This action is based on the following: On or about Jnly 7, 1997, you pled guilty to Domestic Assault. The above conduct is a misdemeanor violarion of law, and constitutes grounds under Section 376.16(e)(4) of the Saint Paul Legislative Code for denial of your license renewal applicarion. Section 376.16(e)(4) of the Saint Paul Legislative Code does not permit the issuance of a license to a person having a felony conviction within the past five years, or a gross misdemeanor or xnisdemeanor conviction in the previous three years involving the use of force or the threat of use of force. Section 310.06 of the Legislative Code also allows deniat of a license when such matters indicate a lack of good moral character or fitness to engage in the licensed acfivity. Under state law, Minn. Stat. ch. 364, the City of Saint Paul must inform you of certain matters: First, the grounds and reasons for the denial of the license. These gtounds and reasons ate set forth above. Second, any complaints or grievances that you may have will be processed and � � adjudicated in ac - -dance with the procedures set forth in ion 31 OAS of ihe Saint Paul Legislative �ode. These procedures are substantially similar to those required ,�`g by the state administrative procedures act, Minn. Stat. §§ 14.57-.69. � g' Third, the eazliest date on which you may reapply for a taxi driver's license will be one year from the later of the following two dates: (1) the date of your successful completion of supervised probation, with a copy of the department of corrections dischazge order and other documents showing compliance with all terms and conditions of probation; or (2} the date, pursuant to section 310.02 of the Legislative Code, your license is denied by the City of Saint Paul. Future reception of a re- application does not guarantee that there will be sufficient evidence of rehabilitation, nor that a license will be issued at that time. Fourth, if you reapply, the City of Saint Pau1 will consider all competent evadence of rehabilitafion that you wish to present. Examples of ihe type of evidence that will be considered are set forth in section 364.03 of the state law. Since the proposed denial of your renewai application for a license is an adverse action, you are entitled to the hearing procedures established in sections 310.05 and 310.06 of the Saint Paul Legislative Code. You or your attorney w2ll have to make a written request for a hearing if you wish to contest the denial of your renewai application. Hearing Procedures: If you contest the facts stated above in bold type, a hearing on the facts will be heard before an administrative law judge, whose findings and recommendations will be given to the St. Paul City Council for a final determination. If you choose to exercise your right to an administrative hearing, the Office of License, Inspections and Environmental Protecrion will also submit a recommendarion to the judge to recover the cost of the hearing. You may then be held responsible for the cost of the adminish�ative hearing. If you do not wish to contest the facts stated above in bold type, but wish to proceed with the license renewal application process and continue to operate as a taacicab driver with licensure by the City of S� Paul, you will need to admit in writing to the facts stated above in bold type. The matter will then be scheduled for hearing before the St. Paul City Council for a final detemunation regazding the status of your taa�icab drivers license. You will be given an ogportunity to speak on your own behalf at the council hearing. There are many personal extenuating circumstances in this matter, most of which I believe he has already brought to your attention. Especially as a woman, I cannot diminish tl�e severity of his action (nor does he), yet in all my dealings with him in an often stressful work situation, I have always found him to be a gentle man. I have no doubt his action was a one-time result of specific overwhelming pressures in his life. He has no prior history of violence. He has indicated to me that althougli he can't take back what he did, he can leazn and grow to be a better person. And I know he has made a sincere effort towazd that goal. Kevin has spent many yeazs in the taxi business, he is knowledgeable and good with customers. He is most definitely not a Uueat. We need good drivers such as Kevin. Please renew his taxi license. This action is based on the following: On or about Jnly 7, 1997, you pled guilty to Domestic Assault. The above conduct is a misdemeanor violarion of law, and constitutes grounds under Section 376.16(e)(4) of the Saint Paul Legislative Code for denial of your license renewal applicarion. Section 376.16(e)(4) of the Saint Paul Legislative Code does not permit the issuance of a license to a person having a felony conviction within the past five years, or a gross misdemeanor or xnisdemeanor conviction in the previous three years involving the use of force or the threat of use of force. Section 310.06 of the Legislative Code also allows deniat of a license when such matters indicate a lack of good moral character or fitness to engage in the licensed acfivity. Under state law, Minn. Stat. ch. 364, the City of Saint Paul must inform you of certain matters: First, the grounds and reasons for the denial of the license. These gtounds and reasons ate set forth above. Second, any complaints or grievances that you may have will be processed and � � adjudicated in ac - -dance with the procedures set forth in ion 31 OAS of ihe Saint Paul Legislative �ode. These procedures are substantially similar to those required ,�`g by the state administrative procedures act, Minn. Stat. §§ 14.57-.69. � g' Third, the eazliest date on which you may reapply for a taxi driver's license will be one year from the later of the following two dates: (1) the date of your successful completion of supervised probation, with a copy of the department of corrections dischazge order and other documents showing compliance with all terms and conditions of probation; or (2} the date, pursuant to section 310.02 of the Legislative Code, your license is denied by the City of Saint Paul. Future reception of a re- application does not guarantee that there will be sufficient evidence of rehabilitation, nor that a license will be issued at that time. Fourth, if you reapply, the City of Saint Pau1 will consider all competent evadence of rehabilitafion that you wish to present. Examples of ihe type of evidence that will be considered are set forth in section 364.03 of the state law. Since the proposed denial of your renewai application for a license is an adverse action, you are entitled to the hearing procedures established in sections 310.05 and 310.06 of the Saint Paul Legislative Code. You or your attorney w2ll have to make a written request for a hearing if you wish to contest the denial of your renewai application. Hearing Procedures: If you contest the facts stated above in bold type, a hearing on the facts will be heard before an administrative law judge, whose findings and recommendations will be given to the St. Paul City Council for a final determination. If you choose to exercise your right to an administrative hearing, the Office of License, Inspections and Environmental Protecrion will also submit a recommendarion to the judge to recover the cost of the hearing. You may then be held responsible for the cost of the adminish�ative hearing. If you do not wish to contest the facts stated above in bold type, but wish to proceed with the license renewal application process and continue to operate as a taacicab driver with licensure by the City of S� Paul, you will need to admit in writing to the facts stated above in bold type. The matter will then be scheduled for hearing before the St. Paul City Council for a final detemunation regazding the status of your taa�icab drivers license. You will be given an ogportunity to speak on your own behalf at the council hearing. There are many personal extenuating circumstances in this matter, most of which I believe he has already brought to your attention. Especially as a woman, I cannot diminish tl�e severity of his action (nor does he), yet in all my dealings with him in an often stressful work situation, I have always found him to be a gentle man. I have no doubt his action was a one-time result of specific overwhelming pressures in his life. He has no prior history of violence. He has indicated to me that althougli he can't take back what he did, he can leazn and grow to be a better person. And I know he has made a sincere effort towazd that goal. Kevin has spent many yeazs in the taxi business, he is knowledgeable and good with customers. He is most definitely not a Uueat. We need good drivers such as Kevin. Please renew his taxi license. This action is based on the following: On or about Jnly 7, 1997, you pled guilty to Domestic Assault. The above conduct is a misdemeanor violarion of law, and constitutes grounds under Section 376.16(e)(4) of the Saint Paul Legislative Code for denial of your license renewal applicarion. Section 376.16(e)(4) of the Saint Paul Legislative Code does not permit the issuance of a license to a person having a felony conviction within the past five years, or a gross misdemeanor or xnisdemeanor conviction in the previous three years involving the use of force or the threat of use of force. Section 310.06 of the Legislative Code also allows deniat of a license when such matters indicate a lack of good moral character or fitness to engage in the licensed acfivity. Under state law, Minn. Stat. ch. 364, the City of Saint Paul must inform you of certain matters: First, the grounds and reasons for the denial of the license. These gtounds and reasons ate set forth above. Second, any complaints or grievances that you may have will be processed and � � adjudicated in ac - -dance with the procedures set forth in ion 31 OAS of ihe Saint Paul Legislative �ode. These procedures are substantially similar to those required ,�`g by the state administrative procedures act, Minn. Stat. §§ 14.57-.69. � g' Third, the eazliest date on which you may reapply for a taxi driver's license will be one year from the later of the following two dates: (1) the date of your successful completion of supervised probation, with a copy of the department of corrections dischazge order and other documents showing compliance with all terms and conditions of probation; or (2} the date, pursuant to section 310.02 of the Legislative Code, your license is denied by the City of Saint Paul. Future reception of a re- application does not guarantee that there will be sufficient evidence of rehabilitation, nor that a license will be issued at that time. Fourth, if you reapply, the City of Saint Pau1 will consider all competent evadence of rehabilitafion that you wish to present. Examples of ihe type of evidence that will be considered are set forth in section 364.03 of the state law. Since the proposed denial of your renewai application for a license is an adverse action, you are entitled to the hearing procedures established in sections 310.05 and 310.06 of the Saint Paul Legislative Code. You or your attorney w2ll have to make a written request for a hearing if you wish to contest the denial of your renewai application. Hearing Procedures: If you contest the facts stated above in bold type, a hearing on the facts will be heard before an administrative law judge, whose findings and recommendations will be given to the St. Paul City Council for a final determination. If you choose to exercise your right to an administrative hearing, the Office of License, Inspections and Environmental Protecrion will also submit a recommendarion to the judge to recover the cost of the hearing. There are many personal extenuating circumstances in this matter, most of which I believe he has already brought to your attention. Especially as a woman, I cannot diminish tl�e severity of his action (nor does he), yet in all my dealings with him in an often stressful work situation, I have always found him to be a gentle man. I have no doubt his action was a one-time result of specific overwhelming pressures in his life. He has no prior history of violence. He has indicated to me that althougli he can't take back what he did, he can leazn and grow to be a better person. And I know he has made a sincere effort towazd that goal.
