That a permanent utility easement shall be retained on, over, under and across the vacated area on behalf of the Ciry of Saint Paul, Department of Public Works to reserve the right of the City to maintain and operate any sewer in or upon said easement and to enter upon said easement or any portion thereof at any time and from time to time, for the purposes of future construction, reconstruction, inspecting, maintaining or repairing the same or any part thereof and shall be subject to the following conditions: a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any other objects that will prohibit nozmal access to utiliry facilities for maintenance purposes will be permitted within the easement area. b. Improvements in or upon the above described easement that do not prohibit the City from exercising its reserved rights may be allowed by obtaining written permission from the Department of Public Works Sewer Division with the understanding that the restoration and costs of such nnprovements shall be the sole responsibility of the petitioner, its successars and assigns in the event the Ciry exercises its reserved easement rights. Tschida Unit Supervisor DATE: August 12, 1997 SUBJECT: Finance Department File Number 17-97 (West Idaho at Wheelock Parkway) The Water Utility has a 6-inch water main in that part of West Idaho Avenue lying between Lot 15, Block 3 Rice Street Villas and West Wheelock Pazkway proposed for vacation. To provide for continued access to our facility, the Water Utility requires an easement be retained over the southerly 10 feet of the proposed vacation. Restrictions within the area aze as follows: 1. No buildings, structures or trees aze permitted within the easement azea, or any temporary structure, material storage, fixture or other objects that may prohibit normal access to water facilities for maintenance purposes without written permission from the Water Utility. 2. No change from the existing grade or change in surfacing within the easement azea is permitted without written perxnission from the Water UUlity. 3. Should it be necessary that the petifioner's works or improvements be removed or damaged as a result of Water Utility operations, all removal, replacement or modification costs shall be borne solely by the petitioner. 4. To provide for continued access to our facility, the Water Utility requires an easement be retained over the southerly 10 feet of the proposed vacation. Restrictions within the area aze as follows: 1. No buildings, structures or trees aze permitted within the easement azea, or any temporary structure, material storage, fixture or other objects that may prohibit normal access to water facilities for maintenance purposes without written permission from the Water Utility. 2.
