2 of the fact that certain properties located in Anoka County have filed of record perpetual easement
3 held on behalf of the City of Saint Paul and its Board of Water Commissioners for the purpose of
4 diverting, taking and drawing water from Lake Baldwin in Anoka County for the purpose of
5 supplying water to the inhabitants of the Ciry of Saint Paul; and
WHEREAS, Upon investigation of this matter the Board and City Council have been apprised that
the City and Board do not need an easement over this property and that the recording of such
easements must have been in error; and

I 1 WHEREAS, The Board and City Council were requested by the underlying property owners to
12 adopt a resolution stating and clarifying the fact that such a perpetual easement is not owned or
13 possessed by the City of Saint Paul and its Boazd of Water Commissioners; now, therefore, be it
14
15 RESOLVED, That the City Council of the City of Saint Paul for itself, and on behalf of the Boazd
16 of Water Comxnissioners of the City of Saint Paul does hereby declaze that the perpetual easements
17 noted of record on the following described tonens properry held by the City of Saint Paul and the
18 Boazd of Water Commissioners of the City of Saint Paui to divert, take and draw water from Lake
19 Baldwin in the County of Anoka, State of Minnesota, to supply the inhabitants of the City of Saint
20 Paul be and is hereby abandoned and released forever, the toaens groperty being described in and
21 contained in the Certificate of Title No. 75633, in Volume 238, page 273, all in the Office of the
22 Registrar of Tifles of Anoka County, Minnesota, and a certified copy of this resolution may be filed
23 of record in the County of Anoka
