BE IT RESOLVED, that, upon the petition of Jack and Theresa Nelson, as documented in
Technology Department File Number 28-97, public properties hereinafter described are hereby
vacated and discontinued as public property: and, subject to the herein stated exceptions, the
easements within those public properties are hereby released.
The properry to be vacated is described as follows:
The North-South alley abutting Lots 1 through 6, Block 6, Suinmit Avenue Addition.to the
City of Saint Paul.
This vacation shall be subject to the terms and condition of Chapter 130, codified March i, 1981, of
the Saint Paul Legislative Code as amended, and to the following conditions:
1. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee
for this vacation which is due and payable withiu 60 days of the effective date of this
resolution.
2. That a permanent utiliry easement shail be retained on, over, under and across the vacated area
to protect the interests of Northern States Power Company. .
3. That the petitioner's their successors, and assigns agree to indemnify, defend and save
harniless the City of Saint Paul, its officers, and employees from all suits, ac6ons, or clanns of
any character brought as a result of injuries or damages received or sustained by any person,
persons, or property on account of this vacation or petitioner's use of this property, including
but not limited to a claim brought because of any act of omission, neglect, or misconduct of
said petitioner or because of any claims or liabiliry arising from any violation of any law or
regulation made in accordance with the law, whether by the petitioner or any of their agents or
employees

1 4. That the petitioner's their successors, and assigns, shal] within 60 days of the effective date of
2 this resolution, file with the City Clerk an acceptance in writing of the conditions of this
3 resolution and shall within the period(s) specified in the terms and conditions of this resolution,

We, 7ack and Theresa Nelson, Mazgazet M. Lindorfer and Super America Crroup Inc., the
undersigned, constituting a majority of the owners (or their legally designated representatives) of
the abutting properties, do hereby petition the Council of the City of 5aint Paul to vacate its
interests in the property legally described as follows:
The alley situated between 1563 Portland Avenue (legally described as 5ummit
Avenue Addition to the City of St. Paul Subject To the Easement over North 10 ft
of the West 50 ft of lots 1, 2 and 3, Block 6) and Super America, 56 Snelling
Avenue North (legally described as Summit Avenue Addition to The City of St.
Paul East 47.68 ft of lot 4, 5 and 6, Block 6). This alley is a graveled surface that
nobody has used for many yeazs. It was part of a t-shaped alley that no ]onger
e�sts and now is a dead end. It has been maintained by the owners of 1563
Portland Avenue since they have lived there in 1991.
PURPOSE: To acquire land for the owners of 1563 Portland Avenue to have the space to
constmct a driveway, landscape the property and safeguard it for an improved space within which
the Nelson children may play. There is insufficient land to do so with their current property line.

compensation and acceptance of the conditions of the vacation. They can be reached at 659-

BE IT RESOLVED, that, upon the petition of Jack and Theresa Nelson, as documented in
Technology Department File Number 28-97, public properties hereinafter described are hereby
vacated and discontinued as public property: and, subject to the herein stated exceptions, the
easements within those public properties are hereby released.
The properry to be vacated is described as follows:
The North-South alley abutting Lots 1 through 6, Block 6, Suinmit Avenue Addition.to the
City of Saint Paul.
This vacation shall be subject to the terms and condition of Chapter 130, codified March i, 1981, of
the Saint Paul Legislative Code as amended, and to the following conditions:
1. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee
for this vacation which is due and payable withiu 60 days of the effective date of this
resolution.
2. That a permanent utiliry easement shail be retained on, over, under and across the vacated area
to protect the interests of Northern States Power Company. .
3. That the petitioner's their successors, and assigns agree to indemnify, defend and save
harniless the City of Saint Paul, its officers, and employees from all suits, ac6ons, or clanns of
any character brought as a result of injuries or damages received or sustained by any person,
persons, or property on account of this vacation or petitioner's use of this property, including
but not limited to a claim brought because of any act of omission, neglect, or misconduct of
said petitioner or because of any claims or liabiliry arising from any violation of any law or
regulation made in accordance with the law, whether by the petitioner or any of their agents or
employees

We, 7ack and Theresa Nelson, Mazgazet M. Lindorfer and Super America Crroup Inc., the
undersigned, constituting a majority of the owners (or their legally designated representatives) of
the abutting properties, do hereby petition the Council of the City of 5aint Paul to vacate its
interests in the property legally described as follows:
The alley situated between 1563 Portland Avenue (legally described as 5ummit
Avenue Addition to the City of St. Paul Subject To the Easement over North 10 ft
of the West 50 ft of lots 1, 2 and 3, Block 6) and Super America, 56 Snelling
Avenue North (legally described as Summit Avenue Addition to The City of St.
Paul East 47.68 ft of lot 4, 5 and 6, Block 6). This alley is a graveled surface that
nobody has used for many yeazs. It was part of a t-shaped alley that no ]onger
e�sts and now is a dead end. It has been maintained by the owners of 1563
Portland Avenue since they have lived there in 1991.
PURPOSE: To acquire land for the owners of 1563 Portland Avenue to have the space to
constmct a driveway, landscape the property and safeguard it for an improved space within which
the Nelson children may play. There is insufficient land to do so with their current property line.

compensation and acceptance of the conditions of the vacation. They can be reached at 659-

BE IT RESOLVED, that, upon the petition of Jack and Theresa Nelson, as documented in
Technology Department File Number 28-97, public properties hereinafter described are hereby
vacated and discontinued as public property: and, subject to the herein stated exceptions, the
easements within those public properties are hereby released.
The properry to be vacated is described as follows:
The North-South alley abutting Lots 1 through 6, Block 6, Suinmit Avenue Addition.to the
City of Saint Paul.
This vacation shall be subject to the terms and condition of Chapter 130, codified March i, 1981, of
the Saint Paul Legislative Code as amended, and to the following conditions:
1. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee
for this vacation which is due and payable withiu 60 days of the effective date of this
resolution.
2. That a permanent utiliry easement shail be retained on, over, under and across the vacated area
to protect the interests of Northern States Power Company. .
3. That the petitioner's their successors, and assigns agree to indemnify, defend and save
harniless the City of Saint Paul, its officers, and employees from all suits, ac6ons, or clanns of
any character brought as a result of injuries or damages received or sustained by any person,
persons, or property on account of this vacation or petitioner's use of this property, including
but not limited to a claim brought because of any act of omission, neglect, or misconduct of
said petitioner or because of any claims or liabiliry arising from any violation of any law or
regulation made in accordance with the law, whether by the petitioner or any of their agents or
employees

1 4. That the petitioner's their successors, and assigns, shal] within 60 days of the effective date of
2 this resolution, file with the City Clerk an acceptance in writing of the conditions of this
3 resolution and shall within the period(s) specified in the terms and conditions of this resolution,

We, 7ack and Theresa Nelson, Mazgazet M. Lindorfer and Super America Crroup Inc., the
undersigned, constituting a majority of the owners (or their legally designated representatives) of
the abutting properties, do hereby petition the Council of the City of 5aint Paul to vacate its
interests in the property legally described as follows:
The alley situated between 1563 Portland Avenue (legally described as 5ummit
Avenue Addition to the City of St. Paul Subject To the Easement over North 10 ft
of the West 50 ft of lots 1, 2 and 3, Block 6) and Super America, 56 Snelling
Avenue North (legally described as Summit Avenue Addition to The City of St.
Paul East 47.68 ft of lot 4, 5 and 6, Block 6). This alley is a graveled surface that
nobody has used for many yeazs. It was part of a t-shaped alley that no ]onger
e�sts and now is a dead end. It has been maintained by the owners of 1563
Portland Avenue since they have lived there in 1991.
PURPOSE: To acquire land for the owners of 1563 Portland Avenue to have the space to
constmct a driveway, landscape the property and safeguard it for an improved space within which
the Nelson children may play. There is insufficient land to do so with their current property line.

compensation and acceptance of the conditions of the vacation. They can be reached at 659-
