Gerry Stratiuuan, Legislative Hearing Officer, called the meeting to order at 130 p.m.
204 E. Sidney Street
David Erickson, owner, appeared and stated he is appealing the decision to deny an ea�tension of
time. There was no completion date in the letter he received, therefore he was not notified of the
appeals process and did not lrnow when to get back to the License, Inspections and
Environmental Protection (LIEP) office. Also, the fence is frozen into the ground.
Gerty Strathman stated he has a copy of the letter sent to David Erickson from David Kenyon of
the LIEP office and it does contain a completion date of December 10, 1997. Also, this meeting
is the appeals meeting, therefore Mr. Erickson did learn about it.
Mr. Erickson stated the fence is on the inside of lilac bushes. These lilac bushes may have been
there 100 years and marked the boundaries of the property. The fence installed during that time
is partly on the neighbor's property and partly on Mr. Erickson's properry.
Mr. Strathman responded the letter from the inspector reads the majority of the fence is on the
neighbor's property. Mr. Strathman asked what Mr. Erickson's plans were to resoive this issue.
Mr. Erickson responded there are some property line issues dating back to the 1920's and 1930's
when his dad owned the property. He cannot buy the property because of some legal issues he is
undertaking.
Mr. Strathman stated LIEP made a good faith determination that the fence is improperly located
and built without the proper permits. Mr. Erickson stated November 10 is not the time to remove
a fence from the ground because things are usually frozen at that time. Mr. Strathman responded
that was not the case last November.
Mr. Strathxnan denied the appeal.
608 & 612 Lincoln Avenue
Alan Spaulding, general partner of Cashill Spaulding Properry, appeared and presented pictures.
The properiy consists of 3 apartment buildings that were constructed in 1919. The four garden
level unit windows and the rooms behind them aze being used as bedrooms. The issue from the
Fire Department is that the openings of the windows aze not lazge enough for proper e�t during
an emergency or a fire. There is one set of windows, a 6 foot long crawl space, and then another
set of windows. Even with proper sized windows, it would be an awkward escape. To further
complicate the issue, some people use the crawl space as storage. Mr. Spaulding is looking for a

variance which would allow the rooms to be used as bedrooms. The living room window
escapes are located very close to the bedrooms; there is no hallway between the ]iving rooms and
the bedrooms.
Gerry Strathman asked about altering the windows. Mr. Spaulding stated the windows are over
70 years old and are an asset to renting the apartments. The peopie that choose to live there like
the look of the building.
Pat Fish reported the Fire Department cannot legally give a variance for an escape window. Mr.
Strathman asked why this issue had not been brought up before. Ms. Fish responded the
inspectors do not always measure every window. Mr. Spaulding said the windows are not
grossly undersized and the typical person could exit through them.
Gerry Strathman granted a variance with the following conditions: 1) If there is a reasonable
opportunity as a result of renovation, reconstruction, or repair, the windows will be replaced with
conforming windows; 2} the units will not be rented to people who will be unable to avail
themselves of this exit system.

Sean Alden, representing the property manager, appeared and stated his window problems are
sunilar to the problems at 608 and 612 Lincoln Avenue. The letter Mr. Alden received states the
windows at 1879, 1885, and 1849 East 7�' are too narrow for the current codes. The company
does plan to replace them to conform to the codes.
Pat Fish reported these types of windows are creating moisture problems in the units. Mr. Alden
responded the windows that have moisture problems haue been taken care of by sealing them
from the outside. The ones that haue deteriorated will be replaced with conforming windows.
Gerry Strathman granted a variance with the following conditions: 1) If there is a reasonable
opportunity as a result of renovation, reconstruction, or repair the windows will be replaced with
conforming windows; 2) the units will not be rented to people who will be unable to avail
