1 BE IT RESOLVED, that, upon the petition of John M. Fischer, as documented in Finance Department
2 File Number 27-1997, public properties hereinafter described are hereby vacated and discontinued
3 as public property; and, subject to the herein stated exceptions, the easements within those public
4 properties are hereby released.
6 The propeny to be vacated is described as follows:
8 Hubbard Avenue, from the southerly extension of a party wall in Lot 6 Block 4, Winter's Addition
9 to St. Paul, located 731 feet easterly of the centerline of Victoria Street to the northerly
10 extended east line of Lot 4, Block 3, Joseph R. Weide's Rearrangement of Block 3 and North one
11 half of Block 2, Winter's Addition to St. Paul, Minnesota.

Also, all that part of Lots 1 and 2, Block 4, Winter's Addition to St. Paullying within the arc of
a 100 foot diameter circle whose radius point is located 10 feet south of the south line of said
Block 4 and 50 feet west of the northerly extension of the westerly line of Lot 3, Block 3, Joseph
R. Weide's Rearrangement of Block 3 and North one half of Block 2, Winter's Addition to St. Paul,
Minnesota.
19 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
20 Saint Paul Legislative Code as amended, and to the following conditions:

That the petitioners, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That a permanent utility easement sha11 be retained on behalf of the Ciry of Saint Paul, Board of
Water Commissioners, in that part of the area being vacated which lies west of the extended east
line of Lot 19, Block 3, Joseph R. Weide's Rearrangement of Block 3 and North one half of
Block 2, Winter's Addition to Saint Paul, Minnesota, subject to the following restrictions:
a. No buildings, structures, trees or any temporary structure, material storage, fiYture, or
other object that will prohibit normal access to water facilities for maintenance purposes
will be permitted within the easement area.

Water Utility.

No change in surfacing within the easement area will be permitted without written
pernussion from the Water Utility.
d. The petiuoner, its successors and assigns shall fully indemnify, defend and save harmless
the Board of Water Commissioners, its officers, agents, employees, and servants from all
suits, action ar claims which shall arise from any injuries or damages received or
sustained by any break in any service pipe, water main, or connection in said reserved
easement, arising out of or resulting from any action or negligence of the petiuoner, its
employees, agents or business invitees.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of Northern States Power Company described as follows:
All that part of vacated Aubbard Avenue which lies westerly of a line drawn 100 feet east
of and parallel to the extended east line of Avon Street.
That with the accompanying Utility Easement Certificates of Intended Non-Use, filed voluntarily
on behalf of US West Communications, Incorporated, Northern States Power Company, District
Energy St. Paul, Incorporated, MCI Telecommunications Corporation, Continental Cablevision,
The Water Utility, and The Department of Public Works, made a part hereof by this reference and
filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these
corporations and departments, waives the right to the utility easements in the vacated area
described above except as documented herein.
That the City Council of the City of Saint Paul hereby authorizes the proper City Officials to
convey to the respective adjoining property owners the vacated property described as follows:

or properry on account of this vacation or petitioner's use of this property, including but not
lunited to a claun brought because of any act of omission, neglect, or misconduct of said
petitioner or because of any clanns or liability arising from any violation of any law or
regulation made in accordance with the law, whether by the petitioner or any of their agents or
employees.

1 7. That the petitioners, their successors, and assigns, shall within 60 days of the effective date of
2 this resolution, file with the City Cierk an acceptance in writing of the conditions of this
3 resolution and shall within the period(s) specified in the terms and conditions of this
4 resolution, comply in all respects with these terms and conditions.

I am requesting a date of May 6, 1998 for a Public Hearing to approve the attached
Council Resolution. The purpose of the resolution is to vacate part of Hubbard Avenue
east of Avon Street to allow for the construction of a plant platform as part of the
petitioner's plat remodeling project.
T�e utilities and City offices with rights to the subject area have all responded to our
inquiries regarding the proposed vacation. Their responses are with the resolution as it is
being routed for signatures. The resolution is currently in Peter Hames' office.
I have enclosed photocopies of the Green Sheet, the Council Resolution, and a map of the

That a permanent utility easement sha11 be retained on behalf of the Ciry of Saint Paul, Board of
Water Commissioners, in that part of the area being vacated which lies west of the extended east
line of Lot 19, Block 3, Joseph R. Weide's Rearrangement of Block 3 and North one half of
Block 2, Winter's Addition to Saint Paul, Minnesota, subject to the following restrictions:
a. No buildings, structures, trees or any temporary structure, material storage, fiYture, or
other object that will prohibit normal access to water facilities for maintenance purposes

No change in surfacing within the easement area will be permitted without written
pernussion from the Water Utility.
d. The petiuoner, its successors and assigns shall fully indemnify, defend and save harmless
the Board of Water Commissioners, its officers, agents, employees, and servants from all
suits, action ar claims which shall arise from any injuries or damages received or
sustained by any break in any service pipe, water main, or connection in said reserved
easement, arising out of or resulting from any action or negligence of the petiuoner, its
employees, agents or business invitees.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of Northern States Power Company described as follows:
All that part of vacated Aubbard Avenue which lies westerly of a line drawn 100 feet east
of and parallel to the extended east line of Avon Street.
That with the accompanying Utility Easement Certificates of Intended Non-Use, filed voluntarily
on behalf of US West Communications, Incorporated, Northern States Power Company, District
Energy St. Paul, Incorporated, MCI Telecommunications Corporation, Continental Cablevision,
The Water Utility, and The Department of Public Works, made a part hereof by this reference and
filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these
corporations and departments, waives the right to the utility easements in the vacated area
described above except as documented herein.
That the City Council of the City of Saint Paul hereby authorizes the proper City Officials to
convey to the respective adjoining property owners the vacated property described as follows:

No change in surfacing within the easement area will be permitted without written
pernussion from the Water Utility.
d. The petiuoner, its successors and assigns shall fully indemnify, defend and save harmless
the Board of Water Commissioners, its officers, agents, employees, and servants from all
suits, action ar claims which shall arise from any injuries or damages received or
sustained by any break in any service pipe, water main, or connection in said reserved
easement, arising out of or resulting from any action or negligence of the petiuoner, its
employees, agents or business invitees.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of Northern States Power Company described as follows:
All that part of vacated Aubbard Avenue which lies westerly of a line drawn 100 feet east
of and parallel to the extended east line of Avon Street.
That with the accompanying Utility Easement Certificates of Intended Non-Use, filed voluntarily
on behalf of US West Communications, Incorporated, Northern States Power Company, District
Energy St. Paul, Incorporated, MCI Telecommunications Corporation, Continental Cablevision,
The Water Utility, and The Department of Public Works, made a part hereof by this reference and
filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these
corporations and departments, waives the right to the utility easements in the vacated area
described above except as documented herein.
That the City Council of the City of Saint Paul hereby authorizes the proper City Officials to
convey to the respective adjoining property owners the vacated property described as follows:
Also, all that part of Lots 1 and 2 Block 4, Winter's Addition to St. Paul lying within the
arc of a 100 foot diameter circle whose radius point is located 10 feet south of the south
line of said Block 4 and 50 feet west of the northerly extension of the westerly line of Lot
3, Block 3, Joseph R. Weide's Rearrangement of Block 3 and North one half of Block 2,
Winter's Addition to St. Paul, Minnesota.
That the petitioners, their successors and assigns, agree to indemnify, defend and save harmless
the City of Saint Paul, its officers, and employees from all suits, actions, or claims of any
character brought as a result of injuries or damages received or sustained by any person, persons,
or properry on account of this vacation or petitioner's use of this property, including but not
lunited to a claun brought because of any act of omission, neglect, or misconduct of said
petitioner or because of any clanns or liability arising from any violation of any law or
regulation made in accordance with the law, whether by the petitioner or any of their agents or
employees.
