RESOLVED, that the Currency Exchange license application by Team Management, Inc.
d/b/a Capital City Check Cashing, for the premises located at 477 Rice Street in Saint Paul, is
recommended for approval. Minnesota Statute §53A.04 requires the approval or disapproval of
the state application by the local governing body.
This resolufion and the action taken above are based upon the proceedings before an
Administrative Law Judge on March 26, 1998, the documents and e�ibits introduced therein,
the testunony offered by and on behalf of the licensee during the Council hearing on Apri122,
1998, and the deliberations of the Council in open session. The Council adopts the Findings of
Fact and Conclusions of Law of the Administrative Law Judge contained in his report. The
report of the ALJ is incorporated in and made part of this resolution.
A copy of this resolution, as adopted, sha11 be sent by first class mail to the
Administrative Law Judge and to the license holder. In addition, a copy of this resolution as
adopted sha11 be delivered by the Office of License, Inspections and Environxnental Protection
and to the Minnesota Commissioner of Commerce.

RECOMMENDATION
The above-entitled matter came on for hearing before Administrative Law
Judge Jon L. Lunde on March 28, 1998, in the City Nalf Annex, 25 West Ke{logg
Boulevard, Saint Paul, MN 55102. The hearing was held pursuant to a Notice
of Pubiic Hearing dated March 6, 1998. The record ciosed at the conciusion of
the scheduled hearing.
Virginia D. Pafiner, Assistant City Attorney, City of Saint Paul, 406 City
Nail and Ramsey County Cou�thouse, 15 West Kellogg Boulevard, Saint Paul,
MN 55102, appeared on behalf of the City of Saint Paui. Carof Toner appeared
on behalf of Team Management, Inc. d/b/a Capital City Check Cashing. There
were no other appearances.
This Report is a recommendation, not a final decision. The Council of the
City of Saint Paui will make a final decision after reviewing the record and may
adopt, reject or modify the Findings of Fact, Conciusions and Recommendations
contained herein. Pursuant fo Saint Paul Legislative Code Section 310.Q5 (c-1),
the final decision of the City Council shall not be made until this Report has been
made available to the pacties to the proceeding and the applicant has been
provided an opportunity to present oral or written arguments alleging error on the
part of the Administrative Law Judge in the application of the law or the
interpretation of the facts and to present argumertt related to any recommended
adverse action. The applicant shouid contact the Council of the City of Saint
Pau{, 310 City Nall, Saint Paul, MN 55102, to ascertain the procedure for
presenting argument.
STATEMENT OF ISSUE
Should this application for a currency exchange license, under Minn. Stat.
Chapter 53A, be approved by the Council of the City of Saint Paul, after
published notice and hearing?
Based upon all of the proceedings herein, the Administrative Law Judge
makes the following:

FiNDINGS OF FACT
1. The Notice of Public Hearing in fhis matter was served on the
Appiicant by the City of Saint Paul on March 6, 1998, by first ciass mail.
2. In accordance with Minn. Stat. § 53A.04 and Chapter 381 of the
Saint Paul Legisiative Code, the City Attomey's Office notified interested persons
of the pub{ic hearing, schedu{ed for March 26, 1998, by publication on March 10,
1998 and by letter on March 6, 1998.
3. Carol Toner, the applicant, Virginia Paimer, the Assistant City
Atfomey, and a representative of the City of Saint Paul Office of License,
inspections and Environmental Protection appeared at the scheduled public
hearing. No testimony was taken. The hearing was scheduled to begin at 9:30
a.m_ After waifing until 9:55 a.m. for an appearance by members of the public,
the undersigned, the appiicant, and Ms. Pafiner concurred that there was no
need to take testimony or to otherwise proceed with a formai hearing. Ms.
Palmer submitted the City's exhibits. It was indicated that no interested persons
had contacted the City after the issuance of the Notice of Pubiic Hearing and that
the appiication was in order.
Sased upon the foregoing Findings of Fact, the Administrative Law Judge
makes the following:
CONCLUSIONS
1. The Council of fhe City of Sairrt Paul and the Administrative Law
Judge have jurisdiction in this matter pursuant to Minn. Stat. § 14.55 and the
Saint Pauf Legislative Code § 381.02, 310.05 and 310.06.
2. The City of Saint Paul has fulfilled all relevant substantive and
procedura� requirements of law and rule.
3. The City of Saint Paul has given proper notice of the hearing in this
matter including proper notice in accordance with the requirements set forth in
Minn. Stat. Chapter 53A and Chapter 381 of the Legisfative Code of the City of
Saint Paul.
4. The applicant has fully complied with the application requirements
specified by law.
5. No member of the public has opposed the application for licensure.
Based upon the foregoing Conclusions, the Administrative Law Judge
makes the following:

IT IS HEREBY RECOMMENDED: that the Council of the City of Saint
Paul approve the currency exchange license application of Capital City Check
Cashing.

a.m_ After waifing until 9:55 a.m. for an appearance by members of the public,
the undersigned, the appiicant, and Ms. Pafiner concurred that there was no
need to take testimony or to otherwise proceed with a formai hearing. Ms.
Palmer submitted the City's exhibits. It was indicated that no interested persons
had contacted the City after the issuance of the Notice of Pubiic Hearing and that
the appiication was in order.
Sased upon the foregoing Findings of Fact, the Administrative Law Judge
makes the following:
CONCLUSIONS
1. The Council of fhe City of Sairrt Paul and the Administrative Law
Judge have jurisdiction in this matter pursuant to Minn. Stat. § 14.55 and the
Saint Pauf Legislative Code § 381.02, 310.05 and 310.06.
2. The City of Saint Paul has fulfilled all relevant substantive and
procedura� requirements of law and rule.
3. The City of Saint Paul has given proper notice of the hearing in this
matter including proper notice in accordance with the requirements set forth in
Minn. Stat. Chapter 53A and Chapter 381 of the Legisfative Code of the City of
Saint Paul.
4. The applicant has fully complied with the application requirements
specified by law.
5. No member of the public has opposed the application for licensure.
Based upon the foregoing Conclusions, the Administrative Law Judge
makes the following:

IT IS HEREBY RECOMMENDED: that the Council of the City of Saint
Paul approve the currency exchange license application of Capital City Check
Cashing.

Commissioner of Commerce of the State of Minnesota for the Commissioner's
