After it is signed please forward it back to my attention. I wiil then forward it to the involved agencies and place it in the critical incident file at the State Capitol. The critical incident teams have been actively training at the State Capitol Complex and a critical incident procedure is in near future. If you should have any questions please feel free to ca11 me at 296-477Q. � � ��;__: ;.:1 ARR/VEALI t/E 98� -3os AGREEvIENT WHEREAS, it is desirous that the City of Saint Paul and the MN Department of Public Safety be prepared to deal adequately with flood, natural disaster, civil disturbance or other emergency occusing within the boundazies of either jurisdiction; and WHEREAS, in order to insure that such preparations be adequate to protect the public peace and safety, and to preserve the lives and property of the peopie of both jurisdictions, it is hereby found and declared to be necessary that the City of Saint Paul and the N1N Department of Public Safety agree to furnish assistance to each other in the event of such emer�ency. NOW, THEREFORE, the City of Saint Paul and MN Public Safety hereby agree to furnish assistance to each other upon the terms and conditions hereinafter set forth, as follows: 1. Wheuever the public anterest requires at, during agreed upon training exercises or on account of an imminent emergency occurring within the boundaries of either jurisdiction, the Mayor of Saint Paul, or his designee, or Commissioner of Public Safety, or his designee, hereinafter called the sending municipality, to fumish police or other force to go to the assistance of the receiving municipality and to request for such purpose personnel, equipment and supplies to the sending municipality. 2. Upon request of the Mayor of Saint Paui or the Commissioner of Public Safety of the receiving municipality, or his designee, the officiai of the sendang municipality, or his designee, sha11 authorize and direct the police or other force of the sending municipality, to assist the receiving municipality and fiirnish the receiving municipality such personnel, equipment and supplies of the sending a�ency, as, in his discretion are available. The sending municipality reserves the right to retain for its own use such qg-�os personnel, equipment and supplies as may be necessary for the proper and adequate protection of the sendin� municipality, or his designee, shall authorize and direct to the receiving municipality only such personnel, equipment and supplies as can, in his discretion, or that of his designee, be safely spared from the sending municipality, and in the case of an emergency azising within the sending municipality while the personnel, equipment and supplies of that municipality are engaged in the receiving municipality, the official of the sending municipatity, or his designee, may, in his discretion, or that of his designee, recall to the sending municipality such personnel, equipment and supplies as he may consider necessary to meet such emergency. 4. White enga�ed in the receiving municipality, the officers and members of such forces of the sending municipality sha11 be paid by ihe sending municipality the same as if performing their regular duties within the sendin� municipality. S. The sending municipality shall be responsible for its own personnel, equipment and supplies and the receiving municipality shail not be held liable for any injuries to personnel or damage to equipment of the sending municipality, nor shall the receiving municipality be required to reimburse the sending municipality for supplies used while so engaged, except that unused equipment and supplies shall be returned to the sending municipality upon the termination of the emergency. The sending municipality shall indemnify the receiving municipality against all claims or actions based upon or arising out of injury or death of officers of tlae sendin� municipality, and dama�e to equipment and supplies of the sendin� municipality while providing police assistance within the receiving municipality. 6. The receiving municipality sha11 not be responsible for any injuries, losses or damages to persons or property arising out of the acts of any of the forces of the sending MUTUAL AID AGREEMENT PAGE2 °�g"- 3os municipality, except that if persons or property not belongin� to either municipality are injured or suffer damages or losses as a result of actions by the sending municipality while specifically carrying out a general assignment of the receiving municipality, such losses shall be the sole and direct responsibility of the receiving municipalin•. The sendin� municipality will not be responsible for any injuries, losses or dama�es arisin� out of the acts of any emplovees or agents of the receiving municipality. 7. Either municipality may request and receive from the other municipality assistance, on an emergency basis, when special personnel, equipment or supplies are needed for emer,�ncy purposes. Tliese emer�encies, noncatastrophic in nature, and limited in scope and duration �vould allow the receiving municipality to take advanta�e of unique capabilities not readily available to the receiving municipality. 8. The sending municipality reserves the right to retain for its own use such unique persom�el, equipment and supplies as may be necessary for the proper and adequate protection of the sending municipality and the official of the sending municipality, or his desi�nee, shall authorize and direct to the receiving municSpality only such personnel, equipment and supplies as can, in his discretion, or that of his designee, be safely spared from the sendin� municipality and in the case of an emer�ency arisin� within the sending municipality while the unique personnel, equipment and supplies of that municipality are en�aged in the receiving municipaiity. The determination of the official of the sending municipality, or his designee, as to r wha[ assistance, as provided herein, shall be final and conclusive, and sha11 give rise to no . liability on the part of the sending municipality for failure to furnish assistance. 10. Each participating municipality is deemed hereby as providing and consenting to, the deputization of all officers responding to any calls hereunder, so that such officers aze properly empowered to enforce all laws, ordinances and regulations of the municipality in which their functions are being performed. The agreement shall be effective only during periods when a Civil Defense Emergency is not in effecT and in the event such Civil Defense Emergency is declared pursuant to ordinance or State or Federal Law, this a�reement shall immediately cease to be effective until such time as such Civi1 Defense Emergency has ended. This agreement shatl be effective ten (10) days after its approval and execution by all parties hereto; shall be for a term of one (1) year; and shalt continue in effect thereafter until and unless canceled by any party upon written notice to the other party. If you should have any questions please feel free to ca11 me at 296-477Q. � � ��;__: ;.:1 ARR/VEALI t/E 98� -3os AGREEvIENT WHEREAS, it is desirous that the City of Saint Paul and the MN Department of Public Safety be prepared to deal adequately with flood, natural disaster, civil disturbance or other emergency occusing within the boundazies of either jurisdiction; and WHEREAS, in order to insure that such preparations be adequate to protect the public peace and safety, and to preserve the lives and property of the peopie of both jurisdictions, it is hereby found and declared to be necessary that the City of Saint Paul and the N1N Department of Public Safety agree to furnish assistance to each other in the event of such emer�ency. NOW, THEREFORE, the City of Saint Paul and MN Public Safety hereby agree to furnish assistance to each other upon the terms and conditions hereinafter set forth, as follows: 1. Wheuever the public anterest requires at, during agreed upon training exercises or on account of an imminent emergency occurring within the boundaries of either jurisdiction, the Mayor of Saint Paul, or his designee, or Commissioner of Public Safety, or his designee, hereinafter called the sending municipality, to fumish police or other force to go to the assistance of the receiving municipality and to request for such purpose personnel, equipment and supplies to the sending municipality. 2. Upon request of the Mayor of Saint Paui or the Commissioner of Public Safety of the receiving municipality, or his designee, the officiai of the sendang municipality, or his designee, sha11 authorize and direct the police or other force of the sending municipality, to assist the receiving municipality and fiirnish the receiving municipality such personnel, equipment and supplies of the sending a�ency, as, in his discretion are available. The sending municipality reserves the right to retain for its own use such qg-�os personnel, equipment and supplies as may be necessary for the proper and adequate protection of the sendin� municipality, or his designee, shall authorize and direct to the receiving municipality only such personnel, equipment and supplies as can, in his discretion, or that of his designee, be safely spared from the sending municipality, and in the case of an emergency azising within the sending municipality while the personnel, equipment and supplies of that municipality are engaged in the receiving municipality, the official of the sending municipatity, or his designee, may, in his discretion, or that of his designee, recall to the sending municipality such personnel, equipment and supplies as he may consider necessary to meet such emergency. 4. White enga�ed in the receiving municipality, the officers and members of such forces of the sending municipality sha11 be paid by ihe sending municipality the same as if performing their regular duties within the sendin� municipality. S. The sending municipality shall be responsible for its own personnel, equipment and supplies and the receiving municipality shail not be held liable for any injuries to personnel or damage to equipment of the sending municipality, nor shall the receiving municipality be required to reimburse the sending municipality for supplies used while so engaged, except that unused equipment and supplies shall be returned to the sending municipality upon the termination of the emergency. The sending municipality shall indemnify the receiving municipality against all claims or actions based upon or arising out of injury or death of officers of tlae sendin� municipality, and dama�e to equipment and supplies of the sendin� municipality while providing police assistance within the receiving municipality. 6. The receiving municipality sha11 not be responsible for any injuries, losses or damages to persons or property arising out of the acts of any of the forces of the sending MUTUAL AID AGREEMENT PAGE2 °�g"- 3os municipality, except that if persons or property not belongin� to either municipality are injured or suffer damages or losses as a result of actions by the sending municipality while specifically carrying out a general assignment of the receiving municipality, such losses shall be the sole and direct responsibility of the receiving municipalin•. The sendin� municipality will not be responsible for any injuries, losses or dama�es arisin� out of the acts of any emplovees or agents of the receiving municipality. 7. Either municipality may request and receive from the other municipality assistance, on an emergency basis, when special personnel, equipment or supplies are needed for emer,�ncy purposes. Tliese emer�encies, noncatastrophic in nature, and limited in scope and duration �vould allow the receiving municipality to take advanta�e of unique capabilities not readily available to the receiving municipality. 8. The sending municipality reserves the right to retain for its own use such unique persom�el, equipment and supplies as may be necessary for the proper and adequate protection of the sending municipality and the official of the sending municipality, or his desi�nee, shall authorize and direct to the receiving municSpality only such personnel, equipment and supplies as can, in his discretion, or that of his designee, be safely spared from the sendin� municipality and in the case of an emer�ency arisin� within the sending municipality while the unique personnel, equipment and supplies of that municipality are en�aged in the receiving municipaiity. The official of the sending municipality, or his desi�nee, may in his discretion, or tl�at of his designee, recail to the sending municipality such persoiuiel, equipment and supplies as , he may consider necessary to meet such emergency. 9. In case weather, road conditions or other circum_tances are such that, in the discretion of the official of the sending municipality, or his designee, personnel, equipment and MUTUAL AiD AGREEMENT PAGE3 9$ -'3o s supplies cannot be fumished to the receiving municipality with reasonable safety he may, in his discretion or that of his designee, refuse to authorize and direct assistance to the receiving municipality. The determination of the official of the sending municipality, or his designee, as to r wha[ assistance, as provided herein, shall be final and conclusive, and sha11 give rise to no . liability on the part of the sending municipality for failure to furnish assistance. 10. Each participating municipality is deemed hereby as providing and consenting to, the deputization of all officers responding to any calls hereunder, so that such officers aze properly empowered to enforce all laws, ordinances and regulations of the municipality in which their functions are being performed. The agreement shall be effective only during periods when a Civil Defense Emergency is not in effecT and in the event such Civil Defense Emergency is declared pursuant to ordinance or State or Federal Law, this a�reement shall immediately cease to be effective until such time as such Civi1 Defense Emergency has ended. This agreement shatl be effective ten (10) days after its approval and execution by all parties hereto; shall be for a term of one (1) year; and shalt continue in effect thereafter until and unless canceled by any party upon written notice to the other party.
