In the matter of condemning and taking permanent easements for water utiliTy purposes in connection with the
Jackson/Maryland "Low Service Number 2" relocation project described as follows:
a permanent easement to construct a bridge for Water UtiliTy purposes over and across that part of the
easterly 25.00 feet of Lot 1, Block 1, Burlina on Industrial Pazk, according to the plat thereof and of record
in the O�ce of the County Recorder of Ramsey County, Minnesota, lying southerly of a line described as
follows:
Commencingat the southeastcorner of Lot 1, Block 1, BurlingtonIndustrial Park; thence northerly
along the east line of said Block 1, a distance of 50.00 feet to the beginning of the line to be
described;thence southwesterly,deflectingto the left 135 degrees 00 minutes 00 seconds, a distance
of 3536 feet, more or less, to a point 25.00 feet west of the east line of said Block 1, and said line
there terminating.
Also, that part of the Burlington Northern, Sante Fe Railroad right-of-way which lies between the
west right-of-way line of Jackson Street and a line drawn parallel with and distant 25.00 feet, to the
west right-of-way of Jackson Street, and which lies between the south line of Burlington Industrial
Park, and the north line of Soo Line Plat Number 3, each accordingto the plats thereofand of record
in the Office of the CounTy Recorder of Ramsey County, Minnesota.
Also, that part of the easterly 25.00 feet of Lot I, Soo Line Plat No. 3, according to the plat thereof
and of record in the Office of the County Recorder of Ramsey County, Minnesota, lying northerly
of a line described as follows:
Commencing at the northeast corner of Lot I, Soo Line Plat No. 3; thence southerly along
the east line of said Lot I a distance of 60.00 feet, to the point of beginning; thence
northwesterly, deflecting to the right 135 degrees 00 tninutes 00 seconds 3536 feet, more
or less to a point 25.00 feet west of the east line of said Lot I and said line there terminating

right-of-way line of Jackson Street; thence southerly along the east right-of way line of Jackson
Street, having an assumed bearing of South 00 degrees 20 minutes 58 seconds East, a distance of
17.0 feet to the point of beginning; thence South 45 degrees 20 minutes 58 seconds East, a distance
of 73.54 feet; thence South 00 degrees 20 minutes 58 seconds East, a distance of 259.03 feet; thence
South 36 degrees 09 minutes 57 seconds East, a distance of 613.21, feet more or less, to a point on
the south right-of-way line of vacated East Maryland Avenue which is 89.39 feet west of the
northeastcomer of Block 1, Itansom's Addition to Saint Paui, according to the plat thereof and of

terminating. The sides of said easement shall be lengthened or shortened to terminate on the east

Addition to Saint Paul which lies west of a line drawn pazallel with and 80.00 feet northeasterly of Soo
Line's (formerlyMinneapolis, St Paul and Sault Ste. Marie Railroad Company's) Main track centerline as

appropriated for the above improvement and to whom payable; and also having submitted

RESOLVED, That the said assessment of benefits be and the same is hereby
approved.
RESOLVED FURTHER, That a public hearing be had before the Council upon said
report and for a confirmation of the award of damages made by the Director of
Technology and also upon the said assessment of benefits; at the Council Chamber,
in the Court House in the City of St. Paul on the 22nd day of A�ril. 1998. at the
hour of 5:30 o'clock P.M. and that the Director of Technology be and he is directed
to give notice of said hearing as prescribed by the Charter.
