WHEREAS, Saint Paul City Charter § 5.02 permits the City, upon recommendation of the
City Attorney and in the case of special or unusual circumstances, to appoint outside counsel to
represent the Ciry; and
WHEREAS, special and unusual conditions exist in the matter of the condemnation and taking
of certain property owned by Plastics, Inc. for the new Science Museum project including the
construction of Eagle Parkway due to the availability of City Attomey staff to represent the City in
this matter given the very short period of time in which the subject property must be acquired; and
WHEREAS, the Ciry Attorney has recommended the appointment of outside counsel far this
matter; NOW, THEREFORE,
BE IT RESOLVED, that the law firm of Dougherty, Rumble and Butler be retained and
appointed to represent the City in the matter of the condemnation and taking of certain property owned
by Plastics Inc. for the New Science Museum Project and for the construction of Eagle Parkway. The
fees to be paid for legal services including an undated real estate appraisal will be $50,000.00, said
fees to be taken from the City's previously approved Science Museum of Minnesota budget.

G�rrent negotiations with Plastics Inc. have reached the stage where the City needs to .'
initiate condemnation proceedings. The City needs the site for the new Science Muse�
and for the construction of Eagle Parkway. Because of the tight time frame and the
limited availability of the City Attarney staff the City needs to hire outside
attorney services and special expertises of the condemnation statute.
