98-377Council File # 98 - 377 0 R 1 G 1 N A L Green Sheet # 5 i�� �� RESQLUTION CITY OF SAINT PAUL, MINNESOTA 1 2 3 Presented By Referred To Committee: Date RESOLUTION APPROVING A HOUSING REPLACEMENT DISTRICT PLAN WHEREAS, the Laws of Minnesota, 1995, Chapter 264, Article 5, Secrions 44 through 47 (the "Enabling Legislarion"), authorize the CiTy of Saint Paul to establish a Housing Replacement District through the Saint Paul Housing and Redevelopment Authority (the "I�A"); and 10 I1 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 t0 E1 WHEREAS, in its Resolution 95-1469 the City Council of the City of Saint Paul accepted the Enabling Legislation; and WHEREAS, a draft Housing Replacement District Plan (the "Plan") was released by the HRA for public review; and WIIEREAS, on March 11, 1998 copies of the Plan were mailed to the Ramsey County Boazd of Commissioners, the School Board and the City's district planning councils; and WHEREAS, the Saint Paul Plamiiiig Commission by its Resolution No. 98-21 found the Plan to be in conformance with the City's Comprehensive Plan;_and WHEREAS, the Saint Paul Capital Improvement Budget Committee reviewed the Plan at its meeting of April 8, 1998; and WI�EREAS, the quality and variety of a city°s housing stock deternunes the livabiliry of its neighborhoods, the stability and strength of its t� base, and its ability to compete effectively in the broader metropolitan area housing market; and WfIEREAS, developing and implementing housing programs that maintain and preserve the quality of the existing housing inventory, ensure high occupancy levels, promote home ownership, encourage additional inveshnent in home unprovement activiries, eliminate the blighting influence of vacant and substandard properties, protect neighborhood livability, and promote the development of new, compatible housing units at infill locafions has been a fundamental objecfive of City and HRA housing policy for many years; and WHEREAS, a Housing Replacement TaY Increment District can potentially generate increments to finance part of the cost of acquiring and treating substandazd housing; and WHEREAS, the City Council believes that the adoption of the Plan is in the best interests of the City of Saint Paul for the reasons hereinbefore stated; and will expand the tas base of the City of Saint Paul, in accordance with the public purpose and provlsions of the applicable state and locallaws and requirements under which 42 the Plan is being implemented; 9g' `37 � 43 44 NOW Tf�REFORE BE IT RESOLVED, by the City Council ofthe City of Saint Paul that the Housing 45 Replacement District Plan dated Apri122, 1998 is hereby approved; and be it 46 47 FURTEIER RESOLVED, that the City makes the following findings: 48 49 50 51 52 That the approved tax increment financing district is a housing replacement dishict and meets the criteria of the Laws of Minnesota, 1995, Chapter 264, Article 5, Sections 44 tluough 47. (1) That the proposed development or redevelopment wouid not reasonably be expected to occur solely through private investment within the reasonably foreseeable future and that the increased mazket value of the site(s) that could reasonably be expected to occut without the use of tax increment financing would be Iess than the increase in the market value estimated to result from the proposed development after subuacting the present value of the projected tas increments for the maximum duration of the district pernutted by the plan. �2) 53 54 55 56 57 58 59 (3) That the taY increment financing plan conforms to the general plan for the development or 60 redevelopment of the municipality as a whole. 61 62 63 64 65 66 67 (4) That the tax increment financing plan will afford maacimum opporiunity, consistent with the sound needs of the municipality as a whole, for the development or redevelopment of the project by private enterprise.
